This should involve close cooperation between all relev<strong>an</strong>t agencies <strong>an</strong>d be based,<br />

wherever possible, on the use of relev<strong>an</strong>t international st<strong>an</strong>dards.<br />

CHAPTER 4<br />

TECHNICAL BARRIERS TO TRADE, AND SANITARY AND<br />

PHYTOSANITARY MEASURES<br />

ARTICLE 40<br />

Objectives<br />

The objectives of this Chapter are <strong>to</strong> facilitate trade in products between the Parties<br />

while increasing the capacity of the Parties <strong>to</strong> identify, prevent <strong>an</strong>d eliminate<br />

obstacles <strong>to</strong> trade as a result of technical regulations, st<strong>an</strong>dards <strong>an</strong>d conformity<br />

assessment procedures applied by either Party, <strong>an</strong>d increasing the capacity of the<br />

Parties <strong>to</strong> protect pl<strong>an</strong>ts, <strong>an</strong>imals <strong>an</strong>d public health.<br />

ARTICLE 41<br />

Multilateral obligations <strong>an</strong>d general background<br />

1. The Parties reaffirm their rights <strong>an</strong>d obligations under the WTO <strong>Agreement</strong>,<br />

<strong>an</strong>d in particular the WTO <strong>Agreement</strong>s on the Application of S<strong>an</strong>itary <strong>an</strong>d<br />

Phy<strong>to</strong>s<strong>an</strong>itary Measures (SPS <strong>Agreement</strong>) <strong>an</strong>d on Technical Barriers <strong>to</strong> Trade (TBT<br />

<strong>Agreement</strong>). The Parties which are not members of the WTO also confirm their<br />

commitment <strong>to</strong> comply <strong>with</strong> the obligations set out in the SPS <strong>an</strong>d TBT<br />

<strong>Agreement</strong>s <strong>with</strong> regard <strong>to</strong> all matters concerning relations between the Parties.<br />

2. The Parties reaffirm their commitment <strong>to</strong> improve public health in the<br />

terri<strong>to</strong>ries of the signa<strong>to</strong>ry Central Afric<strong>an</strong> States, in particular by strengthening<br />

their capacity <strong>to</strong> identify unsafe products, pursu<strong>an</strong>t <strong>to</strong> Article 47 of this Chapter.<br />
