TITULO PRELIMINAR De acuerdo con el Anteproyecto de Bibiloni, se amplía el término que establece el Código Civil para que las leyes tengan fuerza obligatoria, a fin de no distinguir entre la Capital y las provincias. Se ha modificado la fórmula actual en lo referente a retroactividad de las leyes, en el sentido que expresa el artículo pertinente del código brasileño -más claro y comprensivo- pero suprimiendo la terminología de "derechos adquiridos", que hoy se juzga peligrosa, para reemplazarla con preceptos concretos que figuran dentro del título complementario. La Comisión considera inútil el agregado últimamente propuesto por Bibiloni al arto ;) del Código Civil, dado que ni siquiera las leyes de orden público pueden atentar contra los derechos garantizados en la Constitución Nacional. , Las reglas concernientes a la capacidad de hecho y de derecho aparecen reunidas en un solo artículo, suprimiendo conforme al Anteproyecto y por las razones que indica la respectiva nota, el art. 8 del Código actual. Elart. 13 ha sido también eliminado. La ley extranjera -cuando su aplicación está autorizada por la nuestra- no ·es un mero hecho aducido en juicio, cuya prueba incumba al litigante, sino una norma jurídica, a la cual deben ajustarse los tribunales. Esta es también la tendencia moderna, tanto en la doctrina como en la legislación.
TíTULO PRELIMINAR El arto 16 aparece redactado en forma que puedan tener cabida dentro de sus términos, los criterios y métodos actuales de interpretación. Se condensan los preceptos sobre la manera de computar los intervalos en el derecho, sin alterar substancialmente su contenido.
