adopted in <strong>the</strong> framework <strong>of</strong> <strong>the</strong><br />

UNEP/Mediterranean Action Plan<br />

Guidelines and Declarations - Italy<br />

(MAP) (Cairo, 1991) by <strong>the</strong><br />

constituent parties <strong>of</strong> <strong>the</strong><br />

Convention <strong>of</strong> Barcelona;<br />

• The Agreement on <strong>the</strong> Protection <strong>of</strong><br />

Mediterranean Coastal Waters<br />

(RAMOGE, 1976);<br />

• Resolution 46/215 <strong>of</strong> <strong>the</strong> United<br />

Nations General Assembly <strong>of</strong> 20<br />

December 1991;<br />

• The recommendation <strong>of</strong> 26 January<br />

1990 <strong>of</strong> <strong>the</strong> <strong>International</strong><br />

Commission <strong>for</strong> <strong>the</strong> Scientific<br />

Exploration <strong>of</strong> <strong>the</strong> Mediterranean<br />

(CIESM) concerning <strong>the</strong> evaluation<br />

<strong>of</strong> <strong>the</strong> impact <strong>of</strong> drift net fishing and<br />

measures to take;<br />

• have adopted <strong>the</strong> present declaration:<br />

Article 1<br />

An international marine sanctuary is established in <strong>the</strong><br />

Corsican-Ligurian-Provence sea in order to protect all<br />

species <strong>of</strong> marine mammals.<br />

Article 2<br />

The signatories base <strong>the</strong>ir declaration on <strong>the</strong> following<br />

points:<br />

• The state <strong>of</strong> conservation is judged<br />

"favourable" when <strong>the</strong> knowledge about <strong>the</strong><br />

populations indicates that <strong>the</strong> marine<br />

mammals <strong>of</strong> <strong>the</strong> region constitute a viable<br />

part <strong>of</strong> <strong>the</strong> ecosystem.<br />

• The term "habitat" signifies all, or part <strong>of</strong> <strong>the</strong><br />

area in which marine mammals are<br />

distributed, <strong>of</strong>fering <strong>the</strong>m appropriate living<br />

conditions.<br />

• The word "take" signifies <strong>the</strong> hunting, capture,<br />

or killing <strong>of</strong> marine mammals as well as<br />

attempts at <strong>the</strong>se acts.<br />

Article 3<br />

The signatories designate a competent authority to coordinate<br />

<strong>the</strong> management <strong>of</strong> <strong>the</strong> sanctuary.<br />
