Section 4.05. The principal of, and service charges on, the Credit shall
be paid without deduction for, and free from, any taxes, and free from all
restrictions, imposed under the laws of the Borrower or laws in effect in its
territories.
Section 4.06. The Development Credit Agreement and the Project
Agreement shall be free from any taxes that shall be imposed under the laws
of the Borrower or laws in effect in its territories on or in connection with
the execution, delivery or registration thereof.
Section 4.07. (a) The Borrower shall from time to time take or cause
to be taken such steps (including, but without limitation, adjustments in
the rates and fares of the R~gie) as shall be required to provide the Rdgie
with revenues sufficient, by such date or dates as shall be agreed upon between
the Borrower, the Association and the Rdgie: (i) to ensure a reasonable
return on the Rdgie's net fixed assets, after covering all operating expenses,
including adequate maintenance and depreciation; and (ii) to enable the
R~gie, out of its cash resources, to meet debt interest and amortization, to
establish and maintain adequate working capital, and to finance a material
part of its capital expenditures.
(b) Without prejudice to the provisions of paragraph (a) of Section
4.03 of this Agreement, the Borrower shall make arrangements, satisfactory
to the Association, promptly to provide the Rdgie or cause the Rdgie to be
provided, during such time as the Rdgie's revenues shall be insufficient to
meet the items in paragraph (a) (ii) of this Section, with funds sufficient to
meet such items.
Section 4.08. The Borrower shall take or cause the Rdgie to take such
action as shall be reasonable in the circumstances to facilitate railway operations
between its territories and the territories of the Republic of Mali,
in accordance with the International Traffic Agreement, the Customs Agreement
and the Railway Convention.
Article V
REMEDIES OF THE AssOCIATION
Section 5.01. (i) If any event specified in paragraph (a) or paragraph
(c) of Section 5.02 of the Regulations shall occur and shall continue for a
period of thirty days, or (ii) if any event specified in paragraph (b) of Section
5.02 of the Regulations or in paragraphs (a), (b) or (c) of Section 5.02 of this
Agreement shall occur and shall continue for a period of sixty days after
notice thereof shall have been given by the Association to the Borrower, then
at any subsequent time during the continuance thereof the Association, at
