EDICTO<br />
D/Dª ROSARIO MARISCAL RUIZ, SECRETARIO/A JUDICIAL DEL JUZ-<br />
GADO DE LO SOCIAL NUMERO 2 DE JEREZ DE LA FRONTERA. HACE SABER:<br />
Que en los autos seguidos en este Juzgado bajo el número 502/20<strong>08</strong> a instancia <strong>de</strong> la parte actora<br />
D/Dª LUIS MARIA JIMENEZ GUERRERO contra CERRAJEREZ S.L., HIERROS H.<br />
HUARTE S.L.U. y VEHICULOS Y PROMOCIONES S.L. sobre Despidos/ Ceses en<br />
general se ha dictado SENTENCIA <strong>de</strong> fecha 6-5-<strong>08</strong> que sustancialmente dice lo siguiente:<br />
SENTENCIA N° <strong>19</strong>8/<strong>08</strong>. En Jerez <strong>de</strong> la Frontera, a seis <strong>de</strong> mayo <strong>de</strong>l año dos mil ocho.<br />
Vistos por el SR. D. RAÚL PÁEZ ESCÁMEZ, Magistrado-Juez <strong>de</strong>l Juzgado<br />
<strong>de</strong> lo Social número Dos <strong>de</strong> los <strong>de</strong> Jerez <strong>de</strong> la Frontera y su Partido, los presentes autos<br />
registrados con el número 502/20<strong>08</strong> y entre las siguientes partes:<br />
Demandante.- D. LUIS MARIA JIMÉNEZ GUERRERO, asistido por el<br />
Letrado D. José Hurtado Chacón.<br />
Demandada.- Las entida<strong>de</strong>s CERRAJEREZ S.L., HIERROS H. HUARTE<br />
S.L.U. y VEHICULOS Y PROMOCIONES LOPEZ S.L., no comparecidas en autos.<br />
Fue citado igualmente el FOGASA, que compareció asistido por el Letrado D.<br />
Lorenzo Martínez Infante.<br />
Causa.- Despido.<br />
FALLO. Que ESTIMANDO la <strong>de</strong>manda interpuesta por D. LUIS MARÍA<br />
JIMÉNEZ GUERRERO, contra la entidad CERRAJEREZ S.L., y DESESTIMANDO<br />
la <strong>de</strong>manda interpuesta frente a HIERROS H. HUARTE S.L.U. y VEHICULOS Y<br />
PROMOCIONES LOPEZ S.L., DEBO DECLARAR Y DECLARO la nulidad <strong>de</strong>l<br />
<strong>de</strong>spido efectuado en fecha 25.01.20<strong>08</strong>, siendo que al amparo <strong>de</strong>l artículo 284 <strong>de</strong> la Ley<br />
<strong>de</strong> Procedimiento Laboral, DEBO DECLARAR Y DECLARO LA EXTINCIÓN DE<br />
LA RELACIÓN LABORAL a la fecha <strong>de</strong> la presente resolución, con con<strong>de</strong>na a la<br />
<strong>de</strong>mandada CERRAJEREZ S.L. al abono <strong>de</strong> una in<strong>de</strong>mnización <strong>de</strong> 45 días <strong>de</strong> salario<br />
por año <strong>de</strong> servicio prorrateándose por meses los periodos inferiores a un año,<br />
computada hasta la fecha <strong>de</strong> la presente resolución, cifrada en 2.544,36 euros.<br />
Junto a ello, proce<strong>de</strong> con<strong>de</strong>nar a la <strong>de</strong>mandada CERRAJEREZ S.L. al abono<br />
<strong>de</strong> los salarios <strong>de</strong> tramitación <strong>de</strong>jados <strong>de</strong>vengados <strong>de</strong>s<strong>de</strong> el 25.01.20<strong>08</strong> hasta la presente<br />
fecha, a razón <strong>de</strong> 47,40 euros al día.<br />
Todo ello ABSOLVIENDO a los restantes <strong>de</strong>mandados <strong>de</strong> la totalidad <strong>de</strong><br />
pedimentos articulados en su contra en el curso <strong>de</strong> las actuaciones.<br />
Notifíquese la anterior sentencia a las partes interesadas, advirtiéndoles que<br />
contra la misma, <strong>de</strong> conformidad con lo dispuesto en la Ley <strong>de</strong> Procedimiento Laboral,<br />
cabe RECURSO DE SUPLICACION ante la Sala <strong>de</strong> lo Social <strong>de</strong>l Tribunal Superior <strong>de</strong><br />
Justicia <strong>de</strong> Andalucía, que <strong>de</strong>berá anunciarse <strong>de</strong>ntro <strong>de</strong> los CINCO días siguientes a la<br />
notificación <strong>de</strong> la presente resolución, bastando para ello la mera manifestación <strong>de</strong> la<br />
parte o <strong>de</strong> su Abogado o representante, al hacerle la notificación <strong>de</strong> aquélla, <strong>de</strong> su<br />
propósito <strong>de</strong> entablarlo. También podrá anunciarse por comparecencia o por escrito <strong>de</strong><br />
las partes o <strong>de</strong> su Abogado o representante ante este Juzgado <strong>de</strong>ntro <strong>de</strong>l indicado plazo.<br />
Así por ésta mi Sentencia, lo pronuncio, mando, y firmo.<br />
PUBLICACION. - Leída y publicada fue la anterior Sentencia por el Sr. Magistrado-<br />
Juez que la dictó en el mismo día <strong>de</strong> su fecha, estando celebrando audiencia pública. Doy fe.<br />
Y para que sirva <strong>de</strong> notificación al <strong>de</strong>mandado CERRAJEREZ S.L., HIE-<br />

En virtud <strong>de</strong> provi<strong>de</strong>ncia dictada en esta fecha por el Ilmo. Sr/Sra. RAÚL PÁEZ<br />
ESCAMEZ, Magistrado <strong>de</strong>l JUZGADO DE LO SOCIAL NUMERO 2 DE JEREZ DE LA<br />
FRONTERA, en los autos número 772/2006 seguidos a instancias <strong>de</strong> ANGEL DAZA<br />
RODRIGUEZ contra INSTITUTO NACIONAL DE LA SEGURIDAD SOCIAL, TESO-<br />
RERIA GENERAL DE LA SEGURIDAD SOCIAL, JADECO, SUBCONTRATA EN<br />
GENERAL S.L. y CONSTRUCCIONES GUISUL S.L. sobre Seguridad Social, se ha<br />
acordado citar a JADECO, SUBCONTRATA EN GENERAL S.L. y CONSTRUCCIONES<br />

BRERA sobre Ejecución <strong>de</strong> títulos judiciales se ha dictado RESOLUCION <strong>de</strong> fecha 6<br />
<strong>de</strong> mayo <strong>de</strong> 20<strong>08</strong>, que, entre otros pronunciamientos contiene el siguiente:<br />
"A la vista la nota simple informativa recibida <strong>de</strong>l Registro <strong>de</strong> la Propiedad<br />
número UNO <strong>de</strong> EL PUERTO DE SANTA MARIA <strong>de</strong> CADIZ, se <strong>de</strong>creta el embargo<br />
<strong>de</strong> la/s finca/s que luego se dirá propiedad <strong>de</strong> DON JOSE MANUEL LOBO CUMBRE-<br />
RA, a cuyo efecto expídase el correspondiente mandamiento <strong>de</strong> embargo, por duplicado<br />
una vez firme la presente.<br />
FINCA/S CUYO EMBARGO SE DECRETA:<br />
URBANA.- Registral 17.184 número CINCO, piso u oficina letra C, en planta<br />
primera exterior, saliendo <strong>de</strong> la escalera, el <strong>de</strong> la <strong>de</strong>recha <strong>de</strong> la casa en Plaza <strong>de</strong>l<br />
Polvorista film. 8, antes plaza General Varela, num. 2 <strong>de</strong> el Puerto <strong>de</strong> Santa María.<br />
Datos registrales: finca 17184 <strong>de</strong> El Puerto <strong>de</strong> Santa María- Propiedad Horizontal.<br />
Tomo 2118, Libro 1460, Folio 136. titular actual D. Jose Manuel Lobo Cumbrera.<br />
Notifiquese la presente resolución a las partes, haciéndoles saber que contra<br />
la misma pue<strong>de</strong> interponer Recurso <strong>de</strong> Reposición en el plazo <strong>de</strong> cinco días, ante este<br />
Juzgado <strong>de</strong> lo Social.<br />
A la vista <strong>de</strong> la diligencia emitida por el Servicio Común <strong>de</strong> El Puerto <strong>de</strong> Santa<br />
María, y <strong>de</strong> la imposibilidad <strong>de</strong> notificar por correo certificado cualquiera <strong>de</strong> las<br />
resoluciones dictadas a los ejecutados, se acuerda que sea notificada esta resolución por<br />
edictos en el Boletín Oficial <strong>de</strong> la Provincia.<br />
Hágase entrega al ejecutante <strong>de</strong> los 7<strong>08</strong>,72 euros que constan en cuenta, como<br />
parte <strong>de</strong>l principal reclamado. Lo mandó y firma S.Sa. Ante mí. Doy fe.<br />
Y para que sirva <strong>de</strong> notificación al <strong>de</strong>mandado MARIA DEL CARMEN<br />

para su publicación en el BOLETIN OFICIAL DE LA PROVINCIA, con la advertencia<br />
<strong>de</strong> que las siguientes notificaciones se harán en estrados, salvo las que <strong>de</strong>ban revestir la forma<br />
<strong>de</strong> auto, sentencia, o se trate <strong>de</strong> emplazamientos. En Jerez <strong>de</strong> la Frontera, a seis <strong>de</strong> mayo <strong>de</strong><br />
