LUIS GRAU An Ordinance 2 for the Government of the Territory of the United-States, North-West of the River Ohio 3 Be it ordained by the United-States in congress assembled, that the said territory, for the purpose of temporary government, be one district; subject, however, to be divided into two districts, as future circumstances, may, in the opinion of congress, make it expedient. 4 Be it ordained by the authority aforesaid, that the estates both of resident and non-resident proprietors in the said territory, dying intestate, shall descend to, and be distributed among their children; and the descendants of a deceased child in equal parts, the descendants of a deceased child or grand-child, to take the share of their deceased parent in equal parts among them; and where there shall be no children or descendants, then in equal parts to the next of kin, in equal degree: and among collaterals, the children of a deceased brother or sister of the intestate shall have in equal parts among them their deceased parents share; and there shall in no case be a distinction between kindred of the whole and half-blood, saving in all cases to the widow of the intestate her third part of the real estate for life, and one-third part of the personal estate; and this law relative to descents and dower, shall remain in full force until altered by the legislature of the district; and until the governor and judges shall adopt laws as herein after mentioned. Estates 5 in the said territory may be devised or bequeathed by wills in writing, signed and sealed by him, or her, in whom the estate may be, (being of full age,) and attested by three witnesses; and real estates may be conveyed by lease and release, or bargain and sale, signed, sealed, and delivered by the person being of full age in whom the estate may be, and attested by two witnesses, provided such wills be duly proved, and such conveyances be acknowledged, or the execution thereof duly proved, and be recorded within one year after; 6 proper magistrates, courts, and registers shall be appointed for that purpose. And personal property may be transferred by delivery, saving, however, to the French and Canadian inhabitants, and 2. GOBIERNO DE LOS TERRITORIOS DEL NOROESTE 1787 Un Decreto para [organizar] el gobierno del territorio de los Estados Unidos al noroeste del río Ohio Los Estados Unidos reunidos en Congreso decretan que con fines de un gobierno temporal, el dicho territorio sea un único distrito, sujeto, sin embargo, a ser dividido en dos distritos si, en opinión del Congreso, las circunstancias futuras lo puedan hacer conveniente. La autoridad antedicha decreta que los patrimonios de los propietarios tanto residentes como no residentes en dicho territorio que mueran intestados, pasarán y serán distribuidos por partes iguales entre sus hijos [supervivientes] y los descendientes de sus hijos fallecidos, tomando los descendientes de un hijo o nieto fallecido, a partes iguales entre ellos, la parte de sus padres fallecidos. Y cuando no haya hijos ni descendientes, [la herencia se dividirá] a partes iguales entre los siguientes parientes de igual grado. Y entre [familiares] colaterales, los hijos del hermano o hermana fallecida del instado se repartirán entre ellos a partes iguales la parte de los padres fallecidos. No se hará en ningún caso diferencia entre hermanos y hermanastros, reservando en todos los casos para la viuda del intestado el usufructo de la tercera parte de las propiedades reales y la propiedad de la tercera parte del patrimonio personal. Y esta ley sobre descendientes y usufructos estará en vigor hasta que el legislativo del distrito la modifique. Y hasta que el gobernador y los jueces aprueben las leyes que a continuación se mencionan, los patrimonios en dicho territorio se donarán o legarán mediante testamentos escritos, firmados y sellados por el propietario del patrimonio mayor de edad, y con el testimonio de tres testigos. Y los patrimonios reales se podrán traspasar por arrendamiento y subarrendamiento, o por trato o venta, firmados, sellados y trasmitidos por la persona a quien pertenezca el patrimonio [y] que sea mayor de edad, y con el testimonio de dos testigos, siempre que talles testamentos están debidamente homologados y los traspasos reconocidos, o su ejecución debidamente probada; y se registrarán dentro del año, para lo que se designarán los magistrados, tribunales y registros debidos.
