LUIS GRAU CONSTITUTION OF NORTh-CAROLINA, Adopted December 17, 1776: 2 DECLARATION OF RIGhTS m A D e B y T h e Representatives of the Freemen of the State of North-Carolina Section 1. 3 That all political power is vested in, and derived from the people only. Sec. 2. That the people of this State ought to have the sole and exclusive right of regulating the internal government and police thereof. Sec. 3. That no man, or set of men, are entitled to exclusive or separate emoluments or privileges from the community, but in consideration of public services. Sec. 4. That the Legislative, Executive, and Supreme Judicial powers of Government, ought to be forever separate and distinct from each other. Sec. 5. That all powers of suspending laws, or the execution of laws, by any authority, without consent of the representatives of the people, is injurious to their rights, and ought not to be exercised. Sec. 6. That elections of Members to serve as Representatives in General Assembly, ought to be free. Sec. 7. That in all criminal prosecutions, every man has a right to be informed of the accusation against him, and to confront the accusers and witnesses with other testimony, and shall not be compelled to give evidence against himself. Sec. 8. That no freeman shall be put to answer any criminal charge, but by indictment, presentment, or impeachment. Sec. 9. That no freeman shall be convicted of any crime, but by the unanimous verdict of a jury, of good and lawful men, in open court, as heretofore used. Sec. 10. That excessive bail should not be required, nor excessive fines imposed, nor cruel or unusual punishments inflicted. Sec. 11. That general warrants, whereby an officer or messenger may he commanded to search suspected places, without evidence of the fact committed, or to seize any person or persons not named, whose offence is 4 not particularly described and supported by evidence, are dangerous to liberty, and ought not to be granted. Sec. 12. That no freeman ought to be taken, imprisoned or disseized of his freehold, liberties, or privileges, or outlawed or exiled, or in any manner destroyed or deprived of his life, liberty or property, but by the law of the land. Declaración de Derechos hecha por los representantes de los freemen del Estado de Carolina del Norte Sección 1. Que todo el poder político está conferido al [pueblo] y proviene únicamente del pueblo. Sec. 2. Que por ello es el pueblo de este estado el que deberá tener el único y exclusivo derecho para regular su gobierno y política interna. Sec. 3. Que ningún hombre o grupo de hombres tiene derecho a [recibir] de la comunidad honorarios o privilegios exclusivos o individuales, sino [sólo] como retribución a los servicios públicos [prestados]. Sec. 4. Que los poderes del gobierno legislativo, ejecutivo y judicial supremo debieran estar siempre separados y ser diferentes los unos de los otros. Sec. 5. Que todos los poderes de cualquier autoridad para dejar en suspenso leyes o para su ejecución, sin el consentimiento de los representantes del pueblo, son perjudiciales para los derechos de éste y no deberán ejercerse. Sec. 6. Que las elecciones de los miembros para servir como representantes en la Asamblea General deberán ser libres. Sec. 7. Que en todos los procesos penales, todo hombre tiene derecho a ser informado de la acusación contra él y a enfrentarse a sus acusadores y testigos con otra prueba, y no podrá ser obligado a declarar contra sí mismo. Sec. 8. Que ningún freeman podrá ser obligado a responder por un cargo criminal sino mediante una acusación, denuncia o auto de impeachment. Sec. 9. Que ningún freeman podrá ser condenado por ningún delito si no es mediante el veredicto unánime de un jurado de hombres buenos y cumplidores de la ley en un juicio abierto, como se acostumbraba anteriormente. Sec. 10. Que no se exigirán fianzas excesivas ni se impondrán multas excesivas, ni se aplicarán castigos cueles o inusuales. Sec. 11. Que los mandamientos generales, por los que se ordene a un oficial o mensajero que registre lugares sospechosos sin prueba del hecho cometido, o que detenga a cualquier persona, sin [incluir] su nombre [y] cuyos delitos no estén descritos en algún detalle ni respaldados por alguna prueba, son perjudiciales a la libertad y no deberán ser concedidos. Sec. 12. Que ningún freeman deberá ser detenido, encarcelado o privado de su propiedad, libertades o privilegios, o proscrito o desterrado, o de algún modo destruido o privado de su vida, libertad o propiedad excepto de conformidad con la ley en vigor.
