2.3 Institutional Responsibilities for <strong>Environmental</strong> Management<br />

lnstitutional responsibilities for environmental management rests with the Joint<br />

Stock Ownership Company of the <strong>Krasnodar</strong> <strong>GRES</strong>. This company is responsible<br />

@ to the Russian Federation, and duly authorized agencies of the Russian Federation,<br />

for operating and managing the plant in an environmentally sound manner, and for<br />

providing a safe and healthful workplace for the power plant employees. They are<br />

also responsible for responding to and mitigating environmental incidents and<br />

emergencies. A description of their structure, management practices, and<br />

capabilities is found in Chapter 10.<br />

Legal oversight and enforcement of Russian Federation requirements rests with<br />

KREC, MEPNR, the Ministry of Fuels and Energy, the State Committee on Sanitary<br />

and Epidemiological Control, and other federal, regional, and local government<br />

entities.<br />

2.3.1 Legal Oversight and Enforcement of <strong>Environmental</strong> Regulations<br />

Enforcement of Russian Federation environmental and health legislation is based<br />

on a system of measures for management, control, and damage assessment. A<br />

hierarchical system of punitive and compensatory civil fines and criminal<br />

prosecutions, adjudicated through the Russian court system, is the focus, and<br />

forms the basis for governmental enforcement of environmental, and health and<br />

safety laws and regulations. Russian citizens also have the right to bring actions<br />

in tort, and seek compensatory damages, against individuals, institutions,<br />

@ organizations or enterprises for violations of environmental, and health and safety<br />
