On 18.3.2010, eleven months before ong>theong> expiry ong>ofong> ong>theong> temporary planning permission No. A/TY/102 on 22.2.2011, ong>theong> applicant submitted an application for renewal ong>ofong> ong>theong> temporary planning permission for a furong>theong>r three years (Application No. A/TY/110); (f) on 7.5.2010, ong>theong> MPC considered ong>theong> application for renewal ong>ofong> ong>theong> temporary permission. Taking into account that ong>theong> application was submitted almost one year before ong>theong> expiry ong>ofong> ong>theong> original planning permission, ong>theong> MPC considered that it would be too early to consider ong>theong> renewal application as ong>theong> planning circumstances might be different at ong>theong> time nearer to ong>theong> expiry ong>ofong> ong>theong> planning permission, which might have a material bearing on ong>theong> decision ong>ofong> ong>theong> planning application. The MPC decided to defer a decision on application No. A/TY/110 until a time closer to ong>theong> expiry ong>ofong> ong>theong> original planning permission; Proposed Amendment to ong>theong> TPB Guidelines No. 34A Submission Time for Application for Renewal (g) to ensure that ong>theong> ong>Boardong> could take into account ong>theong> latest planning circumstances pertaining to an application for renewal ong>ofong> temporary planning permission, it was proposed that ong>theong> TPB Guidelines No. 34A be revised by adding a new paragraph 3.4 to stipulate that an application for renewal ong>ofong> planning permission for temporary use should not be submitted more than four months before ong>theong> expiry ong>ofong> ong>theong> original temporary approval; and Consultation (h) ong>theong> proposed amendments to ong>theong> TPB Guidelines No. 34A were to indicate ong>theong> time requirement for submission ong>ofong> application for renewal ong>ofong> temporary planning permission. Consultation with government

In response to a Member’s enquiry on ong>theong> second and third sentences ong>ofong> ong>theong> proposed paragraph 3.4 ong>ofong> ong>theong> TPB Guidelines, Miss H.Y. Chu said that ong>theong> intention was to set out ong>theong> reason for requesting ong>theong> applicants to submit ong>theong> applications for renewing temporary planning approvals no more than four months before ong>theong> expiry ong>ofong> ong>theong> temporary approvals. The reason was that in considering ong>theong> application for renewing temporary planning approval, ong>theong> ong>Boardong> needed to take into account ong>theong> planning circumstances at ong>theong> time nearer to ong>theong> expiry ong>ofong> ong>theong> planning approval as any change in ong>theong> planning circumstances might have a bearing on ong>theong> decision ong>ofong> ong>theong> application. 7. This Member considered that ong>theong> purpose ong>ofong> ong>theong>se two sentences was not very clear, and it was doubtful wheong>theong>r ong>theong> reason behind ong>theong> 4-month requirement for ong>theong> submission ong>ofong> ong>theong> application for renewing temporary planning approvals should be set out in ong>theong> Guidelines. The Secretary said that it was a common practice that explanations would be provided in ong>theong> TPB Guidelines for stipulation ong>ofong> requirements. For instance, in paragraph 3.3 ong>ofong> ong>theong> TPB Guidelines No. 34A, it had set out ong>theong> reason why ong>theong> planning applications for renewing temporary approval should be submitted to ong>theong> ong>Boardong> no less than two months before ong>theong> expiry ong>ofong> ong>theong> temporary approval. 8. In order to set out clearly ong>theong> reason behind ong>theong> 4-month requirement, ong>theong> Chairman suggested to add ‘The rationale behind this arrangement is that..’ at ong>theong> beginning ong>ofong> ong>theong> second sentence. Members agreed. 9. Anoong>theong>r Member said that if an applicant had to submit his renewal application not earlier than four months before ong>theong> expiry ong>ofong> ong>theong> temporary planning approval and in case his application was rejected by ong>theong> MPC/ Rural and New ong>Townong> ong>Planningong> Committee (RNTPC), ong>theong> applicant’s temporary approval would expire before he could have his review application heard by ong>theong> ong>Boardong>. This Member opined that a longer time might be more appropriate in ong>theong> subject item. 10. The Secretary said that legal advice had been sought on ong>theong> subject time requirement. Under ong>theong> Ordinance, an applicant aggrieved by ong>theong> decision ong>ofong> ong>theong> MPC/RNTPC on ong>theong> application for renewal ong>ofong> temporary planning approval could seek
