obligated to submit to the Director General of Oil and Gas of the Department<br />

of Mines and Energy, among others, the following:<br />

1. Annual programme of works and approved budgets for those works;<br />

2. An operational programme of oil and gas mining, 3 months before the<br />

works begin.<br />

3. All data, samples, maps, reports and other documents obtained or<br />

produced by the company from the exploration and exploitation of oil<br />

and gas, which are regarded as Government property. (Article 4).<br />

4. After obtaining permission from the Director General, the company can<br />

send the samples and data abroad for assessment / evaluation.<br />

5. The company is obligated to give correct information to Government<br />

inspectors and provided inspectors with the necessary facilities to<br />

carry out their responsibilities.<br />

Except as approved by the Minister of Mines and Energy, exploration<br />

and exploitation cannot be carried out in the following places:<br />

(i) Defense /military bases, sealanes of navigation, or ports<br />

installations;<br />

(ii) Religious, cultural, natural reserves or touristy areas;<br />

(iii) Less than 250 meters from the boundary of its mining<br />

areas;<br />

(iv) Fishing grounds or spawning areas;<br />

(v) Areas with underwater installations, pipelines, and<br />

underwater cables; and<br />

(vi) In areas under scientific research or investigation.<br />

Companies are obligated to prevent pollution of the sea, rivers,<br />

coastlines or air space and to fight and eliminate pollution when it occurs.<br />

The construction of installations and structures at sea must meet the<br />

following requirements:<br />

(i) Assure the safety of workers;<br />
