Like all oong>theong>r trades in Hong Kong, ong>theong> operation ong>ofong> private columbaria should comply with ong>theong> statutory or oong>theong>r requirements stipulated by ong>theong> Government. 29. The same member said that ong>theong> number ong>ofong> deaths in ong>theong> territory was projected to be about 40,000 per year in ong>theong> next twenty years. This Member enquired about ong>theong> target set by ong>theong> Government in supplying ong>theong> niches. According to this Member, ong>theong> Government had committed several years ago to supply some 80% ong>ofong> ong>theong> total niches to be provided in ong>theong> territory. 30. Mrs. Lai Chan Chi Kuen, Marion referred to paragraph 13 ong>ofong> ong>theong> subject Public Consultation Document and said that in ong>theong> last ten years (2000 – 2009), niches provided by ong>theong> Government accounted for about 14% ong>ofong> cremations in ong>theong> same period, or 40% if BMCPC was to be taken into account. The supply ong>ofong> public niches in ong>theong> future would depend on ong>theong> availability ong>ofong> suitable sites and success or oong>theong>rwise ong>ofong> gaining local support. 31. In relation to ong>theong> development ong>ofong> columbarium facilities in Wo Hop Shek Cemetery, anoong>theong>r Member supplemented that it was a potential site as only one-tenth ong>ofong> ong>theong> cemetery had been developed. The upper platforms ong>ofong> ong>theong> cemetery were largely undeveloped but inaccessible. Building roads to serve ong>theong> upper platforms would be costly. BMCPC had previously considered co-developing ong>theong> cemetery site with FEHD. This Member envisaged that with ong>theong> Government policy to increase ong>theong> supply ong>ofong> niches, ong>theong>re should be opportunity for cooperation between BMCPC and ong>theong> Government in developing

In response, Mrs. Lai Chan Chi Kuen, Marion said that ong>theong> Government was conducting technical studies to utilise ong>theong> undeveloped areas ong>ofong> ong>theong> Wo Hop Shek Cemetery. 32. Five Members raised ong>theong> following comments/ suggestions/ questions: (a) unavoidably, some List B columbaria could not meet all ong>theong> licensing requirements, and might choose to close down business after ong>theong> exemption period. The Administration should be prepared to resolve ong>theong> issues arising from regulation ong>ofong> List B columbaria or to provide ‘exit’ to both ong>theong> operators and ong>theong> affected descendents. The operation ong>ofong> non-conforming existing private columbaria might have to be tolerated. Oong>theong>rwise, ong>theong> Government had to ong>ofong>fer low cost solutions to ong>theong> concerned descendents to accommodate ong>theong> interred cremains by way ong>ofong> building more GoRs or to allocating more land for providing columbarium facilities; (b) ong>theong> Administration should consider imposing conditions in ong>theong> licences requiring ong>theong> operators to set up a trust fund or similar mechanism for ong>theong> long term management ong>ofong> ong>theong> private columbaria; and to consult ong>theong> local DC as ong>theong> consultation might enhance ong>theong> public’s understanding ong>ofong> ong>theong> proposal and ease ong>theong> anxiety ong>ofong> ong>theong> locals; (c) ong>theong> Administration could consider delegating ong>theong> control ong>ofong> columbaria to DCs, noting that about half ong>ofong> ong>theong> DCs had columbaria in ong>theong>ir respective districts; (d) ong>theong> Administration might also look into ong>theong> provision ong>ofong> niches for cremains ong>ofong> pets as that ong>theong>re was an increasing demand for such provision from pet owners; and (e) what were ong>theong> plans to strengong>theong>n consumer education on ong>theong> choice ong>ofong> private columbaria and on ong>theong> risks ong>ofong> patronising operators ong>ofong> private columbaria in List B.
