" Ellas tienen por objeto permitir a las personas de pocos recursos, la adquisición y conservación de un inmueble, que habrá de permanecer en la familia, a pesar del fallecimiento del adquirente o de su cónyuge. De este modo se fortalecen los vínculos de la sangre y la pequeña propiedad, hase de nuestra organización civil. Las leyes N" 9.677 Y 10.284 han contribuido a remediar en parte, las situaciones que se contemplaron al dictarlas; pero el proyecto aludido es más completo y reune las ventajas de aislar el problema, de otros que se le agregan sin necesidad; de suprimir la exigencia del domicilio obligatorio sobre la finca; de fijar un límite, que la Comisión ha reducido prudentemente a 50.000 pesos; de establecer la intervención judicial; de permitir la reserva, aun sobre bienes hipotecados y de prever el caso de quien, formando parte de una familia, desea constituir la propia. La inscripción deberá limitarse a una sola propiedad. previa orden judicial dictada con conocimiento de causa. No podrá alterarse el destino de la cosa, ni venderla, pormutarla o gravarla, salvo que mediare la anuencia de todos los interesados. La inembargabilidad se refiere a las obligaciones posteriores a la inscripción y comprende los frutos en un 1'\('senta por ciento. Tampoco podrá ser invocado el beneficio contra la acción reinvindicatoria, o las que tuviesen origen en créditos derivados de trabajos o materiales por mejoras en el inmueble, o las provenientes de impuestos fiscales, de cuotas impagas a favor de los herederos condóminos. Cesa por expropiación, a pedido del constituyente o de la mayoría de Jos herederos¡ por la venta autorizada, o cuando las mejoras introducidas hubieren duplicado el valor establecido en el Registro.

En este capítulo se han incluido algunas reglas que en el Anteproyecto figuran dentro del título correspondiente a los actos jur-ídicos. Son las que atañen a la manera de transmitir la decía ración de voluntad, y que por tal motivo tienen aquí su lugar adecuado. CAPITULO 11 Del error Al tratar esta difícil materia, la Comisión ha procurado descartar en lo posible las sutilezas que resultan del sistema que inspira a nuestro Código, si bien no se ha creído prudente alterarlo en forma fundamental.
