382 IWGIA – EL MUNDO INDIGENA – 2013KENIAEn Kenia, los pueblos que se identifican con el movimiento indígena sonprincipalmente pastoralistas y cazadores recolectores, así como algunospueblos pescadores y pequeñas comunidades agrícolas. Se estima que lospastoralistas comprenden un 25% de la población nacional, mientras que lamayor comunidad de cazadores recolectores cuenta aproximadamente con79.000 personas. 1 Los pastoralistas ocupan en su mayoría las tierras áridasy semiáridas del norte de Kenia y la frontera entre Kenia y Tanzania al sur.Los cazadores recolectores incluyen a los ogiek, sengwer, yaaku, waata, elmolo, aweri (boni), malakote, wagoshi y sanye, mientras que entre los pueblospastoralistas están los turkana, rendille, borana, maasai, samburu, ilchamus,somali, gabra, pokot, endorois y otros. Todos se enfrentan a inseguridaden la tenencia de la tierra y los recursos, deficiente prestación de serviciosbásicos, escasa representación política, discriminación y exclusión. Susituación parece empeorar cada año, exacerbada por una creciente competenciapor los recursos en sus zonas.No existe una legislación específica sobre los pueblos indígenas de Kenia.Sin embargo, la Constitución de 2010 identifica específicamente a lasminorías y comunidades marginadas como grupos que necesitan mayor proteccióny atención por parte del Estado. La definición constitucional de gruposmarginados, al ser amplia, engloba a la mayoría de los grupos que seidentifican como pueblos indígenas. Kenia no ha ratificado el Convenio 169de la OIT y se abstuvo de votar cuando la Asamblea General de las NacionesUnidas adoptó la Declaración de las Naciones Unidas sobre los Derechos delos Pueblos Indígenas, en 2007. En 2012, la oposición de Kenia a la existenciade comunidades indígenas en el país parece haberse invertido en el Consejode Derechos Humanos cuando el país manifestó que su gobierno reconocíalas vulnerabilidades de minorías y comunidades marginadas. Este reconocimientoprepara el camino para una defensa más profunda por parte delas comunidades.
