LAUDO DE ARBITRAJE 17 CASO A-05-678A base <strong>de</strong> lo anterior, la Unión no cumplió con el procedimiento <strong>de</strong> quejas yagravios para el trámite <strong>de</strong> la presente querella, por lo que la misma no seríaarbitrable procesalmente.Ahora bien, fue planteado por la Unión que le es aplicable al presente caso ladoctrina <strong>de</strong> querella continua (violación o agravio continuo), lo cual <strong>de</strong>rrotaría lostérminos provistos bajo el procedimiento <strong>de</strong> quejas y agravios.Varios tratadistas en el campo laboral reconocen la existencia <strong>de</strong> violacionescontinuas a un convenio. Los tratadistas Elkouri & Elkouri han señalado lo siguiente:Many arbitrators have held that ‘continuing’violations of theagreements (as opossed to a single isolated and completedtransaction) give rise to ‘continuing’grievances in the sensethat the act complained of may be said to be repeated fromday to day, with each day treated as a new ’ocurrence’.These arbitrators permit the filing of such grievances at anytime, although any back pay would ordinarily accrued onlyfrom the date of filing. For example, where the agreementprovi<strong>de</strong>d for filing ‘within ten working days of theocurrence’, it was held that where employees wereerroneously <strong>de</strong>nied work, each day lost was to be consi<strong>de</strong>redan ‘ocurrence’and that a agrievance presented within 10working days of any such day lost would be timely. 7Fairweather, a<strong>de</strong>más, señala:If the grievant continues to suffer from the alleged contractviolation, the arbitrator may find that the violation is acontinuing one.
