SIXIEME PARTIE: MAINTIEN EN <strong>DE</strong>TENTION<br />

Vu les règles 63, 64, 66, 68 et 82 du Règlement intérieur,<br />

Vu la demande de mise en liberté déposée par la défense de Nuon Chea le 8 septembre 2010 (C65 –<br />

la « Demande de mise en liberté »),<br />

Vu les observations des co-procureurs en date du 13 septembre 2010 (C65/2),<br />

I. SUR LA <strong>DE</strong>MAN<strong>DE</strong> <strong>DE</strong> MISE EN LIBERTE <strong>DE</strong> NUON CHEA<br />

A. RAPPEL <strong>DE</strong> LA PROCEDURE<br />

1614. Le 8 septembre 2010, la défense de Nuon Chea a déposé une Demande de remise en liberté<br />

de son client, soutenant que :« provisional detention specifically refers to the time spent in<br />

custody ‘pending a final judgement’ and the only possible endpoints of such a period are<br />

conviction, acquittal, final appellate determination or provisional release » 5405 ; « the<br />

maximum period allowable under Cambodian law in which to provisionally detain Nuon<br />

Chea is three years » 5406 ;« any extension of provisional detention by the OCIJ - including the<br />

four-months enlargement allowed under the CCP and the Rules - must be subsumed within<br />

the global three-year period » 5407 .<br />

1615. Au vu de ces éléments, la défense demande aux co-juges d’instruction de mettre un terme à la<br />

détention provisoire de Nuon Chea à l’expiration de la période de trois ans, soit le 19<br />

septembre 2010.<br />

1616. Les co-procureurs demandent que la Demande de remise en liberté déposée par Nuon Chea<br />

soit rejetée, affirmant que : “The operative law governing the provisional detention of the<br />

Charged Person is contained in the Rules”; “the Rules do not establish a three-year maximum<br />

period of provisional detention that applies to both the judicial investigation and trial<br />

proceedings (…)”; et “the provisional detention of the Charged Person for longer than three<br />

years would not violate international standards of justice, given the complexity of the case,<br />

the seriousness of the charges and the diligence of the Court to date” 5408 . En conséquence, les<br />

co-procureurs font valoir que : “the Charged Person’s Application for Provisional Release<br />

should be denied and that, pursuant to Rule 68, the Co-Investigating Judges should continue<br />
