2. Assist<strong>an</strong>ce may be postponed by the requested authority on the ground that it<br />

would interfere <strong>with</strong> <strong>an</strong> ongoing investigation, prosecution or proceeding. In such a<br />

case, the requested authority shall consult <strong>with</strong> the applic<strong>an</strong>t authority <strong>to</strong> determine<br />

whether assist<strong>an</strong>ce c<strong>an</strong> be given subject <strong>to</strong> such terms or conditions as the<br />

requested authority may require.<br />

3. Where the applic<strong>an</strong>t authority seeks assist<strong>an</strong>ce which it would itself be<br />

unable <strong>to</strong> provide if so requested, it shall draw attention <strong>to</strong> that fact in its request. It<br />

shall then be for the requested authority <strong>to</strong> decide how <strong>to</strong> respond <strong>to</strong> such a request.<br />

4. In the cases referred <strong>to</strong> in paragraphs 1 <strong>an</strong>d 2, the decision of the requested<br />

authority <strong>an</strong>d the reasons for it must be communicated <strong>to</strong> the applic<strong>an</strong>t authority<br />

<strong>with</strong>out delay.<br />

ARTICLE 10<br />

Exch<strong>an</strong>ge of information <strong>an</strong>d confidentiality<br />

1. Any information communicated in whatsoever form pursu<strong>an</strong>t <strong>to</strong> this Pro<strong>to</strong>col<br />

shall be of a confidential or restricted nature, depending on the rules applicable in<br />

each of the Parties. It shall be covered by the obligation of official secrecy <strong>an</strong>d shall<br />

enjoy the protection extended <strong>to</strong> similar information under the relev<strong>an</strong>t laws of the<br />

Party that received it <strong>an</strong>d the corresponding provisions applying <strong>to</strong> the Community<br />

authorities.<br />

2. Personal data may be exch<strong>an</strong>ged only where the Party which may receive<br />

them undertakes <strong>to</strong> protect such data in a m<strong>an</strong>ner at least equivalent <strong>to</strong> that<br />

applying <strong>to</strong> the particular case in the Party that may supply them. To that end, the<br />

Parties shall inform each other of their applicable rules, including, where<br />

appropriate, legal provisions in force in the Member States of the Europe<strong>an</strong><br />

Community.<br />

3. The use, in judicial or administrative proceedings instituted in respect of<br />

operations in breach of cus<strong>to</strong>ms legislation, of information obtained under this<br />

Pro<strong>to</strong>col is considered <strong>to</strong> be for the purposes of this Pro<strong>to</strong>col. The Parties may<br />

therefore, in their records of evidence, reports <strong>an</strong>d testimonies <strong>an</strong>d in proceedings<br />

<strong>an</strong>d charges brought before the courts, use as evidence information obtained <strong>an</strong>d<br />

documents consulted in accord<strong>an</strong>ce <strong>with</strong> the provisions of this Pro<strong>to</strong>col. The<br />

competent authority which supplied that information or gave access <strong>to</strong> those<br />

documents shall be notified of such use.<br />

4. Information obtained shall be used solely for the purposes of this Pro<strong>to</strong>col.<br />

Where one of the Parties wishes <strong>to</strong> use such information for other purposes, it shall<br />

obtain the prior written consent of the authority which provided the information.<br />

Such use shall then be subject <strong>to</strong> <strong>an</strong>y restrictions laid down by that authority.
