Daar word allerweë aanvaar dat
biotegnologie en die genetiese
manipulering van gewasse die
sleutel gaan wees om die mensdom oor
die volgende dekades te kan voed. Sowat
9.1 biljoen mense sal teen 2050 moet kan
eet en net dié tegnologie sal die wa deur
die drif kan trek, meen kenners.
‘n Mens het simpatie met onkundige
verbruikers wat grootoog en onseker na
luidrugtige (en dikwels oningeligte)
kapsie makers luister, wat biotegnologie na
iets laat klink wat ‘n sluwe Frankenstein in
‘n laboratorium kon bedink het. Daar is
wel ‘n laboratorium betrokke, maar daar
is niks van sinister-beligte proefbuise wat in
donker vertrekke weggesteek word nie.
Eintlik is dit doodgewone biologie.
Dit rym selfs met wat juffrou Bester in
graad 10 vir ons oor die voortplantingsdinge
van die denneboom vertel het.

geskryf. Ons vergeet so maklik van die krag
van God se verbond. So maklik raak ons in

Hoe hervorm mens grond?
Met die ANC se beleidskonferensie
om die draai, styg die politieke
temperatuur feitlik weekliks. ‘n
Gewilde maar hoogs emosionele en
kontroversiële onderwerp blyk die
grondhervormingsdebat te wees. Die
begrip “grondhervorming” is in elk
geval, soos mens in Engels sou sê, ‘n
“misnomer”. Hoe kan mens grond
“hervorm”? Dit is wel moontlik om
die wette en reëls oor die besit en
gebruik daarvan te hervorm, maar
die grond self? Ag toggie, néé!
Eweneens moet landbouers hardop
en duidelik néé sê vir ondeurdagte
of selfs kwaadwillige voorstelle wat
dikwels hieromtrent gedoen word –
voorstelle wat waarskynlik vir
populêre steunwerwing gedoen word, veral
as daar van onteiening sonder vergoeding
gepraat word. Laasgenoemde is nog ‘n
“misnomer”: in ons regstaat impliseer
onteiening die betaling van billike vergoe–
ding. Dit sal die “hervorming” van Suid-Afrika
se Grondwet sowel as dié van sekondêre
wetgewing vereis om gevolg te gee aan
ekstremistiese standpunte oor grondverdeling
sonder vergoeding. Hoewel sodanige
radikale standpunte nie deur hoofstroom
politici gelug word nie, is dit tog kommerwekkend
dat sommige politici toegelaat word
om dit te propageer. Om hierdie rede moet
Agri SA en andere in die burgerlike samele–
wing meer as ooit tevore nou aan die
gronddebat deelneem
en met beginselvastheid
en konstruktiewe
voorstelle die hande
van verantwoordelike
politici te sterk om
Suid-Afrika op ‘n
volhoubare groeipad
te hou.

enersyds te verduidelik
hoekom daar onbevredigend gevorder is met
die regerende party se beleidsopdragte oor
“grondhervorming” en andersyds voorstelle te

word. Met vanjaar se opening van die

Eiendomsreg uitgedaag
parlement het president Zuma die hoë koste
van grondverkryging voor die deur van die
“gewillige koper, gewillige verkoper”-
benadering gelê. Hy het boere ook onlangs
daarvan beskuldig dat hulle toelaat dat
plase, wat onder die restitusieprogram
aangekoop is, verval voordat dit aan
begunstigdes oorgedra is. Hy het dit as ‘n
rede aangevoer vir die hoë persentasie
mislukkings op restitusieplase asook vir die
noodsaak van ‘n herkapitaliseringsprogram.
Agri SA het reeds hierop gereageer deur dit
duidelik te stel dat die restitusieprogram
deurspek is met talle administratiewe falings
wat dit aangewese vir die regering maak om
hieroor hand-in-eie-boesem te steek eerder
as om die boeregem-
eenskap as sondebok
te wil uitsonder. Tog is
dit betekenisvol dat
minister Nkwinti se
Groenskrif oor
Grondhervorming
geen melding maak
van onteiening sonder
vergoeding, of die
skrapping van die
“gewillige koper,
gewillige verkoper”benadering,
of van
gebreke met die
beleidsbedeling
rondom die restitusieprogram nie.
Nogtans moet daar nou uitsluitsel oor die
“gewillige koper, gewillige verkoper”-debat
verkry word. Dit bly Agri SA se standpunt dat
die Grondwet ‘n goeie basis vir redelikheid
en billikheid daarstel vir vergoeding in
gevalle waar die staat die verpligting het om
bates aan te koop vir openbare doeleindes of
in openbare belang. Die korrekte toepassing
van die “gewillige koper, gewillige verkoper”benadering
is ons insiens die wyse waarop
hieraan gevolg gegee kan word, en ingeligte
persone stem hiermee saam. ‘n Werkgroep
oor die voorgestelde waardeerder-generaal,
soos voorgestel in die Groenskrif, gee
aandag aan hoe deursigtigheid en beter etiek
met grondaankope verseker kan word. Die
rede hiervoor is voor-die-hand-liggend:
volgens die Onteieningswet is die “gewillige
koper, gewillige verkoper”-benadering ‘n
objektiewe maatstaf om die prys van grond of
ander bates met behulp van vergelykende
marktransaksies te bepaal. In die populêre
politiek word hierdie benadering verkeerd
verstaan as sou grondeienaars pryse kan
dikteer. Hopelik sal rede seëvier met die
afsluiting van hierdie debat.
Oor verskeie ander voorstelle in die
Groen skrif is daar ‘n wisselende mate van
vordering gemaak, maar te min om dit as ‘n
afgeronde pakket van beleidvoorstelle na die
ANC se beleidskonferensie te neem.
Die vraag is dus, wat kan minister Nkwinti
aan dié konferensie voorhou wat wye steun
kan geniet?
Een van die aspekte wat moontlik op
daardie vlak gedebatteer kan word is
grond plafonne – anders gestel: beperkings
op plaasgroottes per individu. Dit kan een
van die redes wees waarom mnr. Gwede
Mantashe, Sekretaris-generaal van die ANC
onlangs met ‘n groep boere wat groot
grond besitters is, ‘n gesprek oor grondaangeleenthede
gevoer het. Hierdie aspek is

How do you reform land?
With the ANC’s policy conference
around the corner, the political
temperature rises weekly. A
popular, yet highly emotional and
controversial topic seems to be the
land reform debate. The concept
“land reform” is in any case a
misnomer. How can you “reform”
land? It is possible to reform the
legislation and rules regarding the
ownership and usage of land, but
the land itself? No, really!
Likewise, farmers must loud and clear
say nó for the ill-considered or even
malicious proposals that are often
made in this regard – proposals that
are probably made for popular
support canvassing, especially if expropriation
without compensation is mooted as a
possibility. The latter is yet another misnomer:
in our constitutional state expropriation implies
the payment of fair compensation. It would
require “reform” of the South African Constitution
as well as secondary legislation to give
effect to extreme views such as land distribution
without compensation. Although such
radical viewpoints are not mentioned by
mainstream politicians, it is still concerning that
some politicians are allowed to propagate this.
For this reason Agri SA and others in civil
society must now take part in the land debate
more than ever before and must, with sound
arguments and constructive proposals,
strengthen the hands of responsible politicians
to keep South Africa on a sustainable growth
path.
The land debate
Minister Gugile Nkwinti faces the challenge
to, on the one hand, explain why progress
with the ruling party’s policy directives on land
reform was unsatisfactory and, on the other
hand, make proposals about how the
situation could be rectified. With the
parliamentary opening this year, President
Zuma placed the blame for the high costs of

land acquisition on the “willing buyer, willing
seller” approach. He also recently accused
farmers of allowing farms that have been
bought under the restitution programme to
become dilapidated before they are
transferred to beneficiaries. He cited this as
reason for the high percentage of failure on
restitution farms, as well as for the necessity
for a recapitalisation programme. Agri SA
already responded to this by making it clear
that serious flaws with the execution of the
restitution programme require from
government to assess and rectify its own
failures rather than blaming the farming
community. Still, it is significant that Minister
Nkwinti’s Green Paper on Land Reform makes
no mention of expropriation without
compensation, or of the scrapping of the
“willing buyer, willing seller” approach, or the
need to address policy failures of the
restitution programme.
But it is imperative that the debate around
the “willing buyer, willing seller” approach
must now be concluded. It always was
Agri SA’s view that the Constitution provides a
sound basis for reasonableness and fairness
with respect to compensation in cases where
the state is obliged to procure assets for
public purposes or in public interest. The
correct application of the “willing buyer,
willing seller” concept is, in our view, the best
way to give effect to this – and informed
people tend to agree. A working group on the
proposed Valuator-General, as proposed in
the Green Paper, is considering measures by
which transparency and ethical behaviour with
land acquisition can be ensured. The reason
for this is obvious: according to the
Expropriation Act the “willing buyer, willing
seller” approach is an objective measure for
determining the price of land or other assets,
by making use of comparative market transactions.
In the popular politics this approach is
incorrectly understood as if land owners can
dictate prices higher than what could be

to the private sector.
Hopefully, reason will
prevail with the closing of this debate.
Varying progress has been made with other
proposals in the Green Paper, but too little to
take it as a complete package of policy
proposals to the ANC’s Policy Conference.
The question, therefore, remains – what can
Minister Nkwinti offer this conference that
enjoys wide support?
One of the aspects that could possibly be
debated at that level is land ceilings – in other
words: limitations on the size of farms per
individual. This could be one of the reasons
why Mr Gwede Mantashe, Secretary-General
of the ANC, recently had a discussion on land
matters with a group of farmers who are
size able land owners. This aspect has also
already been debated in a working group of
the Green Paper’s National Reference Group.
It is one of the issues about which deep
philosophical differences exist, which can have
catastrophic results for food production and
economic development if not handled
correctly.
The structuring of the land debate in itself is
problematic. On the one hand, Minister
Nkwinti consults about land matters by means
of the National Reference Group he had
established. A wide group of organisations
take part in this on the grounds of mandates
they obtain from their support bases.
This includes Agri SA. At the same time Mr
Mantashe, on behalf of the ruling party, now
started with a parallel process by consulting

Monsanto het vanjaar nege Centre of Excellence-inligtingsdae in
die verskillende mielieverbouingstreke aangebied. Een van die
dae is aangebied op die plaas van Jurgens Fourie, Sardiensvlei,
naby Bothaville.
Die Centre of Excellence-konsep beteken dat die Monsantolandboukundige
in daardie bepaalde gebied saam met ‘n produsent
verskeie proewe onder normale kommersiële toestande uitvoer.
Daar word onder meer gekyk na die optimale plantestand vir sekere
basters, plantdiepte, opkoms, opbrengs en bemesting. Verskillende
onkruidbeheerprogramme waarin verskillende onkruiddoders in
kombinasie met Roundup PowerMax gebruik word, word ook getoets om
te sien hoe die beste onkruidbeheer in daardie omgewing verkry kan
word.
Die resultate word dan op die inligtingsdae met die produsente van
die omgewing gedeel. Vanjaar het sowat 200 produsente die
Sardiensvlei-inligtingsdag bygewoon, waar daar benewens die proewe,
ook aandag gegee is aan die plant van toevlugareas en nuwe basters in

absa launched the AgriGrow Card,
for farmers to use when buying
supplies, thus providing merchants
and input suppliers with a convenient way
to accept payment. The AgriGrow card is
the farmers’ electronic wallet with unique
payment functionalities, Absa says.
The card was piloted last year with the
agriculture co-op, Boeremake laars
Koöperatief Beperk (BKB), as a strategic
partner, and was presented to farmers at
this year’s Nampo Harvest Day. It is a
payment solution that will assist farmers in
financial manage ment and will help to
avoid overspending, Absa says.
Explaining how this will work, Absa
Agribusiness head Ernst Janovsky says
that farmers will approach selected and
accredited co-operative stores and
agribusinesses to purchase inputs such as
seed, fertiliser, fuel and chemicals in
future.
A farmer’s account will then be
debited and the merchant account will be
credited.

electricity audit
Due to increased tariffs and the state’s significant focus on energy efficiency
practices, Eskom plans the intensification of its demand-side management
(DSM) initiatives in the country over the near term. In order to increase the
effectiveness of the DSM programmes, Eskom has commissioned the company,
Frost & Sullivan, to assist in identifying what equipment is currently in use across
a number of business sectors. The energy audit is crucial to the ongoing
implementation of incentives that may benefit sectors such as agriculture,
Eskom says. Key equipment categories include fans, pumps, variable speed
drivers, heat pumps, compressors, lighting, motors, heating, ventilation, air
conditioning and geysers. The aim of the study is to map the unit quantity, as
well as the percentage of total electricity usage for each of these product
categories. Eskom, with the assistance of Frost & Sullivan, will conduct these

community. Today, just twelve months later, a multi-million rand
enterprise development initiative from AfriSam will see these women’s dream of
having a good income from sustainable farming come true. This innovative
project is aimed at providing sustainable economic development and
diversification in the communities where AfriSam operates, and forms part of
AfriSam’s investment in community enterprise development under the mantle of
their social and labour plan.
AfriSam is working together with social enterprise Food & Trees for Africa
(FTFA) to develop this commercially viable organic farming community project.

at Source Handmade Foods
celebrated ten years of operations
since its founding in January 2002
by hosting a dinner for key stakeholders on
Koelfontein farm, Prince Alfred’s Hamlet on
Friday 25 May 2012. Guest speaker,
Western Cape minister of agriculture and
tural development Gerrit van Rensburg, also
earlier that day officially opened the first
major expansion of the company’s facilities
since 2004. The company has come a long
way since its humble beginnings in 2002.
That was also the year that fifth-generation
fruit farmer Frans Conradie handed the reins
of the family’s successful farming business,
Koelfontein farm, to his son Handri. At the
time, the farm was already renowned for its
quality deciduous fruit and Frans had just

is ‘n wêreldwye voorloper in die
vervaardiging van trekkers en is die
moedermaatskappy van Massey, Challanger,
Fendt en Valtra. Die maatskappy gaan
eersdaags ’n kantoor in Kaapstad vestig wat
hom op diens en ondersteuning aan
Afrika-markte gaan toespits.
‘n Verdere uitbreiding is ‘n onderdelepakhuis
wat onlangs naby die OR Tambolughawe
geopen is. Van hier beoog AGCO
om saam met sy verspreidingsvennote,
Barloworld en Valtrac, beter diens aan lande
in Afrika te lewer. ‘n Groot verskeidenheid
van sowat 40 000 verskillende onderdele
sal hier geberg word om dienslewering aan
Afrika te bespoedig.
AGCO beplan ook om in die nabye
toekoms ‘n landbou-opleidingsentrum op
die been te bring. Die sentrum sal kursusse
in basiese landbouopleiding bied, sowel as
gevorderde kursusse in dieselwerktuigkunde.
Wynn Dedwith, besturende direkteur van
Valtrac Suid-Afrika, het tydens die
oorhandiging daarop gewys dat die firma
reeds sedert 1994 ‘n pad met Weiveldlandbouskool
stap en beplan om dié goeie
verhouding in die toekoms uit te bou. “Die
leerders is die boere van die toekoms. Dit is
noodsaaklik om hulle op die hoogte van nuwe
tegnologie te hou. Ons hoop dat goed

August 2011. In view of the importance to effectively combat stock theft, a bill to repeal and substitute the Stock
Theft Act, 1959, the Movement of Animals and Animal Produce Bill, 2012, has been drafted. Once finalised,
this bill will replace the Stock Theft Act as it is known today.

comprehensive and holistic strategy (the
National Rural Safety Strategy) be formulated
to support the creation of a safe rural
environment and ensure food security. Agri
SA believes that the Draft Movement of
Animal and Animal Produce Bill, when it is
enacted, can play an important role to
combat stock theft and to promote the aims
of the national strategy with regard to the
prevention of stock theft.
Among various challenges that South
African farmers face, stock theft is still one of
the biggest. While it is a priority crime in
most provinces, it is much more serious in
regions that are bordering other countries. To
deal with the
stock theft
problem, the
Red Meat
Producers’
Organisation,
an affiliate of
Agri SA,
established the
National Stock
Theft Forum,
which includes
various
role-players in
agriculture as
well as various
departments.
Agri SA is
represented in
the forum. At its recent meeting the Forum
established a working group to evaluate and
compile comment on the draft bill. After
consulting its nine provincial organisations,
Agri SA provided a copy of the comment to
the SAPS in support of the National Stock
Theft Forum.

Mineral rights: Agri SA
to decide on way forward

The Appeal Court recently gave judgment in the case on the
expropriation of mineral rights. Some members of Agri SA had possibly
already read the reports in the media. The court decided that the
Minerals and Petroleum Resources Act had not resulted in the overall
expropriation of mineral rights. It was a unanimous decision of all five
judges presiding. Judge Wallis wrote the judgment.
The state, in the person of the
minister of minerals and energy,
noted an appeal against the
findings of Judge Ben du Plessis in
April 2011 that the act did result in
the expropriation of mineral rights. The
Appeal Court, in the person of Judge Wallis,
in a judgment consisting of 87 pages, did an
analysis of the history of mineral rights in
South Africa since 1871. The judges felt that
there were three important questions in this
case that had to be answered:
• What constituted an expropriation in terms
of section 25(2) of the Constitution?
• What was the nature of the rights that
holders of mineral rights had before the
Development of Minerals and Petroleum
Resources Act came into effect?
• Were those rights expropriated in terms of
the act?
The court especially focused on the second
question, namely what the true nature of the
rights was, which Agri SA claimed were taken
away without compensation. Agri SA’s
advocates argued that those mineral rights
pertained to the common law, and were
initially part of the bundle of ownership rights
of the land.
The court also dealt with the difference
between a deprivation and an expropriation,
but found that Agri SA did not claim that this
was an arbitrary deprivation of rights, but

rather an expropriation and that they
therefore did not have to decide on the
question of whether this could possibly have
been an arbitrary deprivation.
Regarding the question of whether any
rights had been deprived, the court found
that the old-order rights had been completely
erased by the Development of Minerals and
Petroleum Resources Act and that no rights
had been transferred to the state. The state
does, however, have the powers to allocate
similar statutory rights to third parties to mine.
Agri SA argued that the rights that the state
had obtained were in essence the same rights
that were taken away from mineral right
holders.

Die aandryfeenheid van ‘n
spilpunt bestaan uit ‘n sentraalgemonteerdemotorratkaseenheid
wat met twee aftakasse
na twee wielratkaste aan
weerskant, aandryf. Wanneer die ratkaste
loop, bou daar hitte op. Die gevolglike
uitsetting wat dit veroor saak word deur die
uitsettingskamer aan die bokant van die
ratkas geabsorbeer. ‘n Diafragma in die
uitsettingskamer skei die inhoud van die
ratkas met die atmosfeer en neem dus die
uitsetting en inkrimping op.
Vir die diafragma om vrylik te kan beweeg,
is daar ‘n klein luggaatjie na die atmosfeer op
die uitsettingskamer. Dit is van die uiterste
belang dat hierdie gaatjie altyd oop moet
wees. Indien dit deur modder verstop raak,
bou druk in die ratkas op en kan die olie
verby die seëls druk of selfs die seëls uitdruk.
As die ratkas afkoel, trek dit water in die
ratkas in. As die proses herhaal word, bou die
water onder in die ratkas op terwyl die
olie vlak daal. Dit is dus logies dat die
ratkaslaers dit nie sal oorleef nie en vroeë
ratkasbrekasie is dus die gevolg.
Die gereelde visuele nagaan vir tekens van
olielekke op die ratkaste en die nagaan van
die luggaatjies op die uitsettingskamers is dus
van die uiterste belang.
Dryfas-koppels waarmee die ratkasasse
aanmekaar gekoppel word, is deesdae redelik
gestandaardiseerd omdat die konsep
eenvoudig die beste werk. Dit bestaan uit vier
aluminiumarmpies wat só gevorm is dat dit ‘n
rubberagtige insetsel omvou. Die rubber dien
as bewegingspunt en skokabsorbeerder.
Indien hierdie koppels verwaarloos word en
toegelaat word om abnormaal te slyt voordat
dit vervang word, kan die koppelstuk breek

In its commentary on the department of water affairs’ approved water tariffs for the 2012/2013 financial year,
Agri SA said the newly released water tariff dispensation contained various positive aspects, amongst others
the fact that it had not applied the maximum allowable increases. However, the organisation believes that the
pricing strategy should be revised as soon as possible to bring about greater transparency in this regard.
According to Agri
SA’s analyses, the
water infrastructure
costs at some
government water
schemes have increased by as
much as 20%. In cases where
the operation and maintenance
costs are not yet fully recovered,
these costs could have –
according to an agreement with the
department – increased by as much as 50%
per annum. “In such cases Agri SA’s
negotiations with the department have
resulted in a significant advantage of as
much as 30%. Although water resourcemanagement
costs in some of the 19
catchment management areas have
increased significantly in percentage terms,
the actual extent of these costs is in most
cases nominal,” said Agri SA president
Johannes Möller.
“In those cases where the water
infrastructure costs have already been fully
recovered, increases of up to 20% are,
however, excessive and not in line with the
annual inflation rate,” Möller noted.
“Agriculture is exposed and susceptible to
administrative prices, such as water and
electricity tariffs, which threaten the economic
viability of the industry. These are costs that
cannot be passed on directly to the value
chain. Sustainable production and food
security are seriously undermined in the
process,” added Möller.
Möller said that, in terms of legislation,
the department is supposed to review the
pricing strategy every five years. The strategy
was last reviewed in 2005 and was effectively

notional concept of how transactions in a
market-related economy should take place.
“Any deviation from this can, therefore, not
be regarded as an integral characteristic of

This, as per the Constitution, would boil
down to deprivation or even expropriation
and should be subjected to fair and
equitable compensation, which currently can
only be equated to market values despite
relevance of such an approach for their
countries. Nduati Kariuki from the Kenya
National Federation of Agricultural
Producers said that African governments,
multi-lateral institutions and donors should
recognise the aspiration of African farmers
to become successful large-scale
commercial producers. “The focus should,
therefore, shift from sustaining a small-scale
producer dispensation towards empowering
farmers to become effective participants in
the commercial food value chain,” he said.
