Es vileza, y flaqueza <strong>de</strong> animo la que cubre con nombre <strong>de</strong> clemencia. Es un protedor <strong>de</strong> malda<strong>de</strong>s quien por femejantes confi<strong>de</strong>racioncs,fin otro motivo, afloxa la ma. no enel caftigo <strong>de</strong> los <strong>de</strong>litos. Es un tyrano indiredo <strong>de</strong> la República, porque dá ocafion á todos los males, que caufa el atrevimiento <strong>de</strong> los <strong>de</strong>linquentes, multipli, candofe eftos á excefsívo numero por falta <strong>de</strong> efcarmiento. Por efta razón, <strong>de</strong>cimos en la Paradoxa, que la que fe llama clemencia <strong>de</strong> Principes, y Magiftrados, es perjudicial á los Pueblos. 24 Quien ferá,pnes,verda<strong>de</strong>ramente clemente? A quel que minora la pena correfpondíente, fegun la Ley común , quando atendidas las circunftancias particulares^ perfuadida la reda razón que fe <strong>de</strong>be minorar. Todo es dodrina <strong>de</strong> Santo Thomas emel articulo citado. De aqui fe infiere, que el ufo <strong>de</strong> la clemencia nunca es arbitrario, como comunmente fe juzga.
