CHAPTER 2<br />

TRADE DEFENCE INSTRUMENTS<br />

ARTICLE 29<br />

Anti-dumping <strong>an</strong>d countervailing measures<br />

1. Subject <strong>to</strong> the provisions of this Article, nothing in this <strong>Agreement</strong> shall be<br />

construed <strong>to</strong> prevent the EC Party or the signa<strong>to</strong>ry Central Afric<strong>an</strong> States,<br />

individually or collectively, from adopting <strong>an</strong>ti-dumping or countervailing<br />

measures in accord<strong>an</strong>ce <strong>with</strong> the relev<strong>an</strong>t WTO <strong>Agreement</strong>s. For the purposes of<br />

this Article, origin shall be determined in accord<strong>an</strong>ce <strong>with</strong> the Parties' nonpreferential<br />

rules of origin.<br />

2. Before imposing definitive <strong>an</strong>ti-dumping or countervailing duties in respect<br />

of products from signa<strong>to</strong>ry Central Afric<strong>an</strong> States, the EC Party shall consider the<br />

possibility of constructive remedies as provided for in the relev<strong>an</strong>t WTO<br />

<strong>Agreement</strong>s.<br />

3. Where <strong>an</strong> <strong>an</strong>ti-dumping or countervailing measure has been imposed for two<br />

or more signa<strong>to</strong>ry Central Afric<strong>an</strong> States by a regional or sub-regional authority,<br />

there shall be one single inst<strong>an</strong>ce of judicial review, including the stage of appeals.<br />

4. Where <strong>an</strong>ti-dumping or countervailing measures may be imposed on a<br />

regional or sub-regional basis <strong>an</strong>d on a national basis, the Parties guar<strong>an</strong>tee that<br />

these measures shall not be applied simult<strong>an</strong>eously <strong>to</strong> the same product by the<br />

regional or subregional authorities <strong>an</strong>d the national authorities.<br />

5. The EC Party shall notify the signa<strong>to</strong>ry Central Afric<strong>an</strong> States of the receipt<br />

of a properly documented complaint before initiating <strong>an</strong>y investigation.<br />

6. The provisions of this Article shall be applicable in all investigations initiated<br />

after this <strong>Agreement</strong> enters in<strong>to</strong> force.<br />

7. The provisions of this Article shall not be subject <strong>to</strong> the dispute settlement<br />

provisions of this <strong>Agreement</strong>.<br />

ARTICLE 30<br />

Multilateral safeguard measures<br />

1. Subject <strong>to</strong> the provisions of this Article, nothing in this <strong>Agreement</strong> shall be<br />

construed <strong>to</strong> prevent the signa<strong>to</strong>ry Central Afric<strong>an</strong> States or the EC Party from<br />
