8. La population civile ne doit pas être utilisée pour protéger les
objectifs militaires

Texte introductif
Le droit international humanitaire (DIH) interdit les attaques contre la
population civile et les biens de caractère civil25 . Le DIH interdit également
l’abus de cette interdiction : les civils, la population civile, et certains biens
spécialement protégés ne peuvent pas être utilisés comme bouclier pour
protéger un objectif militaire des attaques26 . Le facteur décisif pour distinguer
l’utilisation de boucliers humains du non-respect de l’obligation de prendre
des précautions passives27 est de savoir si le fait que des combattants et/ou
des objectifs militaires soient mêlés à la population civile est délibérément
voulu par la partie attaquée afin d’obtenir une « protection » pour ses forces et
