El <strong>Centre</strong> <strong>UNESCO</strong> <strong>de</strong> Catalunya – Unescocat és <strong>una</strong> institució creada l’any 1984 com a referent <strong>de</strong> la<br />
<strong>UNESCO</strong> a Catalunya. Manté relacions oficials amb la <strong>UNESCO</strong> i té estatut especial prop <strong>de</strong> l’ECOSOC i<br />
<strong>de</strong>l Departament d’Informació Pública <strong>de</strong> les Nacions Uni<strong>de</strong>s.<br />
Unescocat <strong>de</strong>fensa i promou el valor <strong>de</strong> les cultures principalment en els àmbits <strong>de</strong> la pau, els drets humans,<br />
el <strong>de</strong>senvolupament, l’educació, la sostenibilitat, el diàleg interreligiós, la diversitat lingüística i el<br />
patrimoni. Unescocat difon els programes i materials elaborats <strong>per</strong> la <strong>UNESCO</strong> i ofereix suport tècnic i<br />
visibilitat a l’acció <strong>de</strong> la societat civil <strong>de</strong> la <strong>UNESCO</strong> canalitzada a través <strong>de</strong> les xarxes <strong>de</strong> biblioteques,<br />
càtedres, escoles, associacions i clubs <strong>UNESCO</strong> <strong>de</strong> Catalunya.<br />

Síntesi: El segle XXI ofereix a Catalunya un horitzó molt ampli <strong>per</strong> a la<br />
seva projecció internacional.. D’<strong>una</strong> banda, la globalització<br />
erosiona el rol <strong>de</strong>ls estats-nació i els arrabassa el monopoli<br />
<strong>de</strong> les relacions internacionals que havien ostentat <strong>de</strong>s <strong>de</strong> la<br />
creació <strong>de</strong> l’Estat mo<strong>de</strong>rn. De l’altra, el nou Estatut d’autonomia<br />
és <strong>una</strong> peça molt important (<strong>per</strong>ò no imprescindible) <strong>per</strong> a l’acció<br />
en <strong>de</strong>termina<strong>de</strong>s àrees <strong>de</strong> l’arena mundial, en especial els<br />
articles 193 a 200 <strong>de</strong> l’Estatut, que formen el Capítol III “Acció<br />
exterior <strong>de</strong> la Generalitat”.<br />

Unescocat<br />
Un àmbit on Catalunya ha començat a tenir un pa<strong>per</strong> rellevant<br />
i gau<strong>de</strong>ix <strong>de</strong> moltes possibilitats és la <strong>UNESCO</strong>. La <strong>UNESCO</strong><br />
admet la participació d’organismes que no són estrictament<br />
estatals, <strong>per</strong>ò que tenen el seu àmbit d’acció radicat en la<br />
cultura (organitzacions intergovernamentals, ONG, governs<br />
municipals i regionals, etc.). I dins d’aquest context favorable, la<br />
Convenció sobre la diversitat cultural és <strong>una</strong> plataforma i<strong>de</strong>al<br />
<strong>per</strong> traçar noves formes <strong>de</strong> participació <strong>de</strong> governs subcentrals<br />
en la governança <strong>de</strong> la globalització.<br />

1 Contextualització<br />
La globalització ha alterat profundament<br />
la lògica <strong>de</strong> les relacions internacionals i,<br />
com a primer fenomen visible d’aquest procés,<br />
els estats-nació han <strong>per</strong>dut el monopoli<br />
que havien ostentat fins ara en l’arena mundial.<br />
La irrupció <strong>de</strong> nous actors en el <strong>de</strong>bat<br />
i l’aplicació <strong>de</strong> <strong>de</strong>termina<strong>de</strong>s polítiques<br />
transfrontereres obliga els estats a assumir<br />
noves pràctiques diplomàtiques, més enllà<br />
<strong>de</strong> la “diplomàcia <strong>de</strong> tractat i ambaixada”.<br />
Davant d’aquesta nova realitat, els governs<br />
subestatals, com el <strong>de</strong> Catalunya,<br />
comencen a intuir les possibilitats que<br />
se’ls obren més enllà <strong>de</strong> les fronteres tradicionals.<br />
Prova d’això són les jorna<strong>de</strong>s <strong>de</strong><br />
treball que els governs no centrals estan<br />
organitzant <strong>per</strong> <strong>de</strong>finir i fonamentar unes<br />
pràctiques quotidianes que es comencen<br />
a consolidar. Citarem tres exemples:<br />

pels governs <strong>de</strong> Catalunya,<br />
Flan<strong>de</strong>s i Quebec.<br />
• Presentació <strong>de</strong> l’ Estratègia catalana <strong>de</strong><br />
coo<strong>per</strong>ació multilateral al <strong>de</strong>senvolupament,<br />
Seu <strong>de</strong> l’ONU, 18 d’octubre <strong>de</strong><br />
Qua<strong>de</strong>rns <strong>de</strong> Recerca · Número 2 - juny 2010<br />

2009, en el marc <strong>de</strong>l seminari “Governs<br />
<strong>de</strong>scentralitzats i nou multilateralisme”,<br />
coorganitzat <strong>per</strong> la Generalitat i la United<br />
Nations University (UNU) a Nova York.<br />
Com es pot comprovar, Catalunya és capdavantera<br />
en aquest àmbit estratègic i,<br />
<strong>de</strong>s <strong>de</strong> la seva <strong>per</strong>sonalitat, comença a fer<br />
aportacions rellevants en la reformulació<br />
en curs <strong>de</strong> les relacions internacionals i <strong>de</strong><br />
la governança mundial.<br />
Un terreny en què el Govern <strong>de</strong> la Generalitat<br />
ha estat actiu és el <strong>de</strong>bat i implementació<br />
<strong>de</strong> la Convenció sobre la protecció i<br />
la promoció <strong>de</strong> la diversitat <strong>de</strong> les expressions<br />
culturals, aprovada <strong>per</strong> la <strong>UNESCO</strong><br />
el 2005. Aquest tractat internacional, que<br />
aposta <strong>per</strong> <strong>una</strong> governança multilateral<br />
<strong>de</strong> la diversitat cultural mundial, ha estat<br />
el banc <strong>de</strong> proves i un trampolí <strong>per</strong> a Catalunya,<br />
en el seu camí cap a la consolidació<br />
d’<strong>una</strong> <strong>para</strong>diplomàcia en cultura.<br />
El present QR, doncs, es fa ressò d’aquesta<br />
nova realitat i <strong>de</strong> les inquietuds <strong>de</strong>ls governs<br />
no centrals. De fa un temps, els responsables<br />
d’ens subestatals són conscients que trepitgen<br />
un terreny polític fundacional, sense<br />
que encara hi hagi gaire fonament teòric i<br />
jurídic que sustenti la seva acció. Fruit <strong>de</strong> la<br />
nostra tesi doctoral (Petit, 2009), presentada<br />
a la Universitat Ramon Llull, aquest estudi<br />
vol omplir un buit que <strong>de</strong>mana reflexió <strong>de</strong><br />
caràcter propositiu.<br />

2 Presentació <strong>de</strong> resultats<br />
La recerca que es presenta analitza les<br />
oportunitats que té el Govern <strong>de</strong> la Generalitat<br />
en l’acció internacional dins <strong>de</strong><br />
l’àrea <strong>de</strong> la cultura.<br />
Per argumentar-ho, es tractarà en primer<br />
lloc <strong>de</strong> l’activitat <strong>de</strong> governs subcentrals<br />
com Califòrnia o el Quebec, exemples <strong>de</strong><br />
governs que han <strong>de</strong>splegat <strong>una</strong> estratègia<br />
internacional, atenent les seves necessitats<br />
internes (<strong>de</strong> caràcter econòmic,<br />
industrial, cultural, etc.). Aquests casos<br />
mostren les tendències que comencen a<br />
<strong>de</strong>spuntar i les possibilitats que ofereix la<br />
globalització.<br />
I en aquest context <strong>de</strong> governança complexa<br />
<strong>de</strong> multiactors, Catalunya pot optar<br />
<strong>per</strong> <strong>una</strong> acció internacional selectiva i sostinguda,<br />
centrada en la <strong>UNESCO</strong>, que li<br />
<strong>per</strong>meti <strong>una</strong> projecció política i cultural. El<br />
primer graó d’aquest projecte és la tasca,<br />
ja iniciada, entorn a la Convenció sobre<br />
la diversitat cultural, <strong>de</strong> la qual s’analitzarà<br />
l’estructura “i<strong>de</strong>ològica”.<br />
A partir d’aquí, l’informe profunditza en<br />
les competències que el nou Estatut d’autonomia<br />
dóna a la Generalitat <strong>de</strong> Catalu-<br />
Qua<strong>de</strong>rns <strong>de</strong> Recerca · Número 2 - juny 2010<br />

nya en matèria <strong>de</strong> política internacional,<br />
sent molt conscients que en el moment <strong>de</strong><br />
tancar el present article el Trib<strong>una</strong>l Constitucional<br />
encara no havia dictat sentència<br />
sobre el recurs presentat. Això no obstant,<br />
el present estudi sosté que <strong>una</strong> eventual<br />
sentència <strong>de</strong>sfavorable sobre el Capítol<br />
III <strong>de</strong> l’Estatut, titulat “Acció exterior <strong>de</strong> la<br />
Generalitat”, no eliminaria la base jurídica<br />
<strong>per</strong> a <strong>una</strong> acció exterior <strong>de</strong> Catalunya.<br />
Per fonamentar-ho es donen tres arguments:<br />

Anàlisi com<strong>para</strong>tiva amb els estatuts<br />
<strong>de</strong> les altres comunitats autònomes<br />
Exposició <strong>de</strong> la doctrina <strong>de</strong>l TC<br />
Explicació <strong>de</strong> l’acció ja realitzada <strong>per</strong><br />
la Generalitat en la matèria.<br />
Finalment, <strong>per</strong> tancar el cercle, la recerca<br />
incorpora el terme <strong>de</strong> nova creació <strong>para</strong>diplomàcia<br />
en cultura, concepte <strong>de</strong> la ciència<br />
política referit a l’acció exterior <strong>de</strong>ls<br />
governs subestatals. Amb tot, sostenem<br />
que l’activitat en <strong>para</strong>diplomàcia referida<br />
a la cultura no s’ha d’incloure en la política<br />
diplomàtica d’un govern, sinó en l’àrea<br />
<strong>de</strong> les polítiques culturals.<br />

La globalització, Catalunya<br />
i la Convenció sobre diversitat<br />
cultural <strong>de</strong> la <strong>UNESCO</strong><br />
1.1 Els governs subestatals<br />
davant <strong>de</strong> la globalització:<br />
Catalunya s’afegeix a les tendències<br />
capdavanteres<br />
El procés econòmic, polític, social<br />
i fins i tot “mental” que anomenem<br />
globalització comporta<br />
canvis importants a la lògica <strong>de</strong><br />
les relacions internacionals, entre<br />
molts altres àmbits. A causa<br />
<strong>de</strong> la multiplicació <strong>de</strong>ls fluxos <strong>de</strong><br />
tot ordre (comercials, financers,<br />
turístics, migratoris, d’informació,<br />
etc.), s’esmicola la possibilitat<br />
que els estats siguin l’únic<br />
agent possible en les relacions<br />
internacionals. Michael Keating,<br />
exdirector <strong>de</strong>l Departament <strong>de</strong><br />
Ciències Polítiques i Socials <strong>de</strong><br />
l’Institut Universitari Europeu <strong>de</strong><br />
Florència, ho contempla com<br />
un fet normal. Al costat <strong>de</strong> les<br />
ambaixa<strong>de</strong>s i <strong>de</strong>legacions oficials,<br />
trobem representacions <strong>de</strong><br />
governs subestatals (regionals i<br />
locals), empreses, sindicats, moviments<br />
socials i organitzacions<br />
transnacionals com ara Greenpeace<br />
i Oxfam. “Aquest univers<br />
és complex, fragmentat i sense<br />
estructura” (Keating 1999:231 i<br />
també Keating 2003:6).<br />
L’increment <strong>de</strong> l’activitat exterior<br />
<strong>de</strong>ls governs no centrals ha estat<br />
<strong>una</strong> constant als països <strong>de</strong>senvolupats<br />
<strong>de</strong>s <strong>de</strong>ls anys vuitanta<br />
<strong>de</strong>l segle passat. En primera<br />
instància, ha estat <strong>una</strong> eina <strong>per</strong><br />
internacionalitzar les economies<br />
domèstiques. En un escenari <strong>de</strong><br />
globalització econòmica, les polítiques<br />
orienta<strong>de</strong>s a atreure inversions<br />
i a potenciar les exportacions<br />
són el primer motor <strong>de</strong><br />
Qua<strong>de</strong>rns <strong>de</strong> Recerca · Número 2 - juny 2010<br />

2. Presentació <strong>de</strong> resultats<br />
l’activitat exterior <strong>de</strong>ls governs<br />
no centrals. Les regions riques<br />
que tenen un pes polític dins <strong>de</strong>ls<br />
països respectius —Califòrnia,<br />
Ba<strong>de</strong>n-Württemberg, Baviera,<br />
Ontàrio, Nova Gal·les <strong>de</strong>l Sud—<br />
disposen <strong>de</strong> molts més recursos<br />
<strong>per</strong> actuar en l’esfera internacional<br />
que les seves equivalents<br />
més petites i menys dota<strong>de</strong>s. Fins<br />
i tot, compten amb més recursos<br />
que molts països en vies <strong>de</strong> <strong>de</strong>senvolupament.<br />
Califòrnia és tan gran, i els seus problemes<br />
tan enormes, que necessita<br />
la seva pròpia política exterior. En<br />
<strong>una</strong> època en què l’economia governa<br />
les relacions exteriors, això no<br />
significa crear ambaixa<strong>de</strong>s i exèrcits,<br />
sinó oficines comercials i agents a<br />
l’exterior, establir les pròpies relacions<br />
amb les nacions estrangeres i<br />
un Govern i un Parlament disposats<br />
a representar els interessos <strong>de</strong><br />
l’estat [<strong>de</strong> Califòrnia] amb in<strong>de</strong>pendència<br />
<strong>de</strong> Washington.<br />

Així, l’estat més poblat <strong>de</strong>ls<br />
EUA, amb un producte interior<br />
brut su<strong>per</strong>ior al <strong>de</strong> Canadà, ha<br />
vist la necessitat <strong>de</strong> reposicionar-se<br />
<strong>de</strong>sprés <strong>de</strong> la signatura<br />
<strong>de</strong>l Tractat <strong>de</strong> Lliure Comerç<br />
d’Amèrica <strong>de</strong>l Nord (TLCAN,<br />
NAFTA en les sigles angleses).<br />
I és que, en efecte, ens trobem<br />
immersos en <strong>una</strong> profunda<br />
transformació <strong>de</strong> l’estat-nació,<br />
que ja no és un mercat protegit<br />
<strong>per</strong> a la indústria local, sinó que<br />
ha dissolt les seves fronteres comercials<br />
i s’ha obert al flux <strong>de</strong><br />
mercats i capitals internacionals.<br />
La vella i<strong>de</strong>a d’un estatnació<br />
amb sobirania mercantil<br />
és ja història. «Igual com les<br />
empreses s’ocupen d’establir<br />
aliances estratègiques <strong>per</strong> raons<br />
<strong>de</strong> cost i <strong>de</strong> competitivitat,<br />
les regions, les localitats i les<br />
ciutats creen vincles internacionals<br />
i el seu propi tipus d’aliança<br />
estratègica amb l’objectiu<br />
<strong>de</strong> reforçar la seva posició<br />
en l’economia mundial» (Hocking<br />
1999:19 i també a Hocking<br />
2003:244-5).<br />
Des d’aquest punt <strong>de</strong> vista, l’acció<br />
exterior <strong>de</strong> la Generalitat s’ha orientat<br />
a atreure inversió estrangera,<br />
a promoure mercats exteriors<br />
<strong>per</strong> als agents econòmics interns<br />
i, <strong>de</strong> forma colateral, a potenciar<br />
l’atractiu turístic ja creat <strong>per</strong> l’extraordinari<br />
branding power <strong>de</strong>ls<br />
Jocs Olímpics <strong>de</strong> Barcelona. L’activitat<br />
<strong>de</strong> la Generalitat s’ha inserit<br />
en <strong>una</strong> tònica generalitzada que<br />
busca oportunitats en el context dinàmic<br />
<strong>de</strong> la globalització. Res que<br />
no hagi fet cap altre Govern subestatal<br />
amb certa capacitat econòmica<br />
i política, doncs. Àngel Mesado,<br />
extècnic <strong>de</strong> la Secretaria d’Afers<br />
Exteriors <strong>de</strong> la Generalitat, fa <strong>una</strong><br />
anàlisi <strong>de</strong>tallada <strong>de</strong> la història <strong>de</strong><br />
les relacions exteriors <strong>de</strong>l Govern,<br />
sobretot pel que fa a la <strong>UNESCO</strong>:<br />
Ja <strong>de</strong>s <strong>de</strong>l començament <strong>de</strong> l’autonomia,<br />
l’acció exterior <strong>de</strong>l Govern<br />
ha estat duta a terme pels diferents<br />
<strong>de</strong>partaments en els seus respectius<br />
àmbits d’actuació i la coordinació<br />
general ha anat a càrrec d’unitats<br />
generalment adscrites al Departament<br />
<strong>de</strong> Presidència sense capacitat<br />
d’assumir <strong>una</strong> coordinació global <strong>de</strong>l<br />
conjunt <strong>de</strong> l’acció exterior.1 Aquesta<br />
estructura dis<strong>per</strong>sa s’acabava <strong>de</strong><br />
concretar amb un seguit d’actors i<br />
organismes vinculats <strong>de</strong> naturalesa<br />
mixta publicoprivada generalment en<br />
forma <strong>de</strong> consorcis i patronats que<br />
assumien part <strong>de</strong>l pes <strong>de</strong> la projecció<br />
exterior catalana. En aquest<br />

<strong>de</strong>l Patronat Català Pro Europa en<br />
la dinamització <strong>de</strong> les relacions <strong>de</strong><br />
Catalunya amb la Unió Europea o<br />
bé l’antic Institut d’Estudis <strong>de</strong> la<br />
Mediterrània —actual IEMed—,<br />
consorci format <strong>per</strong> la Generalitat,<br />
l’Ajuntament <strong>de</strong> Barcelona i el<br />
Govern central, responsable <strong>de</strong><br />
l’or<strong>de</strong>nació <strong>de</strong> l’acció exterior en<br />
<strong>una</strong> àrea consi<strong>de</strong>rada prioritària com<br />
és la Mediterrània i, molt especialment,<br />
el Magrib. En el camp <strong>de</strong> les<br />
relacions econòmiques i comercials,<br />
el COPCA i el CIDEM són dos consorcis<br />
<strong>de</strong> reconegut prestigi centrats<br />
en la promoció exterior comercial i<br />
industrial, respectivament.<br />
A partir <strong>de</strong> l’any 2003, durant els<br />
anys <strong>de</strong> l’anomenat «Govern Catalanista<br />
i d’Esquerres», es manté l’esquema<br />
administratiu bàsic centrat en<br />
<strong>una</strong> unitat <strong>de</strong> coordinació adscrita<br />
al Departament <strong>de</strong> Presidència —en<br />
aquest cas la Secretaria <strong>de</strong> Relacions<br />
Internacionals—. 2<br />

Però l’acció exterior <strong>de</strong> tot Govern,<br />
sigui estatal o subestatal, no sols<br />
té un vector mercantil. Un altre<br />
vessant <strong>de</strong> les relacions internacionals<br />
és el <strong>de</strong> la coo<strong>per</strong>ació. I<br />
és aquí on Catalunya també té<br />
<strong>una</strong> porta <strong>per</strong> a l’acció internacional.<br />
Un bon exemple n’és l’acord<br />
signat el gener <strong>de</strong> 2009 entre la<br />
Generalitat, mitjançant l’Agència<br />
Catalana <strong>de</strong> Coo<strong>per</strong>ació al Desenvolupament<br />
(ACCD), i el Programa<br />
<strong>de</strong> Nacions Uni<strong>de</strong>s <strong>per</strong> al<br />
Desenvolupament (PNUD). Aquest<br />
memoràndum d’entesa és el primer<br />
acord que aquest organisme<br />
<strong>de</strong> Nacions Uni<strong>de</strong>s signa amb un<br />
ens no estatal. Com també és <strong>per</strong>tinent<br />
citar l’acord <strong>de</strong> coo<strong>per</strong>ació<br />
entre Catalunya i la República<br />
<strong>de</strong> l’Uruguai, signat el 2006. El setembre<br />
<strong>de</strong> 2009, es va formalitzar<br />
el Pla <strong>de</strong> Treball 2009-2011 <strong>per</strong> <strong>de</strong>s-<br />

envolupar aquest acord en àmbits<br />
com les relacions exteriors, la<br />
joventut, el turisme, la innovació<br />
i la formació. Així, el Pla <strong>de</strong> Treball<br />
Catalunya-Uruguai preveu<br />
consolidar accions en les quals<br />
ja existia col·laboració, com <strong>per</strong><br />
exemple entre l’Institut <strong>de</strong> Recerca<br />
i Tecnologia Agroalimentàries <strong>de</strong><br />
Catalunya (IRTA) i l’Instituto Nacional<br />
<strong>de</strong> Investigación Agropecuaria<br />
d’Uruguai (INIA). Catalunya<br />
pot tenir <strong>una</strong> presència al món no<br />
sols en el mercat, sinó també en<br />
els valors i el coneixement.<br />
En aquesta nova dinàmica que<br />
dibuixa la globalització, els sistemes<br />
fe<strong>de</strong>rals es troben clarament<br />
avantatjats. Es tracta <strong>de</strong> casos en<br />
què els governs subestatals participen<br />
en l’àmbit internacional<br />
en aquelles àrees en les quals<br />
tenen competències polítiques<br />
substantives. Això inclou sovint<br />
àrees polítiques que tenen <strong>una</strong><br />
importància no sols simbòlica<br />
sinó també <strong>per</strong> a la pràctica política.<br />
D’aquesta manera, l’acció<br />
<strong>para</strong>diplomàtica inclou les àrees<br />
d’àmbit general (economia, medi<br />
ambient, política social, <strong>de</strong>senvolupament<br />
rural i urbà, etc.), així<br />
com, en els casos d’<strong>una</strong> comunitat<br />
lingüística i cultural diferenciada,<br />
d’altres més específiques<br />
(cultura, educació, política lingüística,<br />
pràctica religiosa, etc.).<br />
Si ens centrem en les polítiques<br />
culturals, observem que el Quebec<br />
fou el primer país a adonar-se<br />
que van íntimament lliga<strong>de</strong>s a <strong>una</strong><br />
acció (<strong>para</strong>)diplomàtica rigorosa i<br />
eficient <strong>per</strong> tal d’obtenir avantatges<br />
en la signatura d’acords internacionals.<br />
En l’esmentat Tractat <strong>de</strong><br />
Lliure Comerç d’Amèrica <strong>de</strong>l Nord<br />
(TLCAN-NAFTA) entre Mèxic, els<br />
EUA i el Canadà, aquest darrer<br />
país va aconseguir davant els EUA<br />
que els béns i serveis culturals fossin<br />
exclosos <strong>de</strong> la liberalització<br />
comercial. Gràcies a aquesta «ex-<br />
cepció cultural», recollida a l’annex<br />
I <strong>de</strong>l TLCAN, l’Estat cana<strong>de</strong>nc<br />
pot intervenir en el mercat <strong>per</strong> tal<br />
d’aplicar mesures <strong>de</strong> promoció <strong>de</strong><br />
la cultura pròpia. I dins d’aquest<br />
tractament específic <strong>de</strong>l sector<br />
cultural, el Quebec té unes condicions<br />
encara més favorables, que<br />
li <strong>per</strong>meten associar-se amb altres<br />
estats <strong>de</strong> la mateixa àrea lingüística.<br />
D’aquesta manera, que<strong>de</strong>n<br />
obertes les portes a, <strong>per</strong> exemple,<br />
coproduccions cinematogràfiques<br />
amb França mitjançant un règim<br />
molt favorable (Zellagui, 2001). Al<br />
contrari, Mèxic no va excloure el<br />
sector cultural <strong>de</strong>l TLCAN i a partir<br />
d’aquest moment, s’ha vist lligat<br />
<strong>de</strong> mans a l’hora d’elaborar polítiques<br />
culturals. Només un exemple:<br />
segons da<strong>de</strong>s <strong>de</strong> la Coalición<br />
Mexicana <strong>para</strong> la Diversidad Cultural,<br />
la producció cinematogràfica<br />
<strong>de</strong> Mèxic ha disminuït un 72%<br />
els darrers anys. A més, els EUA<br />
controlen 2.500 <strong>de</strong> les 3.000 sales<br />
<strong>de</strong> projecció <strong>de</strong> cinema <strong>de</strong> Mèxic.<br />
Com a conseqüència d’això, conclou<br />
la Coalició, s’han tancat empreses<br />
<strong>de</strong> producció, ha augmentat<br />
l’atur en el sector i s’han reduït<br />
les exportacions audiovisuals <strong>de</strong>l<br />
país (Barlet, 2005).<br />
D’aquests exemples se’n <strong>de</strong>sprèn<br />
la necessitat que les polítiques culturals<br />
incloguin com a pràctica habitual<br />
un seguiment molt estret <strong>de</strong><br />
les negociacions <strong>de</strong>ls acords internacionals,<br />
encara que «només es<br />
tracti <strong>de</strong> comerç». L’acció <strong>para</strong>diplomàtica<br />
<strong>de</strong> la Generalitat ja no<br />
és un luxe, sinó <strong>una</strong> peça més en<br />
les seves polítiques internes.<br />
En els moments fundacionals <strong>de</strong> la<br />
societat global, la reformulació <strong>de</strong><br />
l’acció exterior genera noves dinàmiques<br />
<strong>de</strong> participació, així com<br />
expectatives internes. En el cas<br />
català, veurem que el Govern <strong>de</strong><br />
la Generalitat té fonament tècnic<br />
i jurídic <strong>per</strong> fer un salt qualitatiu i<br />
implementar <strong>una</strong> <strong>para</strong>diplomàcia<br />

activa, com a contribució catalana<br />
a la globalització. I la Convenció<br />
sobre diversitat cultural <strong>de</strong> la<br />
<strong>UNESCO</strong> i el seu <strong>de</strong>splegament<br />
és l’àmbit <strong>de</strong>s d’on Catalunya pot<br />
posar en pràctica un multilateralisme<br />
actiu, selectiu i estratègic. És<br />
en l’especialització i la concentració<br />
<strong>de</strong> recursos humans i financers<br />
que Catalunya pot aportar un valor<br />
afegit amb <strong>per</strong>sonalitat pròpia als<br />
processos <strong>de</strong> redimensionament<br />
<strong>de</strong> la governança política, econòmica<br />
i institucional en curs. Hi ha<br />
arguments <strong>per</strong> <strong>de</strong>splegar <strong>una</strong> diplomàcia<br />
acotada <strong>per</strong>ò sostinguda,<br />
que li doni un protagonisme<br />
i <strong>una</strong> activitat que li <strong>per</strong>meti reinventar<br />
la seva presència al món. I<br />
la Convenció <strong>de</strong> la <strong>UNESCO</strong> sobre<br />
diversitat cultural pot ser un element<br />
clau <strong>per</strong> ampliar i consolidar<br />
<strong>una</strong> <strong>para</strong>diplomàcia cultural amb<br />
molts rèdits <strong>per</strong> a Catalunya.<br />
1.2 La Convenció sobre la diversitat<br />
cultural, <strong>una</strong> aposta <strong>de</strong><br />
la <strong>UNESCO</strong> en la governança<br />
global <strong>de</strong> la diversitat<br />
El 20 d’octubre <strong>de</strong> 2005, la 33a<br />
Conferència general <strong>de</strong> l’Organització<br />
<strong>de</strong> les Nacions Uni<strong>de</strong>s<br />
<strong>per</strong> a l’Educació, la Ciència i la<br />
Cultura (<strong>UNESCO</strong>) va aprovar<br />
la Convenció sobre la protecció<br />
i la promoció <strong>de</strong> la diversitat<br />
<strong>de</strong> les expressions culturals. 3<br />
Aquest tractat internacional va<br />

estats membres <strong>de</strong> la <strong>UNESCO</strong>,<br />
mentre que quatre estats es van<br />
abstenir i els EUA i Israel s’hi van<br />
oposar. L’aprovació <strong>de</strong> la Convenció<br />
va ser molt celebrada,<br />
<strong>per</strong>què s’interpreta com un contrapès<br />
als acords <strong>de</strong> liberalització<br />
<strong>de</strong>l comerç internacional <strong>de</strong><br />
l’Organització Mundial <strong>de</strong>l Comerç<br />
(OMC). Es pot dir que gràcies<br />
a la Convenció, la <strong>UNESCO</strong><br />
ha <strong>de</strong>s<strong>per</strong>tat <strong>de</strong> la seva letargia<br />
institucional, <strong>de</strong>sprés <strong>de</strong> la crisi<br />
que va comportar l’adopció <strong>de</strong><br />
l’Informe McBri<strong>de</strong> a la dècada<br />
<strong>de</strong>ls 1980. Així, la Convenció és<br />
<strong>una</strong> fita a favor <strong>de</strong> la diversitat<br />
cultural en l’àmbit <strong>de</strong>l dret internacional<br />
i, <strong>de</strong>s d’un punt <strong>de</strong> vista<br />
polític, és la principal <strong>de</strong>rrota <strong>de</strong><br />
l’administració Bush en la seva<br />
<strong>de</strong>riva unilateralista i en la seva<br />
estratègia <strong>de</strong> <strong>de</strong>sregulació <strong>de</strong>l<br />
mercat cultural i audiovisual.<br />
Pel que fa al contingut, la Convenció<br />
consagra en l’àmbit <strong>de</strong>l<br />
dret internacional la legitimitat<br />
<strong>de</strong>ls països a aplicar polítiques<br />
culturals. Els seus principis fonamentals<br />
són:<br />

La diversitat cultural va estretament<br />
lligada als drets<br />
humans, com ara la llibertat<br />
d’expressió o el dret a la<br />
creació, amb la <strong>de</strong>mocràcia i<br />
amb el pluralisme i la solidaritat<br />

Es reconeix la natura específica<br />
<strong>de</strong>ls béns i serveis culturals,<br />
que no po<strong>de</strong>n ser tractats<br />
solament pel seu valor<br />
comercial, sinó també com a<br />
portadors <strong>de</strong> valors, d’i<strong>de</strong>ntitat<br />
i <strong>de</strong> sentit.<br />
Els estats tenen dret a aplicar<br />
mesures <strong>de</strong> preservació i<br />
promoció <strong>de</strong> totes les expressions<br />
culturals que els són<br />
pròpies, al marge <strong>de</strong> les lleis<br />

<strong>de</strong> mercat que les facin viables,<br />
o no, econòmicament.<br />
Per tal <strong>de</strong> garantir un món<br />
divers, és fonamental l’ajut<br />
a les indústries culturals <strong>de</strong>ls<br />
països en via <strong>de</strong> <strong>de</strong>senvolupament.<br />
La solidaritat és un valor<br />
central en la relació entre<br />
cultures i, en conseqüència,<br />
cal potenciar la transferència<br />
tecnològica i <strong>de</strong> coneixement,<br />
així com la coo<strong>per</strong>ació<br />
entre els països <strong>de</strong>senvolupats<br />
i els que es troben en via<br />
<strong>de</strong> <strong>de</strong>senvolupament.<br />
La indústria cultural està lligada<br />
al <strong>de</strong>senvolupament<br />
sostenible <strong>de</strong> les societats.<br />
La Convenció crea mecanismes<br />
d’aplicació i seguiment.<br />
Així mateix, es preveu la<br />
creació d’un mecanisme <strong>de</strong><br />
conciliació <strong>per</strong> a la resolució<br />
<strong>de</strong> conflictes, que pot generar<br />
<strong>una</strong> jurisprudència en<br />
dret internacional <strong>de</strong>s d’<strong>una</strong><br />
<strong>per</strong>spectiva cultural i no comercial.<br />
La Convenció sobre Diversitat<br />
Cultural <strong>de</strong> la <strong>UNESCO</strong> no<br />
se subordina a altres acords<br />
i tractats internacionals, com<br />
ara els <strong>de</strong> l’OMC, si bé tampoc<br />
els <strong>de</strong>roga.<br />
La recerca dirigida <strong>per</strong> les professores<br />
<strong>de</strong> dret internacional<br />
públic <strong>de</strong> la UAB, Francina Esteve<br />
i Claudia Jiménez, exposa<br />
en un <strong>de</strong>ls capítols les principals<br />
característiques <strong>de</strong> la Convenció<br />
(Esteve, Jiménez 2006). Així, un<br />
tema que afecta els fonaments<br />
i<strong>de</strong>ològics <strong>de</strong>l tractat és el reconeixement<br />
<strong>de</strong> «la naturalesa específica<br />
<strong>de</strong> les activitats i els béns<br />
i serveis culturals com a portadors<br />
d’i<strong>de</strong>ntitat, valors i signifi-<br />

cat» (art. 1.g). Aquest argument ja<br />
va ser esgrimit en el seu moment<br />
pels <strong>de</strong>fensors <strong>de</strong> l’excepció cultural,<br />
sense èxit, durant la Ronda<br />
Uruguai <strong>de</strong> l’OMC els anys 1986-<br />
94. Una expressió cultural o els<br />
béns i serveis que la vehiculen<br />
no tenen <strong>per</strong> què ser competitius,<br />
ni han <strong>de</strong> <strong>de</strong>saparèixer pel<br />
simple fet <strong>de</strong> no ser-ho. La manifestació<br />
d’<strong>una</strong> expressió cultural<br />
està íntimament lligada a l’expressió<br />
d’<strong>una</strong> comunitat o grup<br />
ètnic i, <strong>per</strong> tant, es fonamenta en<br />
els drets humans i en el principi<br />
<strong>de</strong>l <strong>de</strong>senvolupament humà sostenible<br />
<strong>de</strong> tota societat. Tot i que<br />
pugui generar valor econòmic,<br />
<strong>una</strong> expressió cultural no s’ha<br />
<strong>de</strong> supeditar a les lleis <strong>de</strong>l mercat,<br />
<strong>per</strong>què la lògica mercantil<br />
pot ser <strong>una</strong> seriosa amenaça <strong>per</strong><br />
a la mateixa su<strong>per</strong>vivència <strong>de</strong><br />
la diversitat <strong>de</strong> les expressions.<br />
Establir la doble naturalesa <strong>de</strong><br />
les expressions culturals era un<br />
pilar fonamental <strong>per</strong>què en el<br />
futur no hi hagi falses interpretacions<br />
sobre l’aplicació <strong>de</strong> la<br />
Convenció.<br />

Així mateix, també cal <strong>de</strong>stacar el<br />
vessant <strong>de</strong> solidaritat i coo<strong>per</strong>ació<br />
que apareix <strong>de</strong> forma transversal<br />
al llarg <strong>de</strong> tota la Convenció. El lligam<br />
entre promoció <strong>de</strong> la diversitat<br />
cultural i coo<strong>per</strong>ació internacional<br />
és la clau <strong>de</strong> volta que <strong>per</strong>metrà en<br />
el futur l’aplicació <strong>de</strong> la Convenció.<br />
D’<strong>una</strong> banda, <strong>per</strong>què així s’assegura<br />
un ampli suport <strong>de</strong> països en<br />
via <strong>de</strong> <strong>de</strong>senvolupament, que en<br />
la seva acla<strong>para</strong>dora majoria no<br />
tenen indústries culturals o, en el<br />
cas <strong>de</strong> tenir-ne, no són en absolut<br />
competitives. Però, sobretot, <strong>per</strong>què<br />
s’exorcitza el fantasma <strong>de</strong>l proteccionisme<br />
i <strong>de</strong>l tancament <strong>de</strong> les<br />
comunitats sobre si mateixes. La<br />
Convenció vol ser un instrument<br />
<strong>per</strong> afavorir un flux cultural equilibrat<br />
entre totes les comunitats <strong>de</strong>l<br />
planeta (en oposició al flux unidireccional<br />
<strong>de</strong> les potències exportadores<br />
actual), i no <strong>una</strong> excusa <strong>per</strong><br />
tancar-se «a l’altre».<br />
Aquest principi <strong>de</strong> solidaritat i<br />
coo<strong>per</strong>ació cultural queda concretat,<br />
a més, en la creació <strong>de</strong>l<br />
Fons Internacional <strong>per</strong> a la Di-<br />
versitat Cultural (art. 18). Tot i<br />
la solemnitat <strong>de</strong>l nom, les aportacions<br />
<strong>de</strong>ls estats signataris a<br />
aquest fons són voluntàries. Per<br />
tant, aquesta figura jurídica té<br />
un caràcter eminentment formal,<br />
ja que el fet que un estat ratifiqui<br />
la Convenció no l’obliga<br />
econòmicament a res. Tanmateix,<br />
el fet que el Fons tingui <strong>una</strong><br />
regulació tan laxa obre les portes<br />
a donacions d’altres ens que<br />
no siguin estats, com ara organismes<br />
i programes <strong>de</strong> les Nacions<br />
Uni<strong>de</strong>s, entitats públiques o<br />
priva<strong>de</strong>s o, fins i tot, governs no<br />
centrals com ara la Generalitat<br />
<strong>de</strong> Catalunya (art. 18.3c). D’altra<br />
banda, el Fons pot acceptar<br />
contribucions finalistes, lliga<strong>de</strong>s<br />
a projectes concrets (art. 18.5).<br />
La laxitud <strong>de</strong> l’article 18 és cabdal<br />
<strong>per</strong> a Catalunya, ja que, tal<br />
com s’argumentarà a les conclusions<br />
d’aquest QR, <strong>per</strong>met<br />
que la Generalitat i la societat<br />
civil catalana tinguin un pa<strong>per</strong><br />
rellevant en la implantació i <strong>de</strong>senvolupament<br />
<strong>de</strong> la Convenció<br />
i, <strong>per</strong> extensió, a la <strong>UNESCO</strong>.<br />

Relacions internacionals <strong>de</strong><br />
la Generalitat <strong>de</strong> Catalunya:<br />
fonaments jurídics<br />
2.1 L’Estatut d’autonomia <strong>de</strong><br />
2006<br />
El punt <strong>de</strong> palanca fonamental<br />
<strong>per</strong> a implementar <strong>una</strong> <strong>para</strong>diplomàcia<br />
en cultura activa <strong>de</strong><br />
la Generalitat és el nou Estatut<br />
d’autonomia. En el seu article<br />
127, estableix que «correspon a<br />
la Generalitat la competència<br />
exclusiva en matèria <strong>de</strong> cultura.<br />
Aquesta competència exclusiva<br />
comprèn en tot cas: [...] La projecció<br />
internacional <strong>de</strong> la cultura<br />
catalana» (article 127 d. Tercer,<br />
EAC 2006). D’altra banda, el Capítol<br />
III <strong>de</strong> l’Estatut “Acció exterior<br />
<strong>de</strong> la Generalitat” estableix les<br />
competències en <strong>para</strong>dilomàcia<br />
<strong>de</strong>l Govern <strong>de</strong> Catalunya (arts.<br />
193 – 200 EAC 2006).<br />
Al quadre 1 hi ha <strong>una</strong> qüestió<br />
clau com és l’article 198 <strong>de</strong>l<br />
nou Estatut, en què es regula<br />
la presència <strong>de</strong> Catalunya a<br />
la <strong>UNESCO</strong>. En aquest article,<br />
«Participació en organismes<br />
multilaterals», s’estableix el<br />
mandat que «la Generalitat ha<br />
<strong>de</strong> participar en els organismes<br />
internacionals competents<br />
en matèries d’interès rellevant<br />
<strong>per</strong> a Catalunya, especialment<br />
la <strong>UNESCO</strong> i altres organismes<br />
<strong>de</strong> caràcter cultural, en la forma<br />
que estableixi la normativa<br />
corresponent». Segons els catedràtics<br />
<strong>de</strong> Dret Constitucional<br />
<strong>de</strong> la Universitat <strong>de</strong> Barcelona<br />
Mercè Barceló i Joan Vintró,<br />
aquest mandat estatutari<br />
implica que «la Generalitat hi<br />
participa [als organismes internacionals]<br />

2. Presentació <strong>de</strong> resultats<br />
Això no obstant, tal i com es pot<br />
comprovar en el mateix quadre<br />
1, l’article 198 està inclòs en el<br />
recurs d’inconstitucionalitat presentat<br />
pel Partit Popular l’octubre<br />
<strong>de</strong>l 2006. En un primer moment,<br />
es pot pensar que si l’alt trib<strong>una</strong>l<br />
dictamina que aquest article no<br />
s’ajusta a la carta magna, tota<br />
estratègia catalana al si <strong>de</strong> la<br />
<strong>UNESCO</strong> quedaria invalidada.<br />
Al nostre entendre, <strong>per</strong>ò, no és<br />
així. Hi ha tres arguments sòlids<br />
que <strong>per</strong>meten refutar aquesta<br />
afirmació:<br />

els antece<strong>de</strong>nts legislatius<br />
que han <strong>per</strong>mès <strong>una</strong> presència<br />
directa, activa i <strong>per</strong>manent<br />
<strong>de</strong> Catalunya a la<br />
<strong>UNESCO</strong> <strong>de</strong>s <strong>de</strong>l 2004.<br />
2.2. Argument 1. Anàlisi com<strong>para</strong>tiva<br />
amb els estatuts d’autonomia<br />
d’altres comunitats<br />
autònomes<br />
Pel que fa al primer argument,<br />
veurem que els estatuts d’autonomia<br />
reformats durant la VIII<br />
legislatura espanyola (2004-08),<br />
incorporen importants elements<br />
<strong>de</strong> participació <strong>de</strong> les comunitats<br />
en els organismes europeus<br />
i internacionals, a diferència <strong>de</strong>ls<br />
seus prece<strong>de</strong>nts. L’anàlisi com<strong>para</strong>tiva<br />
<strong>de</strong>l quadre 2 entre tots<br />
els estatuts reformats aporta llum<br />
sobre la qüestió.<br />
Com es pot comprovar, dues comunitats<br />
tenen en l’articulat <strong>de</strong>l<br />
seu estatut referències explícites a<br />
la seva presència a la <strong>UNESCO</strong>.<br />
Es tracta <strong>de</strong> Catalunya i Castella<br />
i Lleó. Si es com<strong>para</strong> el redactat i<br />
la data d’aprovació, es pot constatar<br />
que l’estatut castellanolleonès<br />
és un calc <strong>de</strong>l català. Contrasta,<br />
<strong>per</strong>ò, que aquest article hagi estat<br />
objecte <strong>de</strong> recurs d’inconstitucionalitat<br />
<strong>per</strong> part <strong>de</strong>l Partit Popular<br />
en el cas català, <strong>per</strong>ò aprovat en<br />
<strong>una</strong> comunitat governada <strong>per</strong><br />
aquest partit. Una sentència <strong>de</strong>l<br />
TC <strong>de</strong>sfavorable a l’article 198<br />
EAC 2006 que eliminés la presència<br />
catalana a la <strong>UNESCO</strong> generaria<br />
efectes en ca<strong>de</strong>na sobre els<br />
altres estatuts d’autonomia i això<br />
provocaria, <strong>de</strong> retruc, importants<br />
contradiccions en l’or<strong>de</strong>nament<br />
jurídic espanyol. Si l’article 198 <strong>de</strong><br />
l’Estatut català resulta inconstitucional,<br />
no queda gens clar qui, com<br />
ni quan aplicarà aquest criteri a<br />
l’article 67 <strong>de</strong> l’Estatut castellanolleonès,<br />
ni a la resta d’estatuts que,<br />
si bé no fan referència explícita a<br />
la <strong>UNESCO</strong>, sí que tenen un es<strong>per</strong>it<br />
similar (<strong>per</strong> exemple, Andalusia<br />
i València).<br />
2.3. Argument 2. Exposició <strong>de</strong><br />
la doctrina <strong>de</strong>l Trib<strong>una</strong>l Constitucional<br />
El segon argument, segons el<br />
qual <strong>una</strong> sentència <strong>de</strong>sfavorable<br />
en l’article 198 EAC no <strong>de</strong>slegitimaria<br />
l’acció <strong>de</strong> la Generalitat<br />
a la <strong>UNESCO</strong>, té <strong>una</strong> major contundència.<br />
En aquest sentit, la jurisprudència<br />
<strong>de</strong>l TC avala l’acció<br />
internacional <strong>de</strong> la Generalitat,<br />
inclosa la seva participació en<br />
organismes com la <strong>UNESCO</strong>. En<br />
concret, ens referim a les sentències<br />
STC 153/1989, STC 80/1993 i<br />
STC 165/1994.<br />
El catedràtic <strong>de</strong> Dret Constitucional<br />
Antoni Monreal dóna les<br />
claus <strong>per</strong> entendre l’evolució <strong>de</strong>l<br />
Trib<strong>una</strong>l Constitucional sobre la<br />
qüestió. Aquesta evolució està<br />
condicionada <strong>per</strong> factors jurídics,<br />

* Article 195. Acords <strong>de</strong> col·laboració<br />
La Generalitat, <strong>per</strong> a la promoció <strong>de</strong>ls interessos <strong>de</strong> Catalunya, pot subscriure acords <strong>de</strong> col·laboració en l’àmbit <strong>de</strong> les seves<br />
competències. Amb aquesta finalitat, els òrgans <strong>de</strong> representació exterior <strong>de</strong> l’estat han <strong>de</strong> prestar el suport necessari a les<br />
iniciatives <strong>de</strong> la Generalitat.<br />
Article 196. Tractats i convenis internacionals<br />
1. El Govern <strong>de</strong> l’estat ha d’informar prèviament la Generalitat sobre els actes <strong>de</strong> subscripció <strong>de</strong>ls tractats que afectin d’<strong>una</strong><br />
manera directa i singular les competències <strong>de</strong> Catalunya. La Generalitat i el Parlament po<strong>de</strong>n dirigir al Govern les observacions<br />
que consi<strong>de</strong>rin <strong>per</strong>tinents.<br />
2. Si es tracta <strong>de</strong> tractats que afecten Catalunya d’<strong>una</strong> manera directa i singular, la Generalitat pot sol·licitar al Govern que<br />
integri representants <strong>de</strong> la Generalitat en les <strong>de</strong>legacions negociadores.<br />
3. La Generalitat pot sol·licitar al Govern la subscripció <strong>de</strong> tractats internacionals en matèries <strong>de</strong> la seva competència.<br />
4. La Generalitat ha d’adoptar les mesures necessàries <strong>per</strong> executar les obligacions <strong>de</strong>riva<strong>de</strong>s <strong>de</strong>ls tractats i els convenis internacionals<br />
ratificats <strong>per</strong> Espanya o que vinculin l’estat en l’àmbit <strong>de</strong> les seves competències.<br />
Article 197. Coo<strong>per</strong>ació transfronterera, interregional i al <strong>de</strong>senvolupament<br />
1. La Generalitat ha <strong>de</strong> promoure la coo<strong>per</strong>ació amb les regions europees amb què comparteix interessos econòmics, socials,<br />
ambientals i culturals, i hi ha d’establir les relacions que corresponguin.<br />
2. La Generalitat ha <strong>de</strong> promoure la coo<strong>per</strong>ació amb altres territoris, en els termes que estableix l’apartat 1.<br />

Es pot dir que l’evolució<br />
ha tingut dues fases clarament<br />
diferencia<strong>de</strong>s. La primera, entre<br />
1980 i 1990 aproximadament, en<br />
què tant la interpretació restrictiva<br />
<strong>de</strong>l Trib<strong>una</strong>l Constitucional<br />
i <strong>de</strong>l Govern central <strong>de</strong>ixaven<br />
un espai molt reduït d’acció. La<br />
segona, a partir <strong>de</strong> la sentència<br />
STC 153/1989 FJ 3 i d’<strong>una</strong> nova<br />
fase <strong>de</strong> relació coo<strong>per</strong>ativa entre<br />
el Govern central i el <strong>de</strong> Catalunya,<br />
va <strong>per</strong>metre <strong>una</strong> ampliació<br />
<strong>de</strong> l’acció exterior i europea.<br />
Aquesta fase coo<strong>per</strong>ativa, explica<br />
Monreal, es va <strong>de</strong>ure en gran<br />
mesura al final <strong>de</strong>l <strong>per</strong>ío<strong>de</strong> <strong>de</strong><br />
majories absolutes característic<br />

STC 153/1989 FJ 8 «No podría llegar a admitirse que cualquier relación, por lejana que sea, con temas en los que<br />
estén involucrados otros países o ciudadanos extranjeros, implique por sí solo o necesariamente<br />
que la competencia resulte atribuida a la regla “relaciones internacionales”.»<br />

expansiva <strong>de</strong>l art. 149.1.3 CE que venga a subsumir en la competencia estatal toda medida<br />
dotada <strong>de</strong> <strong>una</strong> cierta inci<strong>de</strong>ncia exterior por remota que sea, ya que si así fuera se produciría<br />
<strong>una</strong> reor<strong>de</strong>nación <strong>de</strong>l propio or<strong>de</strong>n constitucional <strong>de</strong> distribución <strong>de</strong> competencias entre el Estado<br />
y las Comunida<strong>de</strong>s Autonómas.»<br />
STC 165/1994 FJ 3 «No pue<strong>de</strong> en forma alg<strong>una</strong> excluirse que, <strong>para</strong> llevar a cabo correctamente las funciones que<br />
tenga atribuidas, <strong>una</strong> Comunidad Autónoma haya <strong>de</strong> realizar <strong>de</strong>terminadas activida<strong>de</strong>s, no ya<br />
sólo fuera <strong>de</strong> su territorio, sino incluso fuera <strong>de</strong> los límites territoriales <strong>de</strong> España.»<br />
[Distinció entre «relacions internacionals» (amb capacitat jurídica <strong>de</strong> ius contrahendi) i «relacions<br />
exteriors» (<strong>de</strong> caràcter polític i social)].<br />
Espanya com a Catalunya. Amb<br />
tot, aquesta fase va estar en quarantena<br />
durant la VII legislatura<br />
espanyola (2000-04), en què el PP<br />
va comptar amb majoria absoluta.<br />

La qüestió fonamental és que la<br />
doctrina <strong>de</strong>l Trib<strong>una</strong>l Constitucional<br />
ha evolucionat <strong>de</strong>s <strong>de</strong> l’inici<br />
<strong>de</strong> la transició <strong>de</strong>mocràtica, i es<br />
pot dir que a partir <strong>de</strong>l 1989 pren<br />
<strong>una</strong> <strong>de</strong>riva menys centralista i<br />
més favorable a la participació<br />
<strong>de</strong> les comunitats autònomes en<br />
les relacions exteriors. En aquest<br />
sentit, el quadre 3 recull els fragments<br />
més representatius <strong>de</strong> les<br />
sentències <strong>de</strong>l TC que <strong>de</strong>ixen<br />
enrere la que es va <strong>de</strong>nominar<br />
«concepció globalitzant» <strong>de</strong> les<br />
relacions internacionals i va<br />
obrir les portes a l’acció exterior<br />
<strong>de</strong> les comunitats autònomes.<br />

La STC 165/1994 <strong>de</strong>ixa clar que les<br />
comunitats autònomes no po<strong>de</strong>n<br />
exercir «relacions internacionals»<br />
en el sentit fort <strong>de</strong> signar tractats<br />
internacionals amb estats sobirans<br />
i organitzacions internacionals governamentals,<br />
que originin obligacions<br />
davant <strong>de</strong> po<strong>de</strong>rs públics<br />
estrangers. Les relacions internacionals,<br />
així <strong>de</strong>fini<strong>de</strong>s, són objecte<br />
<strong>de</strong> reserva <strong>per</strong> l’esmentat article<br />
149.1.3 <strong>de</strong> la Constitució. Això no<br />
obstant, la sentència accepta «la<br />
possibilitat d’establir mesures que<br />
regulin i coordinin les activitats<br />
amb projecció externa <strong>de</strong> les comunitats<br />
autònomes, <strong>per</strong> evitar o<br />
remeiar eventuals <strong>per</strong>judicis sobre<br />
la direcció i l’execució <strong>de</strong> la<br />
política exterior» (Barceló i Vintró,<br />
2008:574). L’Acord <strong>de</strong> Coo<strong>per</strong>ació<br />
Catalunya – Uruguai i el Pla <strong>de</strong><br />
Treball que el <strong>de</strong>senvolupa, abans<br />
citats, en són exemples clars.<br />

Així, d’acord amb STC 165/1994<br />
FJ 3, en aquells casos en què la<br />
Generalitat necessiti actuar més<br />
enllà <strong>de</strong> les fronteres estatals en<br />
el <strong>de</strong>splegament <strong>de</strong> les competències<br />
que li són pròpies, podrà<br />
realitzar <strong>de</strong>termina<strong>de</strong>s activitats<br />
exteriors (excloent, això sí, la signatura<br />
i celebració <strong>de</strong> tractats<br />
internacionals que comportin<br />
l’assumpció <strong>de</strong> compromisos internacionals).<br />
Així doncs, el TC<br />
interpreta l’acció exterior com<br />
un component <strong>de</strong> l’acció <strong>de</strong> les<br />
comunitats autònomes <strong>de</strong>rivat<br />
<strong>de</strong> l’exercici <strong>de</strong> les competències<br />
que li són pròpies.<br />
En conseqüència, i retornant a<br />
l’article 198 <strong>de</strong> l’EAC 2006, malgrat<br />
que el TC el <strong>de</strong>rogués tot<br />
o en part, po<strong>de</strong>m afirmar amb<br />
fonament jurídic que la porta<br />
<strong>de</strong> participació <strong>de</strong> Catalunya a<br />
la <strong>UNESCO</strong> no quedaria tancada.<br />
Podria no quedar recollida<br />
a l’Estatut, <strong>per</strong>ò es podria regular<br />
en altres nivells normatius,<br />
com veurem en el tercer i últim<br />
argument.<br />
2.4. Argument 3. Explicació <strong>de</strong><br />
l’acció ja realitzada pel Govern<br />
<strong>de</strong> la Generalitat<br />
En efecte, el darrer argument<br />
pren en consi<strong>de</strong>ració l’acció <strong>de</strong> la<br />
Generalitat ja realitzada al si <strong>de</strong> la<br />
<strong>UNESCO</strong> <strong>de</strong>s <strong>de</strong>l 2004, moment en<br />
què el govern català va es<strong>de</strong>venir<br />
membre <strong>de</strong> ple dret <strong>de</strong> la <strong>de</strong>legació<br />
espanyola a l’organisme internacional.<br />

l’Estat espanyol (i eventualment<br />
<strong>de</strong> les comunitats autònomes) a la<br />

el seu temps i <strong>de</strong>dicació. Des <strong>de</strong>l setembre<br />

2. Presentació <strong>de</strong> resultats<br />
<strong>UNESCO</strong> es vehicula a través <strong>de</strong><br />
l’anomenada Comisión Nacional<br />
Española <strong>de</strong> Coo<strong>per</strong>ación con la<br />
<strong>UNESCO</strong>. La funció d’aquest òrgan<br />
és la d’assessorar el Govern<br />
central sobre les matèries relatives<br />
a la <strong>UNESCO</strong>, així com mantenir el<br />
contacte institucional <strong>per</strong>manent<br />
amb l’organització internacional.<br />
El punt <strong>de</strong>stacable <strong>de</strong> la qüestió és<br />
que la Comisión està regulada <strong>per</strong><br />
reial <strong>de</strong>cret, <strong>una</strong> norma <strong>de</strong> rang<br />
molt inferior a un estatut d’autonomia.<br />
En l’actualitat, la Comisión és<br />
regida pel Reial <strong>de</strong>cret 173/2004,<br />
<strong>de</strong> 30 <strong>de</strong> gener.<br />
La darrera reforma <strong>de</strong> la comissió<br />
es va produir just al final <strong>de</strong> la VII<br />
legislatura espanyola, en què el PP<br />
governava amb majoria absoluta,<br />
i la va signar l’aleshores ministre<br />
<strong>de</strong> la Presidència, Javier Arenas.<br />
Aquesta modificació va obrir les<br />
portes <strong>per</strong>què hi hagués <strong>una</strong> presència<br />
<strong>de</strong> Catalunya a la <strong>de</strong>legació<br />
espanyola. L’esmentat Reial <strong>de</strong>cret<br />
173/2004 estableix que la comissió<br />
té tres òrgans: el ple, el consell executiu<br />
i la secretaria. El ple aprova<br />
els plans i les línies generals d’actuació<br />
i està constituït <strong>per</strong> l’ambaixador<br />
<strong>de</strong>legat <strong>per</strong>manent d’Espanya<br />
davant la <strong>UNESCO</strong>, representants<br />
<strong>de</strong>ls diferents ministeris implicats,<br />
un representant <strong>de</strong> cadasc<strong>una</strong> <strong>de</strong><br />
les comunitats autònomes i <strong>per</strong>sonalitats<br />
en qualitat d’ex<strong>per</strong>ts.<br />
Per la seva part, el consell executiu<br />
és l’òrgan <strong>de</strong> la comissió que marca<br />
les autèntiques polítiques <strong>de</strong> relació<br />
entre Espanya i la <strong>UNESCO</strong>.<br />
És la «sala <strong>de</strong> màquines» <strong>de</strong> la representació<br />
<strong>de</strong> l’Estat espanyol a<br />
l’organisme internacional i és qui<br />
assisteix a les reunions al si <strong>de</strong> la<br />
<strong>UNESCO</strong>. Està format <strong>per</strong> diversos<br />
representants <strong>de</strong>l Govern central<br />
i dos representants <strong>de</strong> comunitats<br />
autònomes, triats d’entre els representants<br />
<strong>de</strong> les comunitats autònomes<br />
que <strong>per</strong>tanyin al ple, <strong>per</strong> un<br />
<strong>per</strong>ío<strong>de</strong> <strong>de</strong> dos anys.<br />
El mateix any 2004 es va elegir<br />
Catalunya i Astúries com a representants<br />
<strong>de</strong> les comunitats<br />
autònomes al consell executiu<br />
<strong>per</strong> a un <strong>per</strong>ío<strong>de</strong> <strong>de</strong> dos anys.<br />
De les entrevistes realitza<strong>de</strong>s<br />
amb els actors implicats <strong>per</strong> a<br />
la redacció d’aquest estudi, po<strong>de</strong>m<br />
<strong>de</strong>duir que la <strong>de</strong>legació<br />
asturiana va estar absent <strong>de</strong>ls<br />
processos <strong>de</strong> discussió i <strong>de</strong>cisió<br />
<strong>de</strong> la <strong>UNESCO</strong> en general, i <strong>de</strong>l<br />
«Procés Convenció <strong>UNESCO</strong>» en<br />
particular. En canvi, Catalunya<br />
va participar activament en el si<br />
<strong>de</strong> la comissió i, tal com establia<br />
el <strong>de</strong>cret, va assistir a la 33a Conferència<br />
General <strong>de</strong> la <strong>UNESCO</strong>,<br />
l’octubre <strong>de</strong>l 2005, en què es va<br />
aprovar la Convenció. 5 Com es<br />
pot observar, la representació<br />
formal <strong>de</strong> Catalunya al si <strong>de</strong>l<br />
consell executiu va acabar l’any<br />
2006, <strong>per</strong>ò la presència catalana<br />
s’ha mantingut <strong>de</strong> facto, gràcies<br />
a la capacitat política i aportacions<br />
<strong>de</strong> la <strong>de</strong>legació <strong>de</strong> la Generalitat.<br />
És <strong>de</strong>stacable que la porta que<br />
obria aquest <strong>de</strong>cret s’hagi aprofitat<br />
pel Govern català <strong>per</strong> <strong>de</strong>splegar<br />
<strong>una</strong> <strong>para</strong>diplomàcia<br />
en cultura amb <strong>per</strong>sonalitat i<br />
visibilitat. El Procés Convenció<br />
<strong>UNESCO</strong> n’ha estat el trampolí.<br />
Des <strong>de</strong>l darrer tram <strong>de</strong> negociacions<br />
<strong>de</strong> la Convenció, el procés<br />
ha comptat amb la presència i<br />
participació <strong>de</strong> la Generalitat <strong>de</strong><br />
Catalunya. El primer cas va ser<br />
la 3a Reunió Intergovernamental<br />
d’Ex<strong>per</strong>ts (París, 25 <strong>de</strong> maig<br />
- 3 <strong>de</strong> juny <strong>de</strong>l 2005), en què es<br />
va <strong>de</strong>batre i aprovar la propos-<br />

ta <strong>de</strong>finitiva <strong>de</strong> Convenció. A<br />
partir d’aquí, el Departament<br />
<strong>de</strong> Cultura i Mitjans <strong>de</strong> Comunicació<br />
i la Direcció General <strong>de</strong><br />
Relacions Internacionals (sota la<br />
<strong>de</strong>pendència <strong>de</strong>l Departament<br />
<strong>de</strong> la Vicepresidència) han enviat<br />
<strong>de</strong>legacions a cada <strong>una</strong> <strong>de</strong><br />
les reunions <strong>de</strong> presa <strong>de</strong> <strong>de</strong>cisió<br />
sobre la Convenció. L’aportació<br />
<strong>de</strong> recursos i, sobretot, <strong>de</strong> capital<br />
humà ex<strong>per</strong>t, ha <strong>per</strong>mès a la Generalitat<br />
tenir un pa<strong>per</strong> visible i<br />
amb <strong>per</strong>sonalitat pròpia al Procés<br />
Convenció <strong>UNESCO</strong>.<br />
En <strong>de</strong>finitiva, doncs, <strong>de</strong>s d’un<br />
punt <strong>de</strong> vista tècnic, jurídic i polític<br />
no hi ha impediments <strong>per</strong>què<br />
l’acció <strong>de</strong> la Generalitat a la<br />
<strong>UNESCO</strong> continuï la seva via ja<br />
en marxa.<br />

Paradiplomàcia en cultura:<br />
la branca exterior <strong>de</strong> les<br />
polítiques culturals (i no la<br />
branca cultural <strong>de</strong> les polítiques<br />
exteriors)<br />
Podríem caracteritzar el terme<br />
<strong>para</strong>diplomàcia com l’acció internacional<br />
amb <strong>per</strong>sonalitat pròpia<br />
respecte l’«estat metropolità»<br />
<strong>de</strong>ls ens subestatals o governs<br />
no centrals, <strong>per</strong> tal d’aconseguir<br />
els seus interessos internacionals<br />
específics (Wolff, 2007). La <strong>para</strong>diplomàcia,<br />
entesa com a capacitat<br />
política emergent <strong>de</strong> les entitats<br />
subestatals en general, és un fenomen<br />
i un tema relativament<br />
nou en les relacions internacionals.<br />
De capacitat <strong>para</strong>diplomàtica<br />
en po<strong>de</strong>n gaudir tant les regions,<br />
les províncies, els län<strong>de</strong>r o<br />
els estats <strong>de</strong> fe<strong>de</strong>racions, així com<br />
les entitats autònomes i locals<br />
d’altres estats unitaris. Tal com<br />
indica Monreal, l’any 2005 hi havia<br />
més <strong>de</strong> dues-centes oficines<br />
<strong>de</strong> representació <strong>de</strong>l conjunt <strong>de</strong>ls<br />
estats membres <strong>de</strong>ls EUA.<br />
Els actors <strong>para</strong>diplomàtics gau<strong>de</strong>ixen<br />
d’autonomia, disposen <strong>de</strong><br />
capacitat d’acció i són capaços<br />
d’exercir influència internacional<br />
en camps i en graus diversos. «Es<br />
tracta d’<strong>una</strong> activitat que es realitza<br />
en els intersticis <strong>de</strong>l sistema<br />
tradicional <strong>de</strong> relacions internacionals,<br />
intersticis que, podria afegir-se,<br />
po<strong>de</strong>n tendir a eixamplar-se<br />
com a conseqüència <strong>de</strong>ls canvis<br />
que aquestes relacions estan ex<strong>per</strong>imentant<br />
<strong>per</strong> raons <strong>de</strong> tota índole,<br />
culturals, econòmiques i polítiques.»<br />

Per <strong>de</strong>finir la condició d’actor<br />
internacional cal aplicar paràmetres<br />
que vagin més enllà <strong>de</strong>ls<br />
associats tradicionalment amb<br />
l’estat (sobirania, territori, població<br />
i reconeixement jurídic).<br />
També cal consi<strong>de</strong>rar criteris lligats<br />
a la voluntat <strong>de</strong> l’ens polític<br />
<strong>de</strong> <strong>de</strong>splegar <strong>una</strong> acció exterior.<br />
Segons Brian Hocking (1999: 248),<br />
aquests criteris complementaris<br />

Si ens cenyim en l’àmbit <strong>de</strong> la<br />
cultura, la <strong>para</strong>diplomàcia correspon<br />
a l’activitat institucional<br />
exterior relacionada amb les polítiques<br />
culturals. Des d’un punt<br />
<strong>de</strong> vista terminològic, preferim el<br />
terme <strong>para</strong>diplomàcia en cultura<br />
abans que <strong>para</strong>diplomàcia cultural.<br />
D’aquesta manera, evitarem<br />
<strong>una</strong> possible assimilació <strong>de</strong> l’objecte<br />
que ens ocupa amb allò que<br />
hom anomena diplomàcia cultural.<br />
Aquesta es pot <strong>de</strong>finir com<br />
la col·laboració aparentment informal<br />
d’un estat amb individus<br />
i institucions civils estrangeres,<br />
mitjançant un ús institucional <strong>de</strong><br />
la cultura i <strong>de</strong>ls mitjans amb què<br />
es propaga, <strong>per</strong> tal d’obtenir <strong>una</strong><br />
influència política. La intenció és<br />
influir en l’estranger <strong>per</strong> aconseguir<br />
diversos objectius: projectar<br />
els valors i formes <strong>de</strong> vida propis;<br />
trencar estereotips; donar <strong>una</strong><br />
visió positiva <strong>de</strong>l propi país, <strong>de</strong><br />
la seva gent, <strong>de</strong> la seva cultura<br />
i <strong>de</strong> les seves polítiques; canviar<br />
les polítiques <strong>de</strong> governs estrangers;<br />
aconseguir canvis polítics<br />
o culturals en països estrangers,<br />
i prevenir, controlar i mitigar els<br />
conflictes amb adversaris estrangers<br />
(Bound, Kirsten, et al. 2007,<br />
entre altres). La <strong>para</strong>diplomàcia<br />
en cultura, doncs, no és <strong>una</strong><br />
forma <strong>de</strong> soft power que pretén<br />
influir en la <strong>per</strong>cepció <strong>de</strong>l propi<br />

país, sinó que aspira a participar<br />
en els fòrums oficials internacionals<br />
fins allà on <strong>per</strong>met la normativa<br />
d’aquestes institucions o<br />
<strong>de</strong> l’estat mateix.<br />
Fet aquest aclariment, la <strong>para</strong>diplomàcia<br />
en cultura representa<br />
<strong>una</strong> qüestió d’interès estratègic<br />
<strong>per</strong> a Catalunya. És en la coordinació,<br />
especialització i concentració<br />
<strong>de</strong> recursos humans i<br />
financers que Catalunya pot tenir<br />
un cert protagonisme a mig<br />
termini en el redimensionament<br />
<strong>de</strong> la governança política, econòmica<br />
i institucional en curs.<br />
La <strong>para</strong>diplomàcia en cultura<br />
és <strong>una</strong> peça més <strong>de</strong> l’aplicació<br />
<strong>de</strong> les seves competències culturals<br />
<strong>de</strong> caràcter intern. Ja hem<br />
remarcat que les polítiques cul-<br />

turals es <strong>de</strong>fineixen <strong>de</strong> manera<br />
creixent en fòrums internacionals.<br />
És a partir <strong>de</strong> l’arquitectura<br />
dissenyada en els acords<br />
multilaterals, que els governs<br />
nacionals po<strong>de</strong>n <strong>de</strong>splegar les<br />
seves polítiques.<br />
Així, <strong>per</strong> exemple, si el govern<br />
<strong>de</strong> la Generalitat vol establir<br />
<strong>una</strong> quota <strong>per</strong> al cinema doblat<br />
en català a les sales d’exhibició,<br />
prèviament haurà d’analitzar-ne<br />
la viabilitat a la llum <strong>de</strong> tractats<br />
com ara l’AGCS (Acord General<br />
sobre el Comerç <strong>de</strong> Serveis,<br />
GATS en les inicials angleses,<br />
sota la tutela <strong>de</strong> l’OMC). Aquest<br />
exemple il·lustra la necessitat<br />
<strong>de</strong>l Govern <strong>de</strong> la Generalitat<br />
d’eixamplar el radi <strong>de</strong> les seves<br />
polítiques sectorials (industrials,<br />
<strong>de</strong> serveis i també culturals). En<br />
l’àmbit <strong>de</strong> la cultura no es tracta<br />
només d’aplicar unes mesures<br />
immediates <strong>per</strong> a la promoció<br />
<strong>de</strong> les expressions culturals pròpies.<br />
També cal anar més enllà i<br />
preveure quins escenaris s’estan<br />
dibuixant en les negociacions en<br />
curs <strong>de</strong> futures normes internacionals.<br />
Per aquesta raó, l’acció exterior<br />
<strong>de</strong> la Generalitat en matèria <strong>de</strong><br />
cultura s’ha <strong>de</strong> circumscriure en<br />
l’esfera <strong>de</strong> les polítiques culturals,<br />
àmbit sobre el qual té competències<br />
plenes. Afirmar que la<br />
<strong>para</strong>diplomàcia en cultura <strong>per</strong>tany<br />
al terreny <strong>de</strong> les relacions<br />
internacionals, en el sentit clàssic<br />
<strong>de</strong>l terme, es <strong>una</strong> concepció<br />
ancorada al segle XX.<br />

3. Conclusions<br />
Les polítiques que el Govern <strong>de</strong> la Generalitat<br />
pot aplicar en matèria cultural vénen<br />
condiciona<strong>de</strong>s (i algunes vega<strong>de</strong>s, fins<br />
i tot <strong>de</strong>termina<strong>de</strong>s) <strong>per</strong> acords que es prenen<br />
en organismes multilaterals. El marc<br />
d’acció ja no és solament l’Estat espanyol,<br />
entès com a estat sobirà mo<strong>de</strong>rn. Igual que<br />
la resta d’estats <strong>de</strong>l món, Espanya es troba<br />
en un procés <strong>de</strong> cessió <strong>de</strong> sobirania a ens<br />
regionals o mundials, com la Unió Europea<br />
o l’Organització Mundial <strong>de</strong>l Comerç, entre<br />
altres. Aquest procés, volgut i executat<br />
pels mateixos estats, és <strong>una</strong> <strong>de</strong> les característiques<br />
bàsiques <strong>de</strong> la globalització, i està<br />
reubicant els centres <strong>de</strong> po<strong>de</strong>r i <strong>de</strong>cisió, tal<br />
com els havíem conegut fins ara. Com a<br />
conseqüència d’això, s’està <strong>de</strong>sdibuixant<br />
la centralitat <strong>de</strong> l’estat-nació tradicional i<br />
apareixen nous processos i noves lògiques<br />
<strong>de</strong> presa <strong>de</strong> <strong>de</strong>cisions el “mercat diplomàtic”<br />
global.<br />
Paral·lelament, la majoria <strong>de</strong>ls estats també<br />
es troben en un procés <strong>de</strong> <strong>de</strong>scentralització.<br />
D’aquesta manera, es fa efectiu el<br />
principi <strong>de</strong> subsidiarietat, segons el qual<br />
hi ha qüestions que <strong>de</strong>passen la capacitat<br />
reguladora <strong>de</strong>ls estats i, doncs, aquests fan<br />
<strong>una</strong> cessió <strong>de</strong> sobirania a organismes <strong>de</strong><br />
coordinació interestatals; com també hi ha<br />
altres qüestions que es po<strong>de</strong>n resoldre en<br />

un nivell institucional més pro<strong>per</strong> a la ciutadania,<br />
raó <strong>per</strong> la qual hi ha <strong>una</strong> transferència<br />
<strong>de</strong> competències, (<strong>de</strong>volution en anglès)<br />
a les unitats territorials que integren<br />
l’estat.<br />
Per això, el marc en què es po<strong>de</strong>n dissenyar<br />
i aplicar polítiques culturals ja no és,<br />
<strong>de</strong> manera exclusiva i aïllada, l’estat-nació<br />
tradicional. Per tal <strong>de</strong> po<strong>de</strong>r <strong>de</strong>senvolupar<br />
les competències en cultura («exclusives»,<br />
segons el nou Estatut), la Generalitat es<br />
veurà forçada cada vegada més a actuar<br />
més enllà <strong>de</strong>l seu propi territori i <strong>de</strong> les fronteres<br />
espanyoles mateixes. Si el Govern <strong>de</strong><br />
Catalunya no <strong>de</strong>senvolupa <strong>una</strong> política exterior<br />
ferma i coordinada <strong>per</strong> <strong>de</strong>fensar els<br />
interessos <strong>de</strong> la cultura catalana, aquestes<br />
competències exclusives establertes <strong>per</strong><br />
l’Estatut quedaran reduï<strong>de</strong>s a <strong>una</strong> mera<br />
formalitat.<br />
Per tant, l’acció política que la Generalitat<br />
pugui <strong>de</strong>splegar a la <strong>UNESCO</strong> no s’ha <strong>de</strong><br />
consi<strong>de</strong>rar tant <strong>de</strong> naturalesa diplomàtica<br />
(i <strong>per</strong> tant, segons com es miri, intrusiva<br />
respecte a les competències <strong>de</strong> l’Estat en<br />
relacions internacionals), com <strong>de</strong> caràcter<br />
cultural (en execució <strong>de</strong> les competències<br />
que li són pròpies i exclusives). Que l’acció<br />
es doni fora <strong>de</strong>l territori no representa, en<br />
la lògica que imposa la globalització, cap<br />

impediment. La sentència <strong>de</strong>l Trib<strong>una</strong>l<br />
Constitucional STC 165/1994, a més, així ho<br />
estableix.<br />
El present QR argumenta que l’activitat<br />
<strong>para</strong>diplomàtica s’ha <strong>de</strong> <strong>de</strong>senvolupar<br />
a la <strong>UNESCO</strong>, ja que l’acció política aquí<br />
entrellaça àmbits fonamentals <strong>per</strong> a Catalunya<br />
com són les polítiques culturals, les<br />
relacions internacionals i la projecció institucional<br />
<strong>de</strong>l nostre país. La implicació <strong>de</strong>l<br />
Govern en el procés d’aprovació i aplicació<br />
<strong>de</strong> la Convenció sobre diversitat cultural<br />
ha estat el primer graó <strong>per</strong> a un futur<br />
aprofundiment en la relació Catalunya –<br />
<strong>UNESCO</strong>. En aquesta línia, la Convenció<br />
sobre diversitat cultural és el projecte polític<br />
estratègic <strong>per</strong> diverses raons:<br />

Els principis i els valors continguts en<br />
el seu text són plenament compatibles<br />
amb les polítiques <strong>de</strong> la Generalitat: la<br />
Convenció proclama la igual dignitat<br />
<strong>de</strong> totes les cultures i la consi<strong>de</strong>ració<br />
<strong>de</strong> la diversitat <strong>de</strong> les expressions culturals<br />
com <strong>una</strong> riquesa a protegir.<br />
És un projecte multiactors (estats, organismes<br />
d’integració regional, organismes<br />
multilaterals, governs subestatals<br />
i societat civil).<br />
Alguns aspectes importants <strong>de</strong> la Convenció<br />
coinci<strong>de</strong>ixen amb competències<br />
i àmbits importants d’actuació <strong>de</strong>l<br />
Govern (cultura, coo<strong>per</strong>ació cultural<br />
internacional, coo<strong>per</strong>ació <strong>per</strong> al <strong>de</strong>senvolupament,<br />
etc.).<br />
Catalunya compta amb capital humà<br />
ex<strong>per</strong>t en el «Procés Convenció<br />
<strong>UNESCO</strong>».<br />
La Convenció crea el Fons <strong>per</strong> a la<br />
Diversitat Cultural. Una participació<br />
financera catalana comportaria la<br />
presència automàtica d’<strong>una</strong> <strong>de</strong>legació<br />
Qua<strong>de</strong>rns <strong>de</strong> Recerca · Número 2 - juny 2010<br />

3. Conclusions<br />
<strong>de</strong> Catalunya a la Conferència <strong>de</strong> Donants<br />
<strong>de</strong> la Convenció.<br />
La GeneraIitat ha realitzat aportacions<br />
importants al procés, sigui en logística i<br />
organització <strong>de</strong> jorna<strong>de</strong>s oficials <strong>de</strong> treball,<br />
sigui en know-how o exemples en<br />
bones pràctiques. Això li ha <strong>per</strong>mès presentar-se<br />
en primera <strong>per</strong>sona davant la<br />
<strong>UNESCO</strong> i sumar bons arguments a qualsevol<br />
<strong>de</strong>manda <strong>de</strong> participació formal en<br />
l’organisme.<br />
La Convenció és un procés dinàmic que<br />
tot just es troba als seus inicis. Atès que no<br />
hi ha doctrina jurídica ni jurisprudència,<br />
que finalment es<strong>de</strong>vingui <strong>una</strong> referència<br />
en el dret internacional, <strong>de</strong>pèn en gran<br />
mesura <strong>de</strong> les aportacions teòriques i <strong>de</strong><br />
les bones pràctiques que generi aquest<br />
procés. Amb la seva entrada en vigor tot<br />
just s’inicia un procés <strong>per</strong> dotar-la <strong>de</strong> contingut<br />
i autoritat. Treballar <strong>per</strong> l’èxit <strong>de</strong> la<br />
Convenció no sols és treballar pels seus<br />
principis, valors i projectes. Una contribució<br />
<strong>de</strong>l Govern <strong>de</strong> la Generalitat que millori<br />
<strong>de</strong> manera sensible les possibilitats<br />
d’èxit <strong>de</strong> la Convenció representa <strong>una</strong><br />
possibilitat real <strong>de</strong> guanyar pes i influència<br />
en l’àmbit internacional, molt especialment<br />
en el camp <strong>de</strong> la cultura.<br />
En <strong>de</strong>finitiva, si les primeres dèca<strong>de</strong>s <strong>de</strong><br />
la <strong>de</strong>mocràcia han servit <strong>per</strong>què la societat<br />
civil catalana teixís <strong>una</strong> xarxa <strong>de</strong> relacions<br />
internacionals, essent el <strong>Centre</strong><br />
<strong>UNESCO</strong> <strong>de</strong> Catalunya - Unescocat l’interlocutor<br />
natural <strong>de</strong> Catalunya amb la<br />
<strong>UNESCO</strong>, les condicions actuals <strong>per</strong>meten<br />
fer un pas endavant. A més <strong>de</strong> mantenir<br />
i enfortir aquesta via d’acció exterior<br />
cultural, ara es pot “institucionalitzar” la<br />
presència catalana en l’àmbit internacional<br />
<strong>de</strong> la cultura. Així, la Generalitat pot<br />
aprofitar els instruments al seu abast <strong>per</strong><br />
cristal·litzar <strong>una</strong> política <strong>para</strong>diplomàtica<br />

en l’àmbit <strong>de</strong> la <strong>UNESCO</strong>. És més, l’acció<br />
<strong>para</strong>diplomàtica en cultura <strong>de</strong> la Generalitat<br />
ja no és un luxe o <strong>una</strong> proposta visionària.<br />
S’ha <strong>de</strong> concebre com l’aplicació<br />
<strong>de</strong> les seves competències que, <strong>per</strong> exercir-les,<br />
po<strong>de</strong>n tenir part <strong>de</strong> la seva acció<br />
fora <strong>de</strong> les fronteres <strong>de</strong> l’Estat espanyol.<br />
En aquest canvi <strong>de</strong> <strong>para</strong>digma, Catalunya<br />
té un cert «avantatge psicològic» respecte<br />
d’altres països que han viscut un segle<br />
XX més còmo<strong>de</strong>, <strong>de</strong>s <strong>de</strong>l punt <strong>de</strong> vista<br />
<strong>de</strong> la sobirania nacional. La caiguda <strong>de</strong>l<br />
mur <strong>de</strong> Berlín, la digitalització i les noves<br />
migracions representen un trencament <strong>de</strong><br />

3. Conclusions<br />
l’ordre que havien aconseguit i que semblava<br />
<strong>de</strong>finitiu. En aquest context, no és<br />
<strong>una</strong> casualitat que països com Dinamarca,<br />
Suècia, Irlanda o Holanda votessin<br />
«no» a successius referèndums sobre la<br />
integració europea. En la majoria <strong>de</strong>ls casos,<br />
aquesta negativa no es <strong>de</strong>u a opcions<br />
antieuropees, sinó a sentiments d’incertesa<br />
i fins i tot <strong>de</strong> por. La feblesa que algunes<br />
comunitats com Catalunya han patit<br />
durant el segle XX podria es<strong>de</strong>venir, ara<br />
al segle XXI, <strong>una</strong> aliada <strong>per</strong> afrontar les<br />
incerteses d’<strong>una</strong> globalització sense instruccions<br />
d’ús.<br />

4. Propostes d’actuació<br />
De caràcter general:<br />
Unitat i <strong>per</strong>durabilitat<br />
La <strong>para</strong>diplomàcia en cultura ha <strong>de</strong> tenir<br />
unitat i <strong>per</strong>durabilitat <strong>per</strong> tal <strong>de</strong> generar<br />
resultats a mitjà-llarg termini. En aquest<br />
sentit, és molt important un acord polític<br />
transversal que comprometi els partits<br />
polítics <strong>de</strong> Catalunya a no fer-ne arma<br />
electoral.<br />
1. Departament d’Acció Exterior: El govern<br />
<strong>de</strong> la Generalitat ha <strong>de</strong> calibrar<br />
quin tipus <strong>de</strong> <strong>para</strong>diplomàcia en cultura<br />
és més convenient. D’<strong>una</strong> banda,<br />
es pot optar <strong>per</strong> la creació d’un<br />
Departament (“Conselleria”) d’Acció<br />
Exterior <strong>de</strong>l Govern <strong>de</strong> la Generalitat,<br />
<strong>per</strong> tal <strong>de</strong> donar visibilitat i autonomia<br />
a la <strong>para</strong>diplomàcia cultural.<br />
Però, <strong>de</strong>s d’un punt <strong>de</strong> vista pragmàtic,<br />
un comissionat que <strong>de</strong>pengui <strong>de</strong><br />
la Presidència o Vicepresidència <strong>de</strong>l<br />
govern podria treballar amb vocació<br />
transversal i coordinar els diferents<br />
<strong>de</strong>partaments implicats. Aquesta segona<br />
opció comportaria un treball<br />
menys mediàtic que <strong>una</strong> Conselleria,<br />
<strong>per</strong>ò <strong>per</strong>metria avançar <strong>per</strong> la via<br />
<strong>de</strong>ls fets.<br />

2. Finançament: De forma complementària,<br />
la <strong>para</strong>diplomàcia en cultura<br />
ha <strong>de</strong> tenir un finançament apropiat<br />
i garantit <strong>de</strong> forma plurianual.<br />
3. Formació: La <strong>para</strong>diplomàcia en<br />
cultura és <strong>una</strong> política fundacional i,<br />
<strong>per</strong> això, és fonamental la formació<br />
<strong>de</strong> quadres tècnics i comandaments<br />
<strong>per</strong> a la seva <strong>de</strong>finició i aplicació. Es<br />
tracta d’<strong>una</strong> acció política interdisciplinària,<br />
que entrellaça àmbits diversos<br />
com les relacions internacionals,<br />
les polítiques culturals, la coo<strong>per</strong>ació<br />
<strong>per</strong> al <strong>de</strong>senvolupament, les polítiques<br />
<strong>de</strong> sostenibilitat i el comerç internacional,<br />
entre altres.<br />
4. Recerca aplicada i intercanvi d’informació:<br />
La recerca aplicada i l’intercanvi<br />
<strong>de</strong> bones pràctiques amb<br />
altres governs i organismes és <strong>una</strong><br />
eina a<strong>de</strong>quada <strong>per</strong> renovar les polítiques<br />
d’acció cultural exterior que<br />
es <strong>de</strong>senvolupen <strong>de</strong>s <strong>de</strong> Catalunya.<br />
5. Relació amb la coo<strong>per</strong>ació internacional:<br />
La <strong>para</strong>diplomàcia en cultura<br />
ha d’anar estretament lligada a la<br />
coo<strong>per</strong>ació internacional. De fet, un<br />
eix <strong>de</strong> la seva acció hauria <strong>de</strong> ser la<br />
coo<strong>per</strong>ació cultural internacional.<br />

6. Avaluació posterior: La <strong>para</strong>diplomàcia<br />
en cultura ha d’incorporar<br />
mecanismes d’avaluació i fiscalització<br />
política.<br />
De caràcter específic:<br />
Acord <strong>UNESCO</strong> – Catalunya<br />
Aquest acord s’ha d’inspirar en l’acord bilateral<br />
entre Flan<strong>de</strong>s i la <strong>UNESCO</strong>, en<br />
què s’acorda l’aportació flamenca a un<br />
fons fiduciari amb projectes elaborats<br />
i executats <strong>per</strong> Flan<strong>de</strong>s. Malgrat que<br />
l’acord estigui regit <strong>per</strong> un comitè mixt<br />
<strong>UNESCO</strong> - Flan<strong>de</strong>s, és la comunitat flamenca<br />
la que assigna els ex<strong>per</strong>ts que<br />
han <strong>de</strong> dur a terme els programes, amb<br />
l’objectiu que la seva aportació econòmica<br />
serveixi també com a formació <strong>de</strong><br />
quadres.<br />
1. Fons <strong>per</strong> a la diversitat cultural: Com<br />
a primer pas <strong>per</strong> assolir un futur fons<br />
fiduciari general <strong>de</strong> Catalunya a la<br />
<strong>UNESCO</strong>, és important <strong>una</strong> participació<br />
activa <strong>de</strong> la Generalitat en el<br />
Fons <strong>per</strong> a la Diversitat Cultural creat<br />
específicament <strong>per</strong> la Convenció.<br />
Aquest fons no estableix <strong>una</strong> contribució<br />
prescriptiva <strong>per</strong> als estats signataris<br />
<strong>de</strong>l tractat i, a més, està obert<br />
a la participació d’altres entitats <strong>de</strong><br />
naturalesa diversa, inclosos els governs<br />

participi en aquest fons solidari és la<br />
via <strong>per</strong> tenir un protagonisme en la<br />
implementació <strong>de</strong> la Convenció, <strong>per</strong>què<br />
en aquests moments disposa <strong>de</strong><br />
poques aportacions. D’aquí ve, entre<br />
altres raons, la importància d’entrellaçar<br />
<strong>para</strong>diplomàcia en cultura i<br />
amb coo<strong>per</strong>ació internacional.<br />
2. Garantia legal <strong>de</strong> la presència <strong>de</strong><br />
Catalunya a la <strong>UNESCO</strong>: Quant a la<br />
participació formal <strong>de</strong> la Generalitat<br />
en els òrgans <strong>de</strong> <strong>de</strong>cisió <strong>de</strong> la UNES-<br />
CO, i més enllà <strong>de</strong> la <strong>de</strong>cisió <strong>de</strong>l TC<br />
sobre l’Estatut, caldria aprovar <strong>una</strong><br />
norma nova que blindi la presència<br />
com a membre nat <strong>de</strong> Catalunya al<br />
ple i al consell executiu <strong>de</strong> la Comissió<br />
espanyola <strong>de</strong> coo<strong>per</strong>ació amb la<br />
<strong>UNESCO</strong>.<br />
3. Societat civil: En l’àmbit intern, és<br />
fonamental la creació d’un organisme<br />
o associació que aplegui tots els<br />
actors implicats (institucions, societat<br />
civil, indústria, acadèmia, etc.) i que<br />
actuï com un catalitzador d’i<strong>de</strong>es i<br />
projectes <strong>per</strong> al Govern. Seria convenient,<br />
a més, que aquest ens fos la<br />
Coalició Catalana sobre Diversitat<br />
Cultural, fe<strong>de</strong>rat a la xarxa internacional<br />
<strong>de</strong> coalicions. D’aquesta manera,<br />
el projecte d’implementar <strong>una</strong><br />
<strong>para</strong>diplomàcia cultural no sols seria<br />
polític, sinó també cívic.<br />

Abstract: The 21 st century offers Catalonia a much broa<strong>de</strong>r horizon to<br />
strengthen its international presence. First, globalisation has<br />
been steadily chipping away at the role of nation states and<br />
the monopoly they have held on international relations since<br />
the dawn of the mo<strong>de</strong>rn state. Second, the new Statute of<br />
Autonomy is a major tool (albeit not an indispensable one,<br />
as will be argued below) for action in certain spheres of the<br />
global arena, in particular Articles 193 to 200 of the Statute,<br />
which together comprise Title V, Chapter III, ‘Foreign activities<br />
of the Catalan Government’.<br />

One sphere in which Catalonia has begun to play an important<br />
role and enjoys a wealth of possibilities is <strong>UNESCO</strong>.<br />
<strong>UNESCO</strong> allows participation by bodies that are not strictly<br />
states, but whose spheres of action encompass culture (intergovernmental<br />
organisations, NGOs, local and regional<br />
governments, etc.). Within this favourable context, the Convention<br />
on Cultural Diversity is an i<strong>de</strong>al platform to find new<br />
ways for sub-central governments to participate in the governance<br />
of globalisation.<br />

1. Context<br />
Globalisation has profoundly altered the<br />
logic of international relations. One of the<br />
first visible effects of this process is that nation<br />
states have lost the monopoly they had<br />
held to date on the global arena. The emergence<br />
of new actors in the <strong>de</strong>bate and the<br />
application of certain cross-bor<strong>de</strong>r policies<br />
require states to accept new diplomatic<br />
practices, beyond traditional ‘treaty and<br />
embassy diplomacy’.<br />
In the context of this new reality, sub-state<br />
governments such as Catalonia’s have<br />
begun to discern the possibilities opening<br />
up before them beyond their traditional<br />
bor<strong>de</strong>rs. Proof of this are the workshops<br />
that non-central governments have been<br />
holding to <strong>de</strong>fine and promote different<br />
common practices that are starting to become<br />
routine. To this end, one might cite<br />
the following three examples:<br />

‘Decentralised Governments and the<br />
New Multilateralism’, co-sponsored by<br />
the Catalan Government and United<br />
Nations University (UNU) in New York.<br />
Clearly, Catalonia is a lea<strong>de</strong>r in this strategic<br />
sphere and has used its status to<br />
begin to make significant contributions to the<br />
reformulation of international relations and<br />
global governance that is now un<strong>de</strong>rway.<br />
One area in which the Catalan Government<br />
has been active is the <strong>de</strong>bate over and<br />
implementation of the Convention on the<br />
Protection and Promotion of the Diversity<br />
of Cultural Expressions, adopted by<br />
<strong>UNESCO</strong> in 2005. This international treaty,<br />
which promotes multilateral governance<br />
of global cultural diversity, has served as<br />
both a testing ground and springboard<br />
for Catalonia in its efforts to cement its<br />
<strong>para</strong>diplomacy in the sphere of culture.<br />
This report focuses on this new reality and<br />
the concerns of non-central governments.<br />
For some time now, the lea<strong>de</strong>rs of substate<br />
bodies have un<strong>de</strong>rstood that they are<br />
navigating uncharted political waters, in<br />
which there is not yet a substantial body<br />
of theory or legal grounds to support their<br />
actions. This study, based on the author’s<br />
doctoral thesis (Petit 2009), read at Ramon<br />
Llull University, seeks to fill a gap in the<br />
field requiring reflection and proposals.<br />

2 Presentation of results<br />
The research presented here analyses<br />
the Catalan Government’s opportunities<br />
for international action within the sphere<br />
of culture.<br />
To this end, it will first examine the activities<br />
of sub-central governments such as<br />
California’s or Quebec’s, both of which are<br />
examples of governments that have pursued<br />
an international strategy adapted<br />
to their domestic needs (economic, industrial,<br />
cultural, etc.). These cases exemplify<br />
certain emerging trends and the possibilities<br />
offered by globalisation.<br />
In this context of complex multi-actor governance,<br />
Catalonia can engage in sustained<br />
and selective international activity,<br />
focusing on <strong>UNESCO</strong>, to heighten its political<br />
and cultural profile. The first step,<br />
which it has already taken, is to become<br />
involved in the work on the Convention<br />
on Cultural Diversity, whose ‘i<strong>de</strong>ological’<br />
structure will be examined here.<br />
The report will then look at the powers<br />
granted by the new Statute of Autonomy to<br />
the Catalan Government in the sphere of<br />
foreign policy, even though, at the time of<br />

writing, the Spanish Constitutional Court<br />
had not yet issued its <strong>de</strong>cision regarding<br />
the appeal filed against it. Regardless, this<br />
pa<strong>per</strong> maintains that even if the Constitutional<br />
Court were to rule against Title V,<br />
Chapter III of the Statute (‘Foreign activities<br />
of the Catalan Government’), it would not<br />
eliminate the legal basis for Catalonia’s foreign<br />
activities. This view is based on three<br />
arguments:<br />
1. A com<strong>para</strong>tive analysis of the statutes<br />
of other autonomous regions of Spain.<br />
2. An examination of Spanish Constitutional<br />
Court doctrine.<br />
3. An explanation of the activities already<br />
conducted by the Catalan<br />
Government in this sphere.<br />
Finally, this pa<strong>per</strong> conclu<strong>de</strong>s by coining<br />
the term <strong>para</strong>diplomacy in the sphere of<br />
culture, a political science concept referring<br />
to the foreign activities of sub-state<br />
governments. In sum, it maintains that<br />
<strong>para</strong>diplomacy in the sphere of culture<br />
should not be consi<strong>de</strong>red part of a government’s<br />
diplomatic policy, but rather part of<br />
its cultural policy.<br />

in the logic of international relations,<br />
among many other spheres.<br />
The proliferation of all manner<br />
of flows (tra<strong>de</strong>, financial, tourism,<br />
migratory, information, etc.)<br />
means that states are no longer<br />
the sole possible agents in international<br />
relations. According to<br />
Michael Keating, former director<br />
of the Department of Political and<br />
Social Sciences at the European<br />
University Institute in Florence, this<br />
is normal. Alongsi<strong>de</strong> the embassies<br />
and official <strong>de</strong>legations, one<br />
finds representatives of sub-state<br />
governments (regional and local),<br />
companies, tra<strong>de</strong> unions, social<br />
movements and transnational organisations<br />
such as Greenpeace<br />
or Oxfam. ‘This universe is complex,<br />
fragmented and unstructured’<br />
(Keating 1999:231 and, also,<br />
Keating 2003:6).<br />
Non-central governments in <strong>de</strong>veloped<br />
countries have steadily<br />
increased their foreign activity<br />
since the 1980s. First and<br />
foremost, this activity has been<br />
used to internationalise domestic<br />
economies. In a context of<br />
economic globalisation, policies<br />
aimed at attracting investments<br />
and promoting exports are the<br />
main drivers behind non-central<br />
governments’ foreign activities.<br />

temberg, Bavaria, Ontario, New<br />
South Wales—have far more resources<br />
to act abroad than their<br />
smaller and less well-endowed<br />
counterparts. In<strong>de</strong>ed, they have<br />
more resources than many <strong>de</strong>veloping<br />
countries.<br />
California is so big, and its problems<br />
so immense, that it needs its<br />
own foreign policy. In an era when<br />
economics commands foreign<br />
relations, this does not mean<br />
embassies and armies, but it does<br />
mean more tra<strong>de</strong> offices and state<br />
agents in foreign countries, its own<br />
relations with foreign nations and<br />
a governor and legislature willing<br />
to represent the state’s interests<br />
in<strong>de</strong>pen<strong>de</strong>ntly of Washington.<br />

Thus, the most populous state in the<br />
US, with a GDP higher than Canada’s,<br />
had to reposition itself after<br />
the North American Free Tra<strong>de</strong><br />
Agreement (NAFTA) was signed.<br />
In short, the world is currently witnessing<br />
a major transformation of<br />
the nation state: no longer a protected<br />
market for local industry, the<br />
nation state has dissolved its tra<strong>de</strong><br />
bor<strong>de</strong>rs and opened the floodgates<br />
to international markets<br />
and capital flows. The old conceit<br />
of a nation state with sovereignty<br />
over tra<strong>de</strong> is history. ‘Just as firms<br />
have engaged in the construction<br />
of strategic alliances for reasons<br />
of cost and competitiveness, so regions,<br />
localities and cities <strong>de</strong>velop<br />
international linkages and their<br />
own brand of strategic alliance<br />
aimed at strengthening their position<br />
in the global economy’ (Hocking<br />
1999:19 and, also, Hocking<br />
2003:244-5).<br />
From this <strong>per</strong>spective, the Catalan<br />
Government’s foreign activities<br />
have been aimed at attracting<br />
foreign investment,<br />
<strong>de</strong>veloping foreign markets for<br />
domestic economic agents and,<br />
as a si<strong>de</strong> product, strengthening<br />
the powerful tourist attraction set<br />
into motion by the extraordinary<br />
branding power of the Barcelona<br />
Olympics. The Catalan Government’s<br />
activities are part of a<br />
broa<strong>de</strong>r ten<strong>de</strong>ncy to seek opportunities<br />
in the dynamic context<br />
of globalisation. It has done no<br />
more than any other sub-state<br />
government with a certain <strong>de</strong>gree<br />
of economic and political<br />
capacity. Àngel Mesado, former<br />
officer of the Catalan Government’s<br />
Office of Foreign Affairs,<br />
offers a <strong>de</strong>tailed analysis of the<br />
history of the Catalan Government’s<br />
foreign relations, above<br />
all with regard to <strong>UNESCO</strong>:<br />
From the start of the system of<br />
autonomous regions, the Catalan<br />
Government’s foreign activities have<br />
been conducted by its different ministries,<br />
each in its respective sphere<br />
of action. The coordination of these<br />
activities has generally fallen to<br />
units attached to the Presi<strong>de</strong>ntial<br />
Department that have lacked the<br />
necessary capacity to assume the<br />
coordination of foreign activity as a<br />
whole. 1 This scattered structure was<br />
roun<strong>de</strong>d out with a series of related<br />
public-private agents and bodies,<br />
generally in the form of consortiums<br />
and boards, that shoul<strong>de</strong>red some<br />
of the responsibility for strengthening<br />

presence. To this end, it is worth<br />
noting the importance of the Patronat<br />
Català Pro Europa (Catalan<br />
Foundation for Europe) in fomenting<br />
Catalonia’s relationship with<br />
the European Union and the former<br />
Institut d’Estudis <strong>de</strong> la Mediterrània<br />
(Institute of Mediterranean Studies,<br />
today, IEMed), a consortium com-<br />

prised of the Catalan Government,<br />
the Barcelona City Council and the<br />
Spanish Government, responsible<br />
for organising foreign activity in the<br />
priority region of the Mediterranean<br />
and, especially, the Maghreb. In the<br />
field of economic and tra<strong>de</strong> relations,<br />
the prestigious consortiums<br />
COPCA (Consortium for Commercial<br />
Promotion of Catalonia) and<br />
CIDEM (<strong>Centre</strong> for Innovation and<br />
Business Development) are <strong>de</strong>voted<br />
to the overseas promotion of Catalan<br />
tra<strong>de</strong> and industry, respectively.<br />
Since 2003, the so-called ‘Govern<br />
Catalanista i d’Esquerres’ (Pro-Catalan<br />
Left-Wing Government) has<br />
maintained the basic administrative<br />
structure based on a coordinating<br />
unit (in this case, the Office of<br />
International Relations) attached to<br />
the Presi<strong>de</strong>ntial Department. 2<br />

However, the foreign activities of<br />
any government, whether state or<br />
sub-state, encompass more than<br />
just tra<strong>de</strong>. Another aspect of international<br />
relations is coo<strong>per</strong>ation.<br />
This sphere, too, offers Catalonia<br />
a gateway for international action.<br />
A good example of this is the<br />
agreement signed in January 2009<br />
between the Catalan Government,<br />
through the Catalan Agency<br />
for Development Coo<strong>per</strong>ation<br />
(ACCD in Catalan), and the United<br />
Nations Development Program<br />
(UNDP). This memorandum of un<strong>de</strong>rstanding<br />
is the first agreement<br />
that this body of the United Nations<br />
has signed with a non-state entity.<br />
Likewise relevant is the coo<strong>per</strong>ation<br />
agreement between Catalonia<br />
and the Republic of Uruguay,<br />
signed in 2006. In September 2009,<br />
the 2009-2011 Work Plan to implement<br />
the agreement in spheres<br />

such as foreign relations, youth<br />
affairs, tourism, innovation and<br />
training was signed. To this end,<br />
the Catalonia-Uruguay Work Plan<br />
aims to strengthen existing collaboration,<br />
such as that between the<br />
Catalan Institut <strong>de</strong> Recerca i Tecnologia<br />
Agroalimentàries (Food<br />
and Agriculture Research and<br />
Technology Institute or IRTA) and<br />
the Uruguayan Instituto Nacional<br />
<strong>de</strong> Investigación Agropecuaria<br />
d’Uruguay (National Institute for<br />
Agricultural Research or INIA).<br />
In short, Catalonia’s international<br />
presence can span not only the<br />
marketplace, but also spheres<br />
such as values and knowledge.<br />
In this new globalised panorama,<br />
fe<strong>de</strong>ral systems have clear advantages.<br />
In such systems, substate<br />
governments participate in<br />
the international sphere in those<br />
areas where they have substantive<br />
political powers. This often<br />
inclu<strong>de</strong>s political areas of both<br />
symbolic and real importance<br />
for policy. Thus, <strong>para</strong>diplomatic<br />
activities inclu<strong>de</strong> both general<br />
spheres (e.g., the economy, the<br />
environment, social policy, rural<br />
and urban <strong>de</strong>velopment, etc.)<br />
and, in the case of communities<br />
with a distinct language and/or<br />
culture, other more specific ones<br />
(e.g., culture, education, linguistic<br />
policy, religion, etc.).<br />
With regard to cultural policy,<br />
Quebec was the first region to realise<br />
that it is inextricably linked<br />
to rigorous and efficient (<strong>para</strong>)diplomatic<br />
activities geared towards<br />
obtaining advantages un<strong>de</strong>r<br />
international agreements. In<br />
the negotiations for the aforementioned<br />
North American Free Tra<strong>de</strong><br />
Agreement (NAFTA) between<br />
Mexico, the US and Canada, Canada<br />
<strong>per</strong>sua<strong>de</strong>d the US to exclu<strong>de</strong><br />
cultural goods and services from<br />
the tra<strong>de</strong> liberalisation between<br />
them. As a result of this ‘cultural<br />
exception’, inclu<strong>de</strong>d in Annex I<br />
to NAFTA, the Canadian government<br />
can intervene in the market<br />
with measures to promote Canadian<br />
culture. Moreover, within the<br />
specific rules governing the cultural<br />
sector, even more favourable<br />
conditions apply to Quebec, which<br />
can partner with other states that<br />
share its language. Thus, the doors<br />
remain open to, for example, film<br />
co-productions with France un<strong>de</strong>r<br />
a highly favourable scheme<br />
(Zellagui 2001). In contrast, Mexico<br />
did not exclu<strong>de</strong> the cultural sector<br />
from NAFTA and, ever since the<br />
treaty was signed, its hands have<br />
been tied when it comes to cultural<br />
policy. To cite just one example, according<br />
to data from the Coalición<br />
Mexicana <strong>para</strong> la Diversidad Cultural<br />
(Mexican Coalition for Cultural<br />
Diversity), film production in<br />
Mexico has dropped off by 72%<br />
in recent years. Moreover, the US<br />
controls 2,500 of the 3,000 cinema<br />
screens in Mexico. As a result, the<br />
Coalition conclu<strong>de</strong>s, production<br />
companies have fol<strong>de</strong>d, unemployment<br />
in the sector has risen<br />
and the country’s audiovisual exports<br />
have fallen (Barlet 2005).<br />
These examples un<strong>de</strong>rscore the<br />
need for cultural policy routinely<br />
to inclu<strong>de</strong> very close monitoring<br />
of the negotiations for international<br />
agreements, even when<br />
these agreements ‘only <strong>de</strong>al with<br />
tra<strong>de</strong>’. The Catalan Government’s<br />
<strong>para</strong>diplomatic activity is no longer<br />
a luxury, but rather an essential<br />
cog of its domestic policy.<br />
In the dawn of a new global society,<br />
the reformulation of foreign<br />
activities gives rise to new participation<br />
dynamics, as well as new<br />
domestic expectations. In the case<br />
of Catalonia, this pa<strong>per</strong> will show<br />
that the Catalan Government has<br />
technical and legal grounds to<br />
make a qualitative leap and engage<br />
in active <strong>para</strong>diplomacy as<br />

a Catalan contribution to globalisation.<br />
Moreover, the <strong>UNESCO</strong><br />
Convention on Cultural Diversity<br />
and its implementation is the<br />
sphere where Catalonia can put<br />
its active, selective and strategic<br />
multilateralism into practice. It is<br />
through the specialisation and<br />
concentration of human and financial<br />
resources that Catalonia<br />
can contribute its own brand of<br />
value ad<strong>de</strong>d to the current efforts<br />
to reshape political, economic and<br />
institutional governance. The case<br />
can be ma<strong>de</strong> for it to conduct a<br />
limited but sustained diplomacy,<br />
which will afford it a prominent<br />
role and allow it to engage in activities<br />
that will help it to reinvent<br />
its international presence. To this<br />
end, the <strong>UNESCO</strong> Convention on<br />
Cultural Diversity may play a key<br />
role in broa<strong>de</strong>ning and strengthening<br />
a breed of cultural <strong>para</strong>diplomacy<br />
with bountiful yields for<br />
Catalonia.<br />
1.2 The Convention on<br />
Cultural Diversity: <strong>UNESCO</strong>’s<br />
commitment to global<br />
governance of diversity<br />
On 20 October 2005, the 33 rd General<br />
Conference of the United<br />
Nations Educational, Scientific<br />
and Cultural Organisation<br />
(<strong>UNESCO</strong>) approved the Convention<br />
on the Protection and<br />
Promotion of the Diversity of<br />

<strong>UNESCO</strong> member states voted<br />
for the international treaty, four<br />
abstained and two, the US and<br />
Israel, voted against it. The Convention’s<br />
adoption was met with<br />
great fanfare, as it was seen as<br />
a counterweight to the World<br />
Tra<strong>de</strong> Organisation’s (WTO) international<br />
tra<strong>de</strong> liberalisation<br />
agreements. In<strong>de</strong>ed, it can be argued<br />
that the Convention jolted<br />
<strong>UNESCO</strong> out of the institutional<br />
lethargy into which it had fallen<br />
following the crisis triggered by<br />
the adoption of the MacBri<strong>de</strong><br />
Report in the 1980s. Thus, the<br />
Convention marked a milestone<br />
in the sphere of cultural diversity<br />
un<strong>de</strong>r international law and,<br />
from a political <strong>per</strong>spective, <strong>de</strong>alt<br />
a major blow to the Bush administration,<br />
in terms of its embrace<br />
of unilateralism and its strategy<br />
of <strong>de</strong>regulating the cultural and<br />
audiovisual markets.<br />
As for its content, the Convention<br />
enshrines countries’ sovereign<br />
right to implement cultural policies<br />
in international law. Its guiding<br />
principles are as follows:<br />

Cultural diversity is closely<br />
linked to human rights, such<br />
as freedom of speech or creation,<br />
as well as to <strong>de</strong>mocracy,<br />
pluralism and international<br />

solely in terms of their commercial<br />

whether or not they are economically<br />

to the cultural industries of<br />
<strong>de</strong>veloping countries.<br />
Solidarity is a key value in<br />
the relations between cultures;<br />
it is thus necessary to<br />
promote the transfer of technology<br />
and know-how and<br />
other forms of coo<strong>per</strong>ation<br />
between <strong>de</strong>veloped and <strong>de</strong>veloping<br />
countries.<br />
The cultural industry is linked<br />
to the sustainable <strong>de</strong>velopment<br />
of societies.<br />
The Convention establishes<br />
implementation and monitoring<br />
mechanisms. It likewise<br />
provi<strong>de</strong>s for the creation of a<br />
dispute settlement mechanism,<br />
which could generate<br />
a body of international law<br />
from a cultural rather than<br />
tra<strong>de</strong> <strong>per</strong>spective.<br />
The <strong>UNESCO</strong> Convention<br />
on Cultural Diversity is not<br />
subordinate to other international<br />
agreements and treaties,<br />
such as the WTO agreements,<br />
although neither does<br />
it repeal them.<br />
Research directed by Francina<br />
Esteve and Claudia Jiménez,<br />
professors of public international<br />
law at the Autonomous University<br />
of Barcelona (UAB), i<strong>de</strong>ntifies<br />
the Convention’s main features<br />
(Esteve and Jiménez 2006). To this<br />
end, one issue affecting the treaty’s<br />
i<strong>de</strong>ological un<strong>de</strong>rpinnings<br />
is its recognition of ‘the distinctive<br />
nature of cultural activities,<br />
goods and services as vehicles<br />
of i<strong>de</strong>ntity, values and meaning’<br />
(Art. 1.g). This argument was unsuccessfully<br />
used by advocates<br />
of a cultural exception during<br />
the WTO’s Uruguay Round (1986-<br />
1994). A cultural expression, or<br />

the goods and services used as a<br />
vehicle for it, does not necessarily<br />
have to be competitive, nor must<br />
it disappear simply because it is<br />
not. The manifestation of a cultural<br />
expression is closely linked<br />
to the expression of a community<br />
or ethnic group and is therefore<br />
groun<strong>de</strong>d in human rights and<br />
the principle of every society’s<br />
right to sustainable human <strong>de</strong>velopment.<br />
Although it may generate<br />
economic value, a cultural<br />
expression must not be subject to<br />
the laws of the market, as market<br />
logic could seriously jeopardise<br />
the very survival of the diversity<br />
of expressions. Establishing the<br />
dual nature of cultural expressions<br />
was one of the main goals<br />
of the Convention, so as to prevent<br />
future misinterpretations regarding<br />
its application.<br />
Similarly, attention should be<br />
called to the cross-cutting emphasis<br />
placed on solidarity and<br />
coo<strong>per</strong>ation throughout the<br />

Convention’s text. The link between<br />
the promotion of cultural<br />
diversity and international coo<strong>per</strong>ation<br />
is the keystone that<br />
will enable the Convention’s future<br />
application. First, it ensures<br />
broad support for the Convention<br />
from <strong>de</strong>veloping countries, an<br />
overwhelming majority of which<br />
do not have cultural industries<br />
or, where they do have them,<br />
have industries that are not at all<br />
competitive. However, above and<br />
beyond that, it banishes the spectre<br />
of protectionism and of communities<br />
isolating themselves from the<br />
rest of the world. The Convention<br />
aims to be an instrument that will<br />
promote a balanced cultural flow<br />
between all the world’s communities<br />
(as opposed to the current<br />
one-way flow from the main exporters)<br />
and not an excuse to close<br />
one’s bor<strong>de</strong>rs to ‘the other’.<br />
This principle of solidarity and<br />
cultural coo<strong>per</strong>ation is moreover<br />
specified in the creation of the<br />
International Fund for Cultural<br />
Diversity (Art. 18). Despite the<br />
Fund’s commanding name, the<br />
signatory states’ contributions to<br />
it are voluntary. Consequently, it<br />
has an eminently formal nature,<br />
as ratifying the Convention does<br />
not oblige a state to do anything<br />
in economic terms. However, the<br />
very laxity of the Fund’s regulation<br />
paves the way for donations<br />
from non-state bodies, such as UN<br />
organisations and programmes,<br />
public and private bodies and<br />
even non-central governments<br />
such as Catalonia’s (Art. 18.3.c).<br />
Additionally, the Fund may accept<br />
contributions earmarked for<br />
specific projects (Art. 18.5). The<br />
flexible nature of Article 18 is critical<br />
for Catalonia, since, as will<br />
be argued in the conclusions of<br />
this report, it allows the Catalan<br />
Government and Catalan civil<br />
society to play an important role<br />
in the Convention’s implementation<br />
and <strong>de</strong>velopment and, by<br />
extension, in <strong>UNESCO</strong>.<br />

The Catalan Government’s<br />
international relations: legal<br />
basis<br />
2.1. The 2006 Statute of<br />
Autonomy<br />
The Catalan Government’s<br />
key leverage point for engaging<br />
in active <strong>para</strong>diplomacy in the<br />
sphere of culture is the new Catalan<br />
Statute of Autonomy (CSA).<br />
Article 127 of the Statute provi<strong>de</strong>s<br />
that ‘The Catalan Government<br />
has exclusive jurisdiction over<br />
cultural matters. This exclusive<br />
jurisdiction inclu<strong>de</strong>s at all times:<br />
[...] The international projection<br />
of Catalan culture’ (Art. 127 d.<br />
Third, CSA 2006). Additionally,<br />
Title V, Chapter 3 of the Statute,<br />
‘Foreign activities of the Catalan<br />
Government’, lays down the Catalan<br />
Government’s powers with<br />
regard to <strong>para</strong>diplomacy (Art.<br />
193-200, CSA 2006).<br />
Table 1 inclu<strong>de</strong>s Article 198 of the<br />
new Statute, a key component<br />
regulating Catalonia’s presence<br />
in <strong>UNESCO</strong>. This article, ‘Participation<br />
in international bodies’,<br />
provi<strong>de</strong>s that ‘The Catalan Government<br />
shall participate in the<br />
competent international bodies<br />
in matters of special interest<br />
to Catalonia, in particular,<br />
in <strong>UNESCO</strong> and other cultural<br />
bodies, as provi<strong>de</strong>d for un<strong>de</strong>r<br />
the relevant regulations’. According<br />
to Mercè Barceló and<br />
Joan Vintró, professors of constitutional<br />
law at the University<br />
of Barcelona (UB), this statutory<br />
mandate means that ‘the Catalan<br />
Government can participate<br />
[in international bodies] without<br />
the need for authorisation from<br />
the state’ (Barceló and Vintró<br />
2008:583).<br />

Notwithstanding the above, as<br />
can be seen in Table 1, Article<br />
198 has been inclu<strong>de</strong>d in the<br />
complaint of unconstitutionality<br />
filed by the People’s Party (PP) in<br />
October 2006. At first glance, one<br />
might think that were the high<br />
court to find that this article is not<br />
consistent with the Constitution,<br />
the entire Catalan strategy within<br />
<strong>UNESCO</strong> would be quashed.<br />
This pa<strong>per</strong>, however, will argue<br />
against that view by offering three<br />

2.2. Argument 1. Com<strong>para</strong>tive<br />
analysis of the statutes of<br />
autonomy of other autonomous<br />
regions<br />
Unlike their pre<strong>de</strong>cessors, the<br />
statutes of autonomy reformed<br />
during the eighth Spanish parliamentary<br />
term (2004-08) inclu<strong>de</strong><br />
important means of participation<br />
by Spanish regions in European<br />
and international bodies. Table 2<br />
offers an enlightening comparison<br />
of all the statutes reformed in<br />
that term.<br />
As can be seen, the articles of the<br />
statutes of two regions, Catalonia<br />
and Castile-Leon, contain explicit<br />
references to their presence<br />
in <strong>UNESCO</strong>. A comparison of<br />
the wording and the dates they<br />
were passed shows that Castile-<br />
Leon’s statute is a carbon copy of<br />
Catalonia’s. This notwithstanding,<br />
the PP filed a complaint of<br />
unconstitutionality against the<br />
article in the Catalan statute, but<br />
passed it in a region it governs.<br />
A finding by the Constitutional<br />
Court against Art. 198 CSA 2006<br />
that eliminated the Catalan presence<br />
in <strong>UNESCO</strong> would have a<br />
domino effect for other statutes of<br />
autonomy, which, in turn, would<br />
give rise to major contradictions<br />
in Spanish law. If Art. 198 of the<br />
Catalan statute is <strong>de</strong>clared unconstitutional,<br />
it is not clear who<br />
will apply this criterion, nor<br />
when, to Art. 67 of Castile-Leon’s<br />
statute and the other statutes<br />
that, without making explicit reference<br />
to <strong>UNESCO</strong>, adhere to<br />
the same spirit (e.g., Andalusia’s<br />
or Valencia’s).<br />
2.3. Argument 2. Examination<br />
of Constitutional Court doctrine<br />
The second argument against the<br />
notion that a finding against Art.<br />
198 CSA 2006 would <strong>de</strong>legitimise<br />
the Catalan Government’s activities<br />
in <strong>UNESCO</strong> is more powerful.<br />
To wit, Spanish Constitutional<br />
Court case law (specifically, the<br />
<strong>de</strong>cisions STC 153/1989, STC<br />
80/1993 and STC 165/1994) supports<br />
the Catalan Government’s<br />
international activities, including<br />
its participation in bodies such as<br />
<strong>UNESCO</strong>.<br />
Antoni Monreal, a professor of<br />
constitutional law, offers the keys<br />
to un<strong>de</strong>rstanding the evolution of<br />
the Constitutional Court’s thinking<br />
on this issue. According to Monreal,<br />
this evolution has been conditioned<br />
by both legal and political<br />
factors, such as the changing<br />
make-ups of the Spanish Chamber<br />
of Deputies and Catalan Parliament<br />
over the course of their<br />

3. The Catalan Government may request that the Spanish Government sign international treaties in areas falling within the<br />

different parliamentary terms. The<br />
evolution can be divi<strong>de</strong>d into two<br />
distinct phases. In the first phase,<br />
which lasted approximately from<br />
1980 to 1990, the restrictive interpretation<br />
of both the Constitutional<br />
Court and the central government<br />
left very little room for action. The<br />
second, which began with <strong>de</strong>cision<br />
STC 153/1989 FJ 3 and a new<br />
phase of coo<strong>per</strong>ative relations between<br />
the central government and<br />
the Catalan Government, saw a<br />
broa<strong>de</strong>ning of foreign and European<br />
activities. Monreal argues<br />
that this coo<strong>per</strong>ative phase was<br />
largely due to the end of the era<br />
of absolute majorities that marked<br />
the 1980s in both Spain and Catalonia.<br />
However, this phase was put<br />
on hold during the seventh Spanish<br />
parliamentary term (2000-04),<br />
when the PP had an absolute majority<br />
(Monreal 2004:319).<br />

attributed to it, an Autonomous Region must <strong>per</strong>form certain activities not only outsi<strong>de</strong><br />
its own territory, but even outsi<strong>de</strong> the territorial limits of Spain.’<br />

At the core of this explanation is<br />
the i<strong>de</strong>a that the Spanish Constitutional<br />
Court’s doctrine has<br />
evolved since the beginning of<br />
the <strong>de</strong>mocratic transition. Specifically,<br />
since 1989, it can be said<br />
to have taken a less centralist<br />
view and to have shown itself<br />
to be more favourable to the autonomous<br />
regions’ participation<br />
in foreign relations. To this end,<br />
Table 3 shows the most representative<br />
excerpts from the Constitutional<br />
Court’s <strong>de</strong>cisions in<br />
terms of casting off the so-called<br />
‘globalising conception’ of international<br />
relations and paving<br />
the way to foreign activities by<br />
the autonomous regions.<br />

relations <strong>de</strong>fined in this<br />
way are reserved un<strong>de</strong>r the<br />
aforementioned Art. 149.1.3 of<br />
the Spanish Constitution. However,<br />
the <strong>de</strong>cision allows ‘the<br />
possibility of taking measures<br />
that regulate and coordinate<br />
activities entailing a foreign<br />
presence of the autonomous<br />
regions with a view to preventing<br />
or remedying possible<br />
prejudices caused by the direction<br />
and implementation of foreign<br />
policy’ (Barceló and Vintró<br />
2008:574). The aforementioned<br />
Catalonia-Uruguay Coo<strong>per</strong>ation<br />
Agreement and the Work<br />
Plan that implements it are two<br />
clear examples of this.<br />

Thus, pursuant to STC 165/1994 FJ<br />
3, in those cases where the Catalan<br />
Government must act beyond<br />
state bor<strong>de</strong>rs in the execution of<br />
its powers, it may engage in certain<br />
foreign activities (excluding,<br />
of course, the signing and entering<br />
into of international treaties<br />
giving rise to international commitments).<br />
In other words, the<br />
Constitutional Court interprets<br />
foreign activities as a component<br />
of the autonomous regions’ activities<br />
<strong>de</strong>riving from the exercise<br />
of their powers.<br />
As a result of the foregoing, and<br />
returning to Article 198 CSA<br />
2006, even if the Constitutional<br />
Court were to strike all or part of<br />
it down, there are legal grounds<br />
to affirm that the door for Catalan<br />
participation in <strong>UNESCO</strong><br />
would not be closed. It might no<br />
longer be mentioned in the Statute,<br />
but it could be regulated at<br />
other regulatory levels, as will be<br />
seen in the third and final argument.<br />
2.4. Argument 3. Review of the<br />
activities already carried out by<br />
the Catalan Government<br />
In effect, the third and final argument<br />
looks at the activities already<br />
carried out by the Catalan<br />
Government in <strong>UNESCO</strong> since<br />
2004, when the Catalan Government<br />
became a member with full<br />
rights of the Spanish <strong>de</strong>legation to<br />
the international body. 4 The Spanish<br />
state (and, where applicable,<br />

Spain’s autonomous regions) are<br />
represented in <strong>UNESCO</strong> by the<br />
Spanish National Commission for<br />
Coo<strong>per</strong>ation with <strong>UNESCO</strong>. The<br />
purpose of this body is to advise the<br />
central government on issues relating<br />
to <strong>UNESCO</strong> and to maintain<br />
<strong>per</strong>manent institutional contact<br />
with the international organisation.<br />
It should be noted that the Commission<br />
is regulated by royal <strong>de</strong>cree,<br />
a type of law that falls well below<br />
a statute of autonomy in the Spanish<br />
legal hierarchy. At present, the<br />
Commission is governed by Royal<br />
Decree 173/2004, of 30 January.<br />
The Commission was last reformed<br />
at the tail end of the<br />
seventh Spanish parliamentary<br />
term, when the PP governed with<br />
an absolute majority. The reform<br />
was signed into law by then<br />
Minister of the Presi<strong>de</strong>ncy, Javier<br />
Arenas. This modification paved<br />
the way for Catalonia to participate<br />
in the Spanish <strong>de</strong>legation.<br />
The aforementioned Royal Decree<br />
173/2004 provi<strong>de</strong>s that the<br />
Commission shall have three<br />
bodies: a plenary body, an executive<br />
council and a secretariat.<br />
The plenary body approves the<br />
plans and general action gui<strong>de</strong>lines<br />
and is ma<strong>de</strong> up of Spain’s<br />
ambassador and <strong>per</strong>manent <strong>de</strong>legate<br />
to <strong>UNESCO</strong>, representatives<br />
from the different ministries<br />
involved, a representative from<br />
each of the autonomous regions<br />
and individuals acting in their<br />
capacity as ex<strong>per</strong>ts.<br />
The executive council is the Commission<br />
body responsible for<br />
establishing the actual policies<br />
governing Spain’s relations with<br />
<strong>UNESCO</strong>. It is the ‘engine room’<br />
of the Spanish state’s representation<br />
before the international body<br />
and it is the body that attends the<br />
meetings at <strong>UNESCO</strong> headquarters.<br />
It consists of diverse representatives<br />
of the central govern-<br />
ment and two representatives<br />
of the autonomous regions, appointed<br />
for a <strong>per</strong>iod of two years<br />
from among the regional representatives<br />
in the plenary body.<br />
In 2004, Catalonia and Asturias<br />
were chosen to represent<br />
the autonomous regions in the<br />
executive council for a term of<br />
two years. Based on interviews<br />
conducted for this study with the<br />
people involved, the Asturian<br />
<strong>de</strong>legation appears not to have<br />
participated in the <strong>UNESCO</strong>’s<br />
discussion and <strong>de</strong>cision-taking<br />
processes in general or in the<br />
‘<strong>UNESCO</strong> Convention Process’<br />
in particular. In contrast, Catalonia<br />
participated actively in the<br />
Commission and, as established<br />
by the <strong>de</strong>cree, atten<strong>de</strong>d the 33 rd<br />
General Conference of <strong>UNESCO</strong><br />
in October 2005, which approved<br />
the Convention. 5 As noted above,<br />
Catalonia’s formal representation<br />
in the executive council<br />
en<strong>de</strong>d in 2006; however, it has<br />
maintained a <strong>de</strong> facto presence<br />
through the political capacity<br />
and contributions of the Catalan<br />
Government’s <strong>de</strong>legation.<br />
It is worth noting that the Catalan<br />
Government took advantage<br />
of the opportunity provi<strong>de</strong>d by<br />
the <strong>de</strong>cree to engage in <strong>para</strong>diplomacy<br />
in the sphere of culture<br />
in its own right and in a visible<br />
way. The <strong>UNESCO</strong> Convention<br />
Process served as a springboard<br />
to this end. Since the final stretch<br />
of the negotiations leading up<br />
to the Convention, the Catalan<br />
Government has been present<br />
and participated in the process.<br />
The first time was at the third<br />

session of the Intergovernmental<br />
Meeting of Ex<strong>per</strong>ts (Paris, 25 May<br />
– 3 June 2005), where the final<br />
draft convention was <strong>de</strong>bated<br />
and approved. Ever since, the<br />
Catalan Ministry of Culture and<br />
the Media and the Directorate<br />
General of International Relations<br />
(attached to the Vice-Presi<strong>de</strong>ntial<br />
Department) have sent<br />
<strong>de</strong>legations to each of the <strong>de</strong>cision-taking<br />
meetings regarding<br />
the Convention. By contributing<br />
resources and, above all, highly<br />
qualified human capital, the<br />
Catalan Government has been<br />
able to play a distinct and visible<br />
role in the <strong>UNESCO</strong> Convention<br />
Process.<br />
In short, from a technical, legal<br />
and political point of view,<br />
there is nothing preventing the<br />
Catalan Government from continuing<br />
with its current activities<br />
in <strong>UNESCO</strong>.<br />

Paradiplomacy in the sphere<br />
of culture: the foreign branch<br />
of cultural policy (rather than<br />
the cultural branch of foreign<br />
policy)<br />
The term <strong>para</strong>diplomacy can be<br />
<strong>de</strong>fined as the international action,<br />
in<strong>de</strong>pen<strong>de</strong>nt of the ‘metropolitan<br />
state’, of sub-state entities or noncentral<br />
governments in pursuit of<br />
their own specific international<br />
interests (Wolff 2007). Paradiplomacy,<br />
un<strong>de</strong>rstood as the emerging<br />
political capacity of sub-state entities<br />
in general, is relatively new<br />
both as a phenomenon and as a<br />
topic in international relations.<br />
The regions, provinces, Län<strong>de</strong>r<br />
or states of fe<strong>de</strong>rations may have<br />
<strong>para</strong>diplomatic capacity, as may<br />
the autonomous and local entities<br />
of other unitary states. According<br />
to Monreal, in 2005, the different<br />
states of the USA collectively had<br />
more than 200 representative offices.<br />
Paradiplomatic agents are autonomous,<br />
have the capacity to<br />
act and are able to exert different<br />
<strong>de</strong>grees of international influence<br />
in a variety of fields. ‘It is an<br />
activity carried out in the gaps<br />
of the traditional system of international<br />
relations, gaps which,<br />
one might add, may tend to grow<br />
larger as a result of the changes<br />
that traditional relations are currently<br />
un<strong>de</strong>rgoing for a wi<strong>de</strong><br />
range of cultural, economic and<br />
political reasons.’ (Monreal 2005:<br />
290 et seq.)<br />
To <strong>de</strong>fine an ‘international actor’,<br />
<strong>para</strong>meters must be used that go<br />
beyond those traditionally associated<br />
with states (sovereignty,<br />
territory, population and legal<br />
recognition). Likewise, criteria<br />
linked to the political entity’s will<br />
to engage in foreign activities<br />
must be taken into consi<strong>de</strong>ration.<br />

Strictly in the sphere of culture,<br />
<strong>para</strong>diplomacy is foreign institutional<br />
activity related to cultural<br />
policy. From a terminological<br />
point of view, the term <strong>para</strong>diplomacy<br />
in the field of culture is preferable<br />
to cultural <strong>para</strong>diplomacy,<br />
as it wards off possible confusion<br />
with so-called cultural diplomacy.<br />
The latter can be <strong>de</strong>fined as<br />
seemingly informal collaboration<br />
between a state and the individuals<br />
and civil-society institutions<br />
of another country through the<br />
institutional use of culture and the<br />
media used to propagate it with<br />
a view to obtaining political influence.<br />
The goal is to exert influence<br />
abroad in or<strong>de</strong>r to achieve different<br />
objectives: to protect one’s<br />
own values and ways of life;<br />
to break stereotypes; to offer a<br />
positive view of the country and<br />
its people, culture and policy;<br />
to change the policy of foreign<br />
governments; to effect political or<br />
cultural changes in foreign countries;<br />
and to prevent, control and<br />
mitigate conflicts with foreign<br />
adversaries (Bound, Kirsten, et<br />
al. 2007, among others). Paradiplomacy<br />
in the sphere of culture<br />
is thus not a form of soft power inten<strong>de</strong>d<br />
to influence the <strong>per</strong>ception<br />
of a country, but rather aspires to<br />

allowed by their own regulations<br />
or those of the state itself.<br />

In light of this clarification,<br />
<strong>para</strong>diplomacy in the sphere of<br />
culture is an issue of strategic importance<br />
for Catalonia. It is in the<br />
coordination, specialisation and<br />
concentration of human and financial<br />
resources that Catalonia<br />
can play a relatively prominent<br />
role in the medium term with regard<br />
to current efforts to reshape<br />
political, economic and institutional<br />
governance. Paradiplomacy<br />
in the sphere of culture is<br />
yet another facet of the application<br />
of its domestic cultural powers.<br />
As noted above, cultural policy<br />
is increasingly being <strong>de</strong>fined<br />
in international forums. National<br />
governments must <strong>de</strong>ploy their<br />

policy based on the architecture<br />
<strong>de</strong>signed in multilateral agreements.<br />
Thus, if the Catalan Government<br />
wishes to establish a quota for films<br />
dubbed in Catalan in Catalan cinemas,<br />
it must first ensure the viability<br />
of such a step un<strong>de</strong>r the rules<br />
of treaties such as GATS (General<br />
Agreement on Tra<strong>de</strong> in Services,<br />
signed within the framework of the<br />
WTO). This example highlights the<br />
need for the Catalan Government<br />
to broa<strong>de</strong>n the radius of its sectoral<br />
policies (regarding industry, services<br />
and culture). In the sphere of<br />
culture, the goal is not only to take<br />
immediate measures to promote<br />
Catalan cultural expressions; it is<br />
also necessary to go one step further<br />
and predict the coming contexts<br />
now being <strong>de</strong>signed in the<br />
talks for future international regulations.<br />
Consequently, the Catalan Government’s<br />
foreign activities with<br />
regard to cultural matters must<br />
be conducted within the sphere<br />
of its cultural policy, a sphere that<br />
falls fully un<strong>de</strong>r its jurisdiction.<br />
The claim that <strong>para</strong>diplomacy<br />
in the sphere of culture belongs<br />
to the field of international relations,<br />
in the classic sense of the<br />
term, is an un<strong>de</strong>rstanding mired<br />
in the 20 th century.<br />

3. Conclusions<br />
The policies that the Catalan Government<br />
can apply in the sphere of culture are conditioned<br />
(and sometimes even <strong>de</strong>termined)<br />
by agreements adopted by multilateral<br />
bodies. The framework for action is no<br />
longer solely the Spanish state, un<strong>de</strong>rstood<br />
as a mo<strong>de</strong>rn sovereign state. Like all other<br />
states in the world, Spain is in the process<br />
of ceding sovereignty to regional and world<br />
bodies, such as the European Union or the<br />
World Tra<strong>de</strong> Organisation, among others.<br />
This process, sought and executed by states<br />
themselves, is one of the main characteristics<br />
of globalisation and is shifting the centres<br />
of power and <strong>de</strong>cision-taking as they<br />
have been un<strong>de</strong>rstood to date. As a result,<br />
the centrality of the traditional nation state<br />
is being ero<strong>de</strong>d and new processes and<br />
<strong>de</strong>cision-taking logics are emerging in the<br />
global ‘diplomatic market’.<br />
At the same time, most states are also<br />
involved in a process of <strong>de</strong>centralisation.<br />
They are thus complying with the<br />
principle of subsidiarity. According to<br />
this principle, some issues exceed states’<br />
regulatory capacity; as a result, states<br />
ce<strong>de</strong> their sovereignty over them to interstate<br />
coordination bodies. Likewise,<br />
other issues can be resolved at institutional<br />
levels closer to citizens, leading to<br />

a <strong>de</strong>volution of powers to the territorial<br />
units that make up the state.<br />
Consequently, the <strong>de</strong>sign and application<br />
of cultural policy is no longer the sole and<br />
exclusive purview of the traditional nation<br />
state. In or<strong>de</strong>r to exercise its cultural<br />
powers (which are ‘exclusive’, according<br />
to the new Statute), the Catalan Government<br />
will increasingly need to act beyond<br />
its own territory and, even, beyond Spanish<br />
bor<strong>de</strong>rs themselves. If the Catalan<br />
Government does not pursue a strong and<br />
coordinated foreign policy to <strong>de</strong>fend the<br />
interests of Catalan culture, the exclusive<br />
powers provi<strong>de</strong>d for by the Statute will be<br />
no more than a formality.<br />
Therefore, the political action that the Catalan<br />
Government might take in <strong>UNESCO</strong><br />
must not be consi<strong>de</strong>red so much diplomatic<br />
(and, therefore, <strong>de</strong>pending on one’s<br />
<strong>per</strong>spective, as infringing on the powers<br />
of the state in the sphere of international<br />
relations) as cultural (that is, as the exercise<br />
of exclusive powers falling within<br />
the scope of its jurisdiction). That this action<br />
takes place outsi<strong>de</strong> Catalan territory<br />
is not, within the logic of globalisation, an<br />
impediment. In<strong>de</strong>ed, Spanish Constitutional<br />
Court <strong>de</strong>cision STC 165/1994 establishes<br />
this view.<br />

This report argues that <strong>para</strong>diplomatic<br />
activity should be carried out in <strong>UNESCO</strong>,<br />
as political action taken there overlaps<br />
with key areas for Catalonia, such as<br />
cultural policy, international relations<br />
and the country’s institutional presence.<br />
The Catalan Government’s involvement<br />
in the process of approving and applying<br />
the Convention on Cultural Diversity<br />
was the first step towards <strong>de</strong>epening<br />
Catalonia-<strong>UNESCO</strong> relations. In this<br />
view, the Convention on Cultural<br />
Diversity is a strategic political project<br />
for several reasons:<br />

The principles and values enshrined<br />
in the text are fully compatible with the<br />
Catalan Government’s policy: the convention<br />
un<strong>de</strong>rscores the equal dignity<br />
of all cultures and the consi<strong>de</strong>ration of<br />
the diversity of cultural expressions as<br />
an asset to be protected.<br />
It is a multi-actor project (states, regional<br />
integration bodies, multilateral bodies,<br />
sub-state governments and civil society).<br />
Major aspects of the Convention overlap<br />
with some of the Catalan Government’s<br />
key powers and spheres of action (culture,<br />
international cultural coo<strong>per</strong>ation,<br />
<strong>de</strong>velopment coo<strong>per</strong>ation, etc.).<br />
Catalonia can offer highly qualified<br />
human capital with regard to the<br />
‘<strong>UNESCO</strong> Convention Process’.<br />
The Convention creates the Fund for<br />
Cultural Diversity. Catalan financial<br />
involvement in the Fund would entail<br />
the automatic presence of the Catalan<br />
<strong>de</strong>legation at the Convention’s Donor<br />
Conference.<br />
The Catalan Government has ma<strong>de</strong> significant<br />
contributions to the process, both<br />
in terms of logistics and the sponsoring of<br />
official workshops and of know-how and<br />
examples of good practice. This has al-<br />

lowed it to stand in the first <strong>per</strong>son before<br />
<strong>UNESCO</strong> and build a strong case in favour<br />
of any request for formal participation in<br />
the body.<br />
The Convention is a dynamic process<br />
that is only just now beginning. As there<br />
is no relevant legal doctrine or case law,<br />
whether or not it emerges as a critical<br />
document in international law will<br />
largely <strong>de</strong>pend on the theory and best<br />
practice contributed throughout the<br />
process. Now that it has entered into force,<br />
the process to endow it with content and<br />
authority is un<strong>de</strong>rway. Working to ensure<br />
the Convention’s success means not only<br />
working for its principles, values and<br />
plans. Any contribution by the Catalan<br />
Government that noticeably improved<br />
the Convention’s chances of success<br />
would be a true opportunity to gain heft<br />
and influence in the international sphere,<br />
in particular, in the field of culture.<br />
In short, whilst the first <strong>de</strong>ca<strong>de</strong> of<br />
<strong>de</strong>mocracy allowed Catalan civil society<br />
to weave a network of international<br />
relations in which Unescocat served as<br />
the natural liaison between Catalonia<br />
and <strong>UNESCO</strong>, current conditions make it<br />
possible to go one step further. In addition to<br />
maintaining and strengthening this means<br />
of cultural foreign activity, the Catalan<br />
presence in the international sphere of<br />
culture can now be ‘institutionalised’.<br />
Thus, the Catalan Government can use<br />
the tools at its disposal to firmly establish<br />
a <strong>para</strong>diplomatic policy in the sphere<br />
of <strong>UNESCO</strong>. Moreover, <strong>para</strong>diplomatic<br />
activity in the sphere of culture by the<br />
Catalan Government is no longer a luxury<br />
or a visionary proposal; rather, it must be<br />
un<strong>de</strong>rstood as the mere implementation<br />
of its powers, which, when exercised, may<br />
partially play out beyond the bor<strong>de</strong>rs of<br />
the Spanish state.<br />

In this <strong>para</strong>digm shift, Catalonia has a<br />
certain ‘psychological edge’ on other<br />
countries that ex<strong>per</strong>ienced a more comfortable<br />
20 th century from the viewpoint of<br />
national sovereignty. The fall of the Berlin<br />
wall, digitalisation and new migratory<br />
flows mark the end of an or<strong>de</strong>r that these<br />
other states had achieved and which<br />
seemed final. In this context, it is no coinci<strong>de</strong>nce<br />
that countries such as Denmark,<br />
Swe<strong>de</strong>n, Ireland or Holland voted ‘no’<br />

on successive referendums on European<br />
integration. In most cases, this rejection<br />
was due not to anti-European sentiments,<br />
but rather feelings of uncertainty<br />
and even fear. The relative weakness of<br />
some communities, such as Catalonia, in<br />
the 20 th century may yet emerge, at the<br />
start of the 21 st century, as a strength that<br />
will allow them to better tackle the uncertainties<br />
of a hitherto uncharted process of<br />
globalisation.<br />

4. Proposals<br />
General proposals:<br />
Unity and durability<br />
Paradiplomacy in the sphere of culture requires<br />
unity and durability to generate<br />
results in the medium-to-long term. To<br />
this end, it calls for a cross-cutting political<br />
agreement by Catalan political parties<br />
not to use it for electoral gain.<br />
1. Ministry of Foreign Action: The<br />
Catalan Government must <strong>de</strong>termine<br />
which type of <strong>para</strong>diplomacy<br />
in the sphere of culture is most advisable.<br />
One option would be to create<br />
a Catalan Ministry (Conselleria)<br />
of Foreign Activity with a view to<br />
endowing cultural <strong>para</strong>diplomacy<br />
with visibility and autonomy. However,<br />
from a pragmatic point of view,<br />
a commission attached to the Presi<strong>de</strong>ntial<br />
or Vice-Presi<strong>de</strong>ntial Office<br />
could work in a cross-cutting manner<br />
and coordinate the different ministries<br />
and <strong>de</strong>partments involved.<br />
The second option would have fewer<br />
re<strong>per</strong>cussions in the media than<br />
a ministry, but would enable more<br />
tangible progress.<br />

2. Funding: In a complementary vein,<br />
<strong>para</strong>diplomacy in the sphere of culture<br />
requires a<strong>de</strong>quate and guaranteed<br />
multi-year funding.<br />
3. Training: Paradiplomacy in the sphere<br />
of culture is a founding policy. Consequently,<br />
the training of technical<br />
managers and senior officials in its<br />
<strong>de</strong>finition and application is critical.<br />
In short, it consists of interdisciplinary<br />
political action spanning such diverse<br />
spheres as international relations,<br />
cultural policy, <strong>de</strong>velopment coop-<br />
eration, sustainability policy and international<br />
tra<strong>de</strong>, among others<br />
4. Applied research and the exchange<br />
of information: Applied research<br />
and the exchange of best practice<br />
with other governments and bodies<br />
is an appropriate tool to keep Catalonia’s<br />
foreign cultural activity policy<br />
up to date.<br />
5. International coo<strong>per</strong>ation: Paradiplomacy<br />
in the sphere of culture must<br />
be closely linked to international coo<strong>per</strong>ation.<br />
In<strong>de</strong>ed, international cultural<br />
coo<strong>per</strong>ation should be used as a<br />
means for <strong>para</strong>diplomatic action.<br />

6. Follow-up assessment: Paradiplomacy<br />
in the sphere of culture must<br />
inclu<strong>de</strong> assessment and political<br />
oversight mechanisms.<br />
Specific proposals:<br />
<strong>UNESCO</strong>–Catalonia agreement<br />
This agreement should be based on the<br />
bilateral agreement signed between<br />
Flan<strong>de</strong>rs and <strong>UNESCO</strong>, establishing<br />
the Flemish contribution to a trust fund<br />
with projects <strong>de</strong>signed and carried out<br />
by Flan<strong>de</strong>rs. Although the agreement<br />
is governed by a mixed <strong>UNESCO</strong>-Flan<strong>de</strong>rs<br />
committee, the Flemish people<br />
choose the ex<strong>per</strong>ts to carry out the programmes,<br />
with a view to ensuring that<br />
the region’s economic contribution also<br />
serves to train lea<strong>de</strong>rs.<br />
1. Fund for Cultural Diversity: As an<br />
initial step towards achieving a general<br />
Catalan trust fund in <strong>UNESCO</strong>,<br />
the Catalan Government should<br />
participate actively in the Fund for<br />
Cultural Diversity specially created<br />
by the Convention. This fund does<br />
not require signatory states of the<br />
treaty to make contributions and it<br />
is moreover open to participation<br />
by different types of entities, including<br />
non-central governments As few<br />

date, contributing to the fund is the<br />
best way for Catalonia to play an important<br />
role in the Convention’s implementation.<br />
Hence, among other<br />
reasons, the importance of linking<br />
<strong>para</strong>diplomacy in the sphere of culture<br />
to international coo<strong>per</strong>ation.<br />
2. Legal guarantee of the Catalan<br />
presence in <strong>UNESCO</strong>: With regard<br />
to the Catalan Government’s formal<br />
participation in <strong>UNESCO</strong>’s <strong>de</strong>cisiontaking<br />
bodies, and irrespective of<br />
the Constitutional Court’s <strong>de</strong>cision<br />
regarding the Statute, a new law should<br />
be passed to guarantee Catalonia’s<br />
presence as an automatic member<br />
of the plenary body and executive<br />
council of the Spanish Commission for<br />
Coo<strong>per</strong>ation with <strong>UNESCO</strong>.<br />
3. Civil society: In the domestic sphere,<br />
a body or association should be set<br />
up that encompasses all stakehol<strong>de</strong>rs<br />
(institutions, civil society, industry,<br />
aca<strong>de</strong>mia, etc.) and serves as a wellspring<br />
of i<strong>de</strong>as and projects for the Catalan<br />
Government. Moreover, it would<br />
be advisable for this body to be the<br />
Catalan Coalition on Cultural Diversity,<br />
which is a member of the international<br />
network. The plan to engage in<br />
cultural <strong>para</strong>diplomacy would therefore<br />
be not only political but civic.<br />
