Nota sobre la edición: Conocí esta Declaración de Derechos del Estado de Delaware a través del artículo de Max Farrand indicado en las notas. A pesar de que la Constitución de Delaware de 1776 menciona dos veces, en los artículos 25 y 30, una “declaración de derechos y normas fundamentales de este Estado, acordadas por esta convención”, y de que ya en 1778 la había incluido una traducción francesa de las constituciones americanas y luego Jackson lo hizo en 1783, Poore no la incluye, como tampoco lo hace Thorpe (que como en muchos otros casos sigue fielmente la pauta de Poore). Las diferencias entre el texto de Force y de Farrand se limita a una terminación de gerundio (anotada) que es sin duda un error de imprenta; aunque hay algunas diferencias de ortografía, capitalización y puntuación (que no se anotan) entre Jackson y Force, sus textos son básicamente idénticos. Nota histórica: Aprobada el 11 de septiembre de 1776, “por la mañana”, esta Declaración de derechos muestra una gran semejanza con la de Maryland y Pennsylvania (los dos estados entre los que Delaware se encuentra situado geográficamente) 2 . La Constitución de Pennsylvania (con su Declaración de derechos) fue aprobada el 28 de septiembre y el proyecto de Declaración de Maryland data del 31 de octubre, lo que indica que la Declaración de Delaware fue anterior a aquéllas. Sin embargo esta precedencia en el tiempo no garantiza la originalidad de los conceptos pues se puede observar que, con mayor o menor precisión, todos ellos son recurrentes en la literatura revolucionaria del momento. Así, a partir de este documento, son muy frecuentes los casos de copiar artículos de una constitución a otra e incluso, como en el caso de Vermont, todo el texto constitucional. Además, hay que considerar también que, en 1776, los diputados de todos los estados estaban permanentemente reunidos en Filadelfia desde donde comunica- 1.
