<strong>en</strong> el traspaso de bi<strong>en</strong>es<br />
inmuebles<br />

Resum<strong>en</strong><br />
En nuestro medio, las ganancias de capital obt<strong>en</strong>idas con el traspaso de bi<strong>en</strong>es<br />
inmuebles no son ingresos sujetos al impuesto sobre la r<strong>en</strong>ta para el v<strong>en</strong>dedor, salvo<br />
que la compra y la v<strong>en</strong>ta de terr<strong>en</strong>os constituya la actividad habitual del contribuy<strong>en</strong>te o<br />
que la ganancia sea producto de la v<strong>en</strong>ta de un bi<strong>en</strong> depreciable. Sin embargo, se debe<br />
t<strong>en</strong>er mucho cuidado con la posición de la Administración Tributaria, ya que <strong>en</strong> muchas<br />
ocasiones ha considerado que lo que determinará la imposición será no tanto la<br />
frecu<strong>en</strong>cia o habitualidad de las operaciones de comprav<strong>en</strong>ta como el ánimo lucrativo<br />
<strong>en</strong> la transacción. En vista de que la ganancia de capital originada <strong>en</strong> el traspaso de un<br />
bi<strong>en</strong> depreciable será siempre gravable, es sumam<strong>en</strong>te importante que se registre <strong>en</strong><br />
forma separada el valor de un terr<strong>en</strong>o con una edificación construida. Ese registro<br />
permitirá <strong>en</strong> un futuro determinar el porc<strong>en</strong>taje de ganancia de capital que se obt<strong>en</strong>dría<br />
del terr<strong>en</strong>o y de la construcción.<br />

Abstract<br />
In our system, capital gains obtained with the transfer of real state property are not<br />
subject to income tax for the seller, unless the purchase and sale of land constitutes the<br />
usual commercial activity of the taxpayer, or the gain is the product of the sale of a<br />
depreciable asset. However, the position of the Tax Administration requires careful<br />
analysis, since it has considered that what determines the taxation is not so much the<br />
frequ<strong>en</strong>cy or habituality of sales transactions, as much as the int<strong>en</strong>t to profit from the<br />
transaction itself. Giv<strong>en</strong> that the capital gain arising from the transfer of a depreciable<br />
property is always taxable, it is extremely important to separately register the value of<br />
the land and the buildings constructed. That record will allow future determination of<br />
the perc<strong>en</strong>tage of capital gain from the land and the constructions.<br />
