3. Compliance With Legislative Requirements<br />

All serious prospectors take their obligations as imposed by section 76<br />

seriously and keep the required records at their registered offices and submit<br />

returns to the Mining Commissioner, containing summaries of work done for<br />

the period under review. The <strong>Minerals</strong> Act requires submission of the returns<br />

“within 30 days after the end of each quarter”(section 76 (1) (d)). The<br />

Ministry’s interpretation of this section is that such quarter is to be calculated<br />

from the date of issuance of the EPL. The industry through the Chamber of<br />

Mines Prospecting Committee has put forward a different interpretation<br />

based on practical realities. To this end, a request has been made to the<br />

Ministry to allow submission of returns as per calendar quarters. The<br />

Ministry maintains that quarters calculated from the commencement date of<br />

the EPL is the correct interpretation of the <strong>Minerals</strong> Act and that this enables<br />
