De plus, le Manuel entreprend de clarifier certains problèmes spécifiques
aux hostilités maritimes : l’utilisation de certaines armes (mines, torpilles) a
été précisée ; les interactions entre navires et aéronefs ont été abordées ; le
développement du droit de la mer a été pris en compte par la distinction entre
les différentes zones maritimes, etc.
La nature non contraignante de ce texte et la faible occurrence des guerres
sur mer ne privent pas pour autant le Manuel de San Remo de son utilité
aujourd’hui. Les États ont désormais à leur disposition un texte cohérent, qui
leur permet de prendre en compte le droit de la guerre sur mer dans leurs
actions et leur législation8 . Il s’agit actuellement du principal texte de référence
en matière de droit de la guerre sur mer.
