NATIONAL CEMETERIES<br />

I. VA <strong>National</strong> Cemetery Adm<strong>in</strong>istration<br />

In 862, President L<strong>in</strong>coln signed <strong>in</strong>to law legislation authoriz<strong>in</strong>g the establishment <strong>of</strong> national<br />

cemeteries “. . . for the soldiers who shall die <strong>in</strong> the service <strong>of</strong> the country.” Fourteen cemeteries were<br />

established that year. These national cemeteries were the beg<strong>in</strong>n<strong>in</strong>g <strong>of</strong> today’s <strong>National</strong> Cemetery<br />

Adm<strong>in</strong>istration.<br />

After the Civil War, search and recovery teams visited hundreds <strong>of</strong> battlefields, churchyards,<br />

plantations and other locations seek<strong>in</strong>g wartime <strong>in</strong>terments that were made <strong>in</strong> haste. By 870, the<br />

rema<strong>in</strong>s <strong>of</strong> nearly 300,000 Civil War dead were re<strong>in</strong>terred <strong>in</strong> 73 national cemeteries.<br />

The <strong>National</strong> Cemetery Adm<strong>in</strong>istration has undergone many changes s<strong>in</strong>ce its <strong>in</strong>ception. In<br />

873, Congress extended the right <strong>of</strong> burial <strong>in</strong> a national cemetery to all honorably discharged Union<br />

<strong>Veterans</strong> <strong>of</strong> the Civil War. By a 933 Executive Order, certa<strong>in</strong> national cemeteries were transferred<br />

from the War <strong>Department</strong> (now the <strong>Department</strong> <strong>of</strong> the Army) to the <strong>National</strong> Park Service <strong>of</strong> the<br />

<strong>Department</strong> <strong>of</strong> the Interior. In June 973, Public Law 93-43 authorized the transfer <strong>of</strong> 82 national<br />

cemeteries from the <strong>Department</strong> <strong>of</strong> the Army to the <strong>Veterans</strong> Adm<strong>in</strong>istration, now the <strong>Department</strong> <strong>of</strong><br />

<strong>Veterans</strong> <strong>Affairs</strong>. This action comb<strong>in</strong>ed the 82 Army cemeteries with 2 cemeteries already under<br />

VA’s jurisdiction. With the addition <strong>of</strong> 29 new cemeteries s<strong>in</strong>ce 973, and the transfer <strong>of</strong> one historic<br />

site and cemetery to the State <strong>of</strong> Kentucky, the <strong>National</strong> Cemetery Adm<strong>in</strong>istration now comprises<br />

3 national cemeteries. The <strong>Department</strong> <strong>of</strong> the Army still adm<strong>in</strong>isters two national cemeteries --<br />

Arl<strong>in</strong>gton and the U.S. Armed Forces Retirement Home, both <strong>in</strong> the Wash<strong>in</strong>gton, DC area -- and the<br />

<strong>Department</strong> <strong>of</strong> Interior adm<strong>in</strong>isters 4, for an overall total <strong>of</strong> 4 national cemeteries.<br />

In 978, Congress established the State Cemetery Grants Program (Public Law 95-476).<br />

Adm<strong>in</strong>istered by the <strong>National</strong> Cemetery Adm<strong>in</strong>istration to aid States and U.S. territories <strong>in</strong> the<br />

establishment, expansion and improvement <strong>of</strong> <strong>Veterans</strong> cemeteries, the State Cemetery Grants<br />

Program complements the <strong>National</strong> Cemetery Adm<strong>in</strong>istration by provid<strong>in</strong>g gravesites for <strong>Veterans</strong> <strong>in</strong><br />

those areas not adequately served by national cemeteries. State veterans cemeteries enhance VA’s<br />

ability to meet the burial needs <strong>of</strong> America’s <strong>Veterans</strong>.<br />

II. General Information<br />

1. INTERMENT IN NATIONAL AND STATE CEMETERIES<br />

a. Burial <strong>in</strong> a national cemetery is based on military service. Requests for <strong>in</strong>terment <strong>in</strong><br />

national cemeteries should be directed to staff at the cemetery where burial is sought. A list <strong>of</strong> VA<br />

national cemeteries is provided <strong>in</strong> Section V.2 <strong>of</strong> this <strong>in</strong>formation sheet or on-l<strong>in</strong>e at http://www.cem.<br />

va.gov. The cemetery director determ<strong>in</strong>es eligibility for burial, usually at the time <strong>of</strong> need. Most<br />

categories <strong>of</strong> persons entitled to burial <strong>in</strong> VA national cemeteries are summarized <strong>in</strong> Section III <strong>of</strong> this<br />

<strong>in</strong>formation sheet.

b. Arl<strong>in</strong>gton <strong>National</strong> Cemetery is under the jurisdiction <strong>of</strong> the <strong>Department</strong> <strong>of</strong> the Army.<br />

Inquiries concern<strong>in</strong>g eligibility for <strong>in</strong>terment there should be directed to Arl<strong>in</strong>gton <strong>National</strong> Cemetery<br />

<strong>in</strong> Virg<strong>in</strong>ia. See Section V.5 <strong>of</strong> this <strong>in</strong>formation sheet for the address and phone number or on-l<strong>in</strong>e at<br />

c. The two active national cemeteries adm<strong>in</strong>istered by the <strong>Department</strong> <strong>of</strong> the Interior --<br />

Andersonville <strong>National</strong> Cemetery <strong>in</strong> Georgia and Andrew Johnson <strong>National</strong> Cemetery <strong>in</strong> Tennessee<br />

-- use the same eligibility criteria as the <strong>National</strong> Cemetery Adm<strong>in</strong>istration. Addresses and telephone<br />

numbers for cemeteries adm<strong>in</strong>istered by the <strong>Department</strong> <strong>of</strong> the Interior are provided <strong>in</strong> Section V.3 <strong>of</strong><br />

this <strong>in</strong>formation sheet.<br />

d. Eligibility criteria for burial <strong>in</strong> State veterans cemeteries are the same or similar to criteria<br />

for burial <strong>in</strong> VA national cemeteries, but some States have residency requirements and other more<br />

restrictive requirements. State cemeteries should be contacted directly for <strong>in</strong>formation. State<br />

veterans cemeteries are listed <strong>in</strong> Section V.4 <strong>of</strong> this <strong>in</strong>formation sheet or on-l<strong>in</strong>e at http://www.cem.<br />

va.gov.<br />

2. ASSIGNMENT OF SPACE<br />

a. The <strong>National</strong> Cemetery Adm<strong>in</strong>istration is authorized to bury eligible <strong>in</strong>dividuals <strong>in</strong> any VA<br />

national cemetery with available grave space. See Section V.2 <strong>of</strong> this <strong>in</strong>formation sheet for a list <strong>of</strong><br />

VA national cemeteries.<br />

b. One gravesite or columbarium niche is authorized for the <strong>in</strong>terment <strong>of</strong> all eligible members<br />

<strong>of</strong> a family except where soil conditions require more than one grave, or when the number <strong>of</strong> eligible<br />

family decedents requires more than one grave, or niche.<br />

c. A gravesite is not reserved before it is needed for a burial. VA honors reservations made<br />

through 962, when cemeteries were under the jurisdiction <strong>of</strong> the <strong>Department</strong> <strong>of</strong> the Army and<br />

reservations were allowed. When a death occurs and eligibility for <strong>in</strong>terment <strong>in</strong> a national cemetery is<br />

determ<strong>in</strong>ed, grave space is assigned by the cemetery director <strong>in</strong> the name <strong>of</strong> the Veteran.<br />

d. Many VA national cemeteries that have exhausted space for full-casket burials can still<br />

<strong>in</strong>ter cremated rema<strong>in</strong>s. Occasionally, full-casket gravesites become available <strong>in</strong> these cemeteries<br />

due to dis<strong>in</strong>terments or when gravesite reservations made through 962 are canceled. Contact the<br />

cemetery director for <strong>in</strong>formation regard<strong>in</strong>g the availability <strong>of</strong> grave space.<br />

3. ENTITLEMENT TO BURIAL BENEFITS<br />

a. There is no charge for burial <strong>in</strong> a national cemetery. Open<strong>in</strong>g and clos<strong>in</strong>g <strong>of</strong> the grave, a<br />

headstone or marker with authorized <strong>in</strong>scription(s), and perpetual ma<strong>in</strong>tenance will be provided by the<br />

Government. Flat bronze, granite or marble grave markers and upright marble or granite headstones<br />

are available to mark graves <strong>in</strong> the style consistent with exist<strong>in</strong>g monuments at the national cemetery.<br />

Marble, granite, or bronze niche covers are used on columbarium.<br />

b. At no expense to the next <strong>of</strong> k<strong>in</strong>, VA furnishes gravel<strong>in</strong>ers for new graves <strong>in</strong> national<br />

cemeteries with space available. The next <strong>of</strong> k<strong>in</strong> may choose to purchase and use a private outer<br />

burial receptacle rather than use the government furnished gravel<strong>in</strong>er and receive a monetary<br />

allowance equal to the average cost to the Government <strong>of</strong> a gravel<strong>in</strong>er, less adm<strong>in</strong>istrative costs.<br />

This monetary allowance will partially defray the cost <strong>of</strong> a privately purchased outer burial receptacle.<br />

Outer burial receptacles may be purchased at private expense for family members <strong>of</strong> an <strong>in</strong>dividual<br />

previously buried, if advance approval <strong>of</strong> the cemetery director is obta<strong>in</strong>ed.<br />

c. A United States flag is provided to drape the casket or accompany the urn <strong>of</strong> an eligible<br />

Veteran who was discharged from military service under conditions other than dishonorable. A<br />

burial flag may be provided by a funeral director or obta<strong>in</strong>ed at VA Regional Offices and most<br />

local post <strong>of</strong>fices. After the service, the flag will be presented to the next <strong>of</strong> k<strong>in</strong> or close associate<br />

<strong>of</strong> the deceased. Flags may be donated to a national cemetery to be flown on appropriate days,<br />

if the cemetery has an Avenue <strong>of</strong> Flags program. VA also will issue a burial flag on behalf <strong>of</strong> a<br />

servicemember who was miss<strong>in</strong>g <strong>in</strong> action and later presumed dead by the military department. By<br />

law, only one flag is presented for the eligible Veteran.<br />

d. VA may not reimburse any costs associated with the burial, <strong>in</strong>clud<strong>in</strong>g transportation <strong>of</strong> the<br />

rema<strong>in</strong>s, <strong>of</strong> a decedent other than a Veteran. VA will pay a monetary burial and funeral expense<br />

allowance for <strong>Veterans</strong> who, at the time <strong>of</strong> death, were entitled to receive pension or compensation or<br />

would have been entitled to compensation but for receipt <strong>of</strong> military retirement pay. Eligibility for the<br />

allowance also may be established when death occurs <strong>in</strong> a VA hospital, nurs<strong>in</strong>g home, or domiciliary,<br />

or a hospital or nurs<strong>in</strong>g home with which VA contracted, and additional costs <strong>of</strong> transportation <strong>of</strong> the<br />

rema<strong>in</strong>s may be reimbursed <strong>in</strong> those cases. In these cases, VA will also pay the cost <strong>of</strong> transport<strong>in</strong>g<br />

the rema<strong>in</strong>s <strong>of</strong> a service-disabled Veteran to the national cemetery with available grave space nearest<br />

his or her home. The person who bore the Veteran’s burial expenses may claim reimbursement up to<br />

prescribed limits.<br />

e. A person who dies on active duty is entitled to certa<strong>in</strong> benefits from the military. Information<br />

about these benefits is available from the branch <strong>of</strong> the Armed Forces <strong>in</strong> which the person served.<br />

f. A Presidential Memorial Certificate may be requested to honor the memory <strong>of</strong> any deceased<br />

Veteran who was discharged under honorable conditions. The local VA Regional Office generally<br />

orig<strong>in</strong>ates the first request for a Presidential Memorial Certificate. Request forms may also be<br />

accessed onl<strong>in</strong>e at http://www.va.gov/vaforms/va/pdf/VA40-0247.pdf. Eligible recipients <strong>in</strong>clude next<br />

<strong>of</strong> k<strong>in</strong>, other relatives and friends. Requests should be accompanied by a copy <strong>of</strong> a document such<br />

as a military discharge certificate to establish honorable service.<br />

g. Additional <strong>in</strong>formation concern<strong>in</strong>g reimbursement <strong>of</strong> burial expenses and other benefits by<br />

VA may be found <strong>in</strong> VA Pamphlet 80-0-01, “Federal Benefits for <strong>Veterans</strong>, Dependents and Survivors.<br />

http://www.va.gov/opa.<br />

4. ARRANGING AN INTERMENT IN A VA NATIONAL CEMETERY<br />

a. Interment arrangements for an eligible Veteran or dependent are made by the funeral<br />

director or the next <strong>of</strong> k<strong>in</strong> at the time <strong>of</strong> need by contact<strong>in</strong>g the national cemetery schedul<strong>in</strong>g <strong>of</strong>fice<br />

at -800-535- 7. A dependent is buried based upon the eligibility <strong>of</strong> the Veteran. To establish the<br />

Veteran’s eligibility, the name <strong>of</strong> the Veteran, together with the rank; serial, service, social security,<br />

and VA claim numbers, as applicable; date and place <strong>of</strong> entry <strong>in</strong>to and separation from the service;<br />

branch <strong>of</strong> service; date and place <strong>of</strong> birth; and date <strong>of</strong> death should be furnished. If any <strong>of</strong> these<br />

items are not available, as much <strong>in</strong>formation as possible should be furnished. A copy <strong>of</strong> the <strong>of</strong>ficial<br />

military discharge document bear<strong>in</strong>g an <strong>of</strong>ficial seal or a DD-214 is usually sufficient to determ<strong>in</strong>e<br />

eligibility for burial <strong>in</strong> a VA national cemetery. The document must show that release from service<br />

was under conditions other than dishonorable. For the majority <strong>of</strong> <strong>in</strong>dividuals, a DD-2 4 or other<br />

discharge document will be required to determ<strong>in</strong>e eligibility for burial; however, documentation such<br />

as a “20 year letter” cover<strong>in</strong>g release from reserve components or the <strong>National</strong> Guard may also<br />

qualify <strong>in</strong>dividuals for burial. If discharge <strong>in</strong>formation cannot be located, the VA Regional Office<br />

or national cemetery will also help to determ<strong>in</strong>e eligibility for burial. More specific <strong>in</strong>formation on<br />

eligibility is <strong>in</strong> Section III <strong>of</strong> this <strong>in</strong>formation sheet. (This <strong>in</strong>formation is solicited under chapter 24,<br />

title 38, United States Code, and is required to permit burial <strong>in</strong> a national cemetery. The <strong>in</strong>formation<br />

may be disclosed outside VA as permitted by law, or as stated <strong>in</strong> the Federal Register <strong>in</strong> accordance<br />

with the Privacy Act <strong>of</strong> 974. Failure to provide the required data may result <strong>in</strong> delay <strong>of</strong> burial until<br />

eligibility is verified.)<br />

b. The schedul<strong>in</strong>g <strong>of</strong>fice will set a tentative date for the burial pend<strong>in</strong>g verification <strong>of</strong> service<br />

and character <strong>of</strong> discharge, and will notify the applicant when the burial is scheduled. Not until the<br />

director verifies eligibility and confirms the arrangements will the proposed date and time <strong>of</strong> the burial<br />

be announced. The decedent may be transported to the cemetery only on the announced date <strong>of</strong> the<br />

burial.<br />

c. For persons choos<strong>in</strong>g cremation there are multiple options. Cremated rema<strong>in</strong>s may be<br />

<strong>in</strong>terred <strong>in</strong> an <strong>in</strong>-ground gravesite, placed <strong>in</strong> a garden niche, or placed <strong>in</strong> a columbarium, where<br />

available. The conta<strong>in</strong>er hold<strong>in</strong>g the cremated rema<strong>in</strong>s may not be delivered to the national cemetery<br />

until the director verifies eligibility and confirms the arrangements. Also, where available, the rema<strong>in</strong>s<br />

<strong>of</strong> the deceased may be scattered <strong>in</strong> Cremation Gardens, designated garden-type areas for the<br />

scatter<strong>in</strong>g <strong>of</strong> cremated rema<strong>in</strong>s.<br />

d. To facilitate arrang<strong>in</strong>g an <strong>in</strong>terment, a person contemplat<strong>in</strong>g burial <strong>in</strong> a national cemetery<br />

should assemble the <strong>in</strong>formation listed <strong>in</strong> paragraph (a.) above, prepare a statement <strong>of</strong> wishes, and<br />

place the <strong>in</strong>formation and statement among other important papers that will be immediately available<br />

to the person(s) mak<strong>in</strong>g f<strong>in</strong>al arrangements for burial.<br />

e. Many national cemeteries have set aside memorial areas to commemorate <strong>Veterans</strong><br />

whose rema<strong>in</strong>s were not recovered or identified, were buried at sea, or are otherwise unavailable for<br />

<strong>in</strong>terment. VA will also provide a memorial headstone or marker to be placed <strong>in</strong> that section <strong>of</strong> the<br />

cemetery.<br />

5. MILITARY HONORS<br />

Military honors are not provided by the <strong>Department</strong> <strong>of</strong> <strong>Veterans</strong> <strong>Affairs</strong>. The <strong>Department</strong> <strong>of</strong><br />

Defense (DOD), through the “Honor<strong>in</strong>g Those Who Served” program, is responsible for provid<strong>in</strong>g<br />

military funeral services. DOD, upon the family’s request or at the behest <strong>of</strong> the respective funeral<br />

home on behalf <strong>of</strong> the Veteran’s family, gives each eligible Veteran a military funeral honors ceremony<br />

to <strong>in</strong>clude the fold<strong>in</strong>g and the presentation <strong>of</strong> the United States burial flag and the play<strong>in</strong>g <strong>of</strong> Taps.<br />

Moreover, the ceremony consists <strong>of</strong> two or more uniformed military persons with at least one member<br />

from the Veteran’s parent service <strong>of</strong> the Armed Forces. These honors are available at burials <strong>in</strong><br />

private, State veterans and national cemeteries.<br />

III. Eligibility<br />

1. PERSONS ELIGIBLE FOR BURIAL IN A VA NATIONAL CEMETERY<br />

VA national cemetery directors have the primary responsibility for verify<strong>in</strong>g eligibility for burial<br />

<strong>in</strong> VA national cemeteries. A determ<strong>in</strong>ation <strong>of</strong> eligibility is usually made <strong>in</strong> response to a request for<br />

burial <strong>in</strong> a VA national cemetery. VA Regional Offices will also assist <strong>in</strong> determ<strong>in</strong><strong>in</strong>g eligibility for burial<br />

<strong>in</strong> a VA national cemetery. The toll-free number for the nearest VA Regional Office is 1-800-827-1000.<br />

a. <strong>Veterans</strong> and Members <strong>of</strong> the Armed Forces (Army, Navy, Air Force, Mar<strong>in</strong>e Corps,<br />

Coast Guard)<br />

( ) Any member <strong>of</strong> the Armed Forces <strong>of</strong> the United States who dies on active duty.<br />

(2) Any Veteran who was discharged under conditions other than dishonorable. With certa<strong>in</strong><br />

exceptions, service beg<strong>in</strong>n<strong>in</strong>g after September 7, 980, as an enlisted person, and service after<br />

October 16, 1981, as an <strong>of</strong>ficer, must be for a m<strong>in</strong>imum <strong>of</strong> 24 cont<strong>in</strong>uous months or the full period<br />

for which the person was called to active duty (as <strong>in</strong> the case <strong>of</strong> a Reservist called to active duty for<br />

a limited duration). Undesirable, bad conduct, and any other type <strong>of</strong> discharge other than honorable<br />

may or may not qualify the <strong>in</strong>dividual for <strong>Veterans</strong> benefits, depend<strong>in</strong>g upon a determ<strong>in</strong>ation made by<br />

a VA Regional Office. Cases present<strong>in</strong>g multiple discharges <strong>of</strong> vary<strong>in</strong>g character are also referred for<br />

adjudication to a VA Regional Office.<br />

(3) Any citizen <strong>of</strong> the United States who, dur<strong>in</strong>g any war <strong>in</strong> which the United States has or<br />

may be engaged, served <strong>in</strong> the Armed Forces <strong>of</strong> any Government allied with the United States dur<strong>in</strong>g<br />

that war, whose last active service was term<strong>in</strong>ated honorably by death or otherwise, and who was a<br />

citizen <strong>of</strong> the United States at the time <strong>of</strong> entry <strong>in</strong>to such service and at the time <strong>of</strong> death.<br />

b. Members <strong>of</strong> Reserve Components and Reserve Officers’ Tra<strong>in</strong><strong>in</strong>g Corps<br />

( ) Reservists and <strong>National</strong> Guard members who, at time <strong>of</strong> death, were entitled to retired pay<br />

under Chapter 223, title 0, United States Code, or would have been entitled, but for be<strong>in</strong>g under<br />

the age <strong>of</strong> 60. Specific categories <strong>of</strong> <strong>in</strong>dividuals eligible for retired pay are del<strong>in</strong>eated <strong>in</strong> section<br />

273 <strong>of</strong> Chapter 223, title 0, United States Code.<br />

(2) Members <strong>of</strong> reserve components, and members <strong>of</strong> the Army <strong>National</strong> Guard or the Air<br />

<strong>National</strong> Guard, who die while hospitalized or undergo<strong>in</strong>g treatment at the expense <strong>of</strong> the United<br />

States for <strong>in</strong>jury or disease contracted or <strong>in</strong>curred under honorable conditions while perform<strong>in</strong>g active<br />

duty for tra<strong>in</strong><strong>in</strong>g or <strong>in</strong>active duty tra<strong>in</strong><strong>in</strong>g, or undergo<strong>in</strong>g such hospitalization or treatment.<br />

(3) Members <strong>of</strong> the Reserve Officers’ Tra<strong>in</strong><strong>in</strong>g Corps <strong>of</strong> the Army, Navy, or Air Force who die<br />

under honorable conditions while attend<strong>in</strong>g an authorized tra<strong>in</strong><strong>in</strong>g camp or on an authorized cruise,<br />

while perform<strong>in</strong>g authorized travel to or from that camp or cruise, or while hospitalized or undergo<strong>in</strong>g<br />

treatment at the expense <strong>of</strong> the United States for <strong>in</strong>jury or disease contracted or <strong>in</strong>curred under<br />

honorable conditions while engaged <strong>in</strong> one <strong>of</strong> those activities.<br />

(4) Members <strong>of</strong> reserve components who, dur<strong>in</strong>g a period <strong>of</strong> active duty for tra<strong>in</strong><strong>in</strong>g, were<br />

disabled or died from a disease or <strong>in</strong>jury <strong>in</strong>curred or aggravated <strong>in</strong> l<strong>in</strong>e <strong>of</strong> duty or, dur<strong>in</strong>g a period <strong>of</strong><br />

<strong>in</strong>active duty tra<strong>in</strong><strong>in</strong>g, were disabled or died from an <strong>in</strong>jury or certa<strong>in</strong> cardiovascular disorders <strong>in</strong>curred<br />

or aggravated <strong>in</strong> l<strong>in</strong>e <strong>of</strong> duty.<br />

c. Commissioned Officers, <strong>National</strong> Oceanic and Atmospheric Adm<strong>in</strong>istration<br />

(1) A Commissioned Officer <strong>of</strong> the <strong>National</strong> Oceanic and Atmospheric Adm<strong>in</strong>istration (formerly<br />

titled the Coast and Geodetic Survey and the Environmental Science Services Adm<strong>in</strong>istration) with<br />

full-time duty on or after July 29, 945.<br />

(2) A Commissioned Officer who served before July 29, 1945; and,<br />

(a) Was assigned to an area <strong>of</strong> immediate military hazard as determ<strong>in</strong>ed by the Secretary <strong>of</strong><br />

Defense while <strong>in</strong> time <strong>of</strong> war, or <strong>in</strong> a Presidentially declared national emergency; or,<br />

(b) Served <strong>in</strong> the Philipp<strong>in</strong>e Islands on December 7, 94 , and cont<strong>in</strong>uously <strong>in</strong> such islands<br />

thereafter.<br />

d. Public Health Service<br />

(1) A Commissioned Officer <strong>of</strong> the Regular or Reserve Corps <strong>of</strong> the Public Health Service<br />

who served on full-time duty on or after July 29, 945. If the service <strong>of</strong> the particular Public Health<br />

Service Officer falls with<strong>in</strong> the mean<strong>in</strong>g <strong>of</strong> active duty for tra<strong>in</strong><strong>in</strong>g, as def<strong>in</strong>ed <strong>in</strong> section 101(22), title<br />

38, United States Code, he or she must have been disabled or died from a disease or <strong>in</strong>jury <strong>in</strong>curred<br />

or aggravated <strong>in</strong> the l<strong>in</strong>e <strong>of</strong> duty.<br />

(2) A Commissioned Officer <strong>of</strong> the Regular or Reserve Corps <strong>of</strong> the Public Health Service who<br />

performed full-time duty prior to July 29, 945:<br />

(a) In time <strong>of</strong> war;<br />

(b) On detail for duty with the Army, Navy, Air Force, Mar<strong>in</strong>e Corps, or Coast Guard; or,<br />

(c) While the Service was part <strong>of</strong> the military forces <strong>of</strong> the United States pursuant to Executive<br />

Order <strong>of</strong> the President.<br />

(3) A Commissioned Officer serv<strong>in</strong>g on <strong>in</strong>active duty tra<strong>in</strong><strong>in</strong>g as def<strong>in</strong>ed <strong>in</strong> section 101(23),<br />

title 38, United States Code, whose death resulted from an <strong>in</strong>jury <strong>in</strong>curred or aggravated <strong>in</strong> the l<strong>in</strong>e <strong>of</strong><br />

duty.<br />

e. World War II Merchant Mar<strong>in</strong>ers<br />

( ) United States Merchant Mar<strong>in</strong>ers with oceango<strong>in</strong>g service dur<strong>in</strong>g the period <strong>of</strong> armed<br />

conflict, December 7, 1941, to December 31, 1946. Prior to the enactment <strong>of</strong> Public Law 105-368,<br />

United States Merchant Mar<strong>in</strong>ers with oceango<strong>in</strong>g service dur<strong>in</strong>g the period <strong>of</strong> armed conflict <strong>of</strong><br />

December 7, 94 , to August 5, 945, were eligible. With enactment <strong>of</strong> Public Law 05-368, the<br />

service period is extended to December 3 , 946, for those dy<strong>in</strong>g on or after November , 998. A<br />

DD-2 4 document<strong>in</strong>g this service may be obta<strong>in</strong>ed by submitt<strong>in</strong>g an application to Commandant (G-<br />

MVP-6), United States Coast Guard, 2 00 2nd Street, SW, Wash<strong>in</strong>gton, DC 20593. Notwithstand<strong>in</strong>g,<br />

the Mar<strong>in</strong>er’s death must have occurred on or after the enactment <strong>of</strong> Public Law 05-368.<br />

(2) United States Merchant Mar<strong>in</strong>ers who served on blockships <strong>in</strong> support <strong>of</strong> Operation<br />

Mulberry dur<strong>in</strong>g World War II.<br />

f. The Philipp<strong>in</strong>e Armed Forces<br />

( ) Any Philipp<strong>in</strong>e Veteran who was a citizen <strong>of</strong> the United States or an alien lawfully admitted<br />

for permanent residence <strong>in</strong> the United States at the time <strong>of</strong> their death; and resided <strong>in</strong> the United<br />

States at the time <strong>of</strong> their death; and,<br />

(a) Was a person who served before July , 946, <strong>in</strong> the organized military forces <strong>of</strong> the<br />

Government <strong>of</strong> the Commonwealth <strong>of</strong> the Philipp<strong>in</strong>es, while such forces were <strong>in</strong> the service <strong>of</strong> the<br />

Armed Forces <strong>of</strong> the United States pursuant to the military order <strong>of</strong> the President dated July 26,<br />

94 , <strong>in</strong>clud<strong>in</strong>g organized guerilla forces under commanders appo<strong>in</strong>ted, designated, or subsequently<br />

recognized by the Commander <strong>in</strong> Chief, Southwest Pacific Area, or other competent authority <strong>in</strong> the<br />

Army <strong>of</strong> the United States, and who died on or after November , 2000; or,<br />

(b) Was a person who enlisted between October 6, 945, and June 30, 947, with the Armed<br />

Forces <strong>of</strong> the United States with the consent <strong>of</strong> the Philipp<strong>in</strong>e government, pursuant to section 4 <strong>of</strong><br />

the Armed Forces Voluntary Recruitment Act <strong>of</strong> 945, and who died on or after December 6, 2003.<br />

g. Spouses and Dependents<br />

( ) The spouse or surviv<strong>in</strong>g spouse <strong>of</strong> an eligible Veteran is eligible for <strong>in</strong>terment <strong>in</strong> a national<br />

cemetery even if that Veteran is not buried or memorialized <strong>in</strong> a national cemetery. In addition, the<br />

spouse or surviv<strong>in</strong>g spouse <strong>of</strong> a member <strong>of</strong> the Armed Forces <strong>of</strong> the United States whose rema<strong>in</strong>s<br />

are unavailable for burial is also eligible for burial.<br />

(2) The surviv<strong>in</strong>g spouse <strong>of</strong> an eligible Veteran who had a subsequent remarriage to a non-<br />

Veteran and whose death occurred on or after January , 2000, is eligible for burial <strong>in</strong> a national<br />

cemetery, based on his or her marriage to the eligible Veteran.<br />

(3) The m<strong>in</strong>or children <strong>of</strong> an eligible Veteran. For purpose <strong>of</strong> burial <strong>in</strong> a national cemetery, a<br />

m<strong>in</strong>or child is a child who is unmarried and:<br />

(a) Who is under 2 years <strong>of</strong> age; or,<br />

(b) Who is under 23 years <strong>of</strong> age and pursu<strong>in</strong>g a full-time course <strong>of</strong> <strong>in</strong>struction at an approved<br />

educational <strong>in</strong>stitution.<br />

(4) The unmarried adult child <strong>of</strong> an eligible Veteran. For purpose <strong>of</strong> burial <strong>in</strong> a national<br />

cemetery, an unmarried adult child is:<br />

Of any age but became permanently physically or mentally disabled and <strong>in</strong>capable <strong>of</strong> selfsupport<br />

before reach<strong>in</strong>g 2 years <strong>of</strong> age, or before reach<strong>in</strong>g 23 years <strong>of</strong> age if pursu<strong>in</strong>g a full-time<br />

course <strong>of</strong> <strong>in</strong>struction at an approved educational <strong>in</strong>stitution. Proper support<strong>in</strong>g documentation must<br />

be provided.<br />

h. Parents<br />

( ) Biological or adoptive parents, who died after October 3, 20 0, and whose biological or<br />

adoptive child was a servicemember:<br />

(a) whose death occurred on or after October 7, 200 , and<br />

(b) whose death was the result <strong>of</strong> a hostile casualty or a tra<strong>in</strong><strong>in</strong>g-related <strong>in</strong>jury, and<br />

(c) who is <strong>in</strong>terred <strong>in</strong> a national cemetery, <strong>in</strong> a gravesite with available space for subsequent<br />

<strong>in</strong>terment, and<br />

(d) at the time <strong>of</strong> the parent’s death, had no spouse, surviv<strong>in</strong>g spouse, or child who is buried,<br />

or who, upon death, may be eligible for burial <strong>in</strong> a national cemetery.<br />

(2) The term “hostile casualty” means a person who, as a member <strong>of</strong> the Armed Forces, dies<br />

as the direct result <strong>of</strong> hostile action with the enemy, while <strong>in</strong> combat, while go<strong>in</strong>g to or return<strong>in</strong>g from<br />

a combat mission if the cause <strong>of</strong> death was directly related to hostile action, or while hospitalized<br />

or undergo<strong>in</strong>g treatment at the expense <strong>of</strong> the United States for <strong>in</strong>jury <strong>in</strong>curred dur<strong>in</strong>g combat, and<br />

<strong>in</strong>cludes a person killed mistakenly or accidentally by friendly fire directed at a hostile force or what is<br />

thought to be a hostile force. The term “hostile casualty” does not <strong>in</strong>clude a person who dies due to<br />

the elements, a self-<strong>in</strong>flicted wound, combat fatigue, or a friendly force while the person was absentwithout-leave,<br />

deserter, or dropped-from-rolls status or was voluntarily absent from a place <strong>of</strong> duty.<br />

(3) The term “tra<strong>in</strong><strong>in</strong>g-related <strong>in</strong>jury” means an <strong>in</strong>jury <strong>in</strong>curred by a member <strong>of</strong> the Armed<br />

Forces while perform<strong>in</strong>g authorized tra<strong>in</strong><strong>in</strong>g activities <strong>in</strong> preparation for a combat mission.<br />

i. Others<br />

Such other persons or classes <strong>of</strong> persons as designated by the Secretary <strong>of</strong> <strong>Veterans</strong> <strong>Affairs</strong><br />

(38 U.S.C. § 2402(6)) or the Secretary <strong>of</strong> Defense (Public Law 95-202, § 40 , and 38 CFR § 3.7(x)).<br />

IV. Ineligibility<br />

1. PERSONS NOT ELIGIBLE FOR BURIAL IN A VA NATIONAL CEMETERY<br />

a. Former Spouses<br />

A former spouse <strong>of</strong> an eligible <strong>in</strong>dividual whose marriage to that <strong>in</strong>dividual has been term<strong>in</strong>ated by<br />

annulment or divorce, if not otherwise eligible.<br />

b. Other Family Members<br />

Family members <strong>of</strong> an eligible person except those def<strong>in</strong>ed as eligible <strong>in</strong> Section III,<br />

paragraph g.<br />

c. Disqualify<strong>in</strong>g Characters <strong>of</strong> Discharge<br />

A person whose only separation from the Armed Forces was under dishonorable conditions or<br />

whose character <strong>of</strong> service results <strong>in</strong> a bar to <strong>Veterans</strong> benefits.<br />

d. Discharge from Draft<br />

A person who was ordered to report to an <strong>in</strong>duction station, but was not actually <strong>in</strong>ducted <strong>in</strong>to<br />

military service.<br />

e. Persons Found Guilty <strong>of</strong> a Capital Crime<br />

Under 38 U.S.C. § 24 , <strong>in</strong>terment or memorialization <strong>in</strong> a VA national cemetery or <strong>in</strong> Arl<strong>in</strong>gton<br />

<strong>National</strong> Cemetery is prohibited if a person is convicted <strong>of</strong> a Federal or State capital crime, for<br />

which a sentence <strong>of</strong> imprisonment for life or the death penalty may be imposed and the conviction<br />

is f<strong>in</strong>al. Federal <strong>of</strong>ficials may not <strong>in</strong>ter <strong>in</strong> <strong>Veterans</strong> cemeteries persons who are shown by clear and<br />

conv<strong>in</strong>c<strong>in</strong>g evidence to have committed a Federal or State capital crime but were unavailable for trial<br />

due to death or flight to avoid prosecution. Federally funded State veterans cemeteries must also<br />

adhere to this law. This prohibition is also extended to furnish<strong>in</strong>g a Presidential Memorial Certificate,<br />

a burial flag, and a headstone or marker.<br />

f. Subversive Activities<br />

Any person convicted <strong>of</strong> subversive activities after September , 959, shall have no right to<br />

burial <strong>in</strong> a national cemetery from and after the date <strong>of</strong> commission <strong>of</strong> such <strong>of</strong>fense, based on periods<br />

<strong>of</strong> active military service commenc<strong>in</strong>g before the date <strong>of</strong> the commission <strong>of</strong> such <strong>of</strong>fense, nor shall<br />

another person be entitled to burial on account <strong>of</strong> such an <strong>in</strong>dividual. Eligibility will be re<strong>in</strong>stated if the<br />

President <strong>of</strong> the United States grants a pardon.<br />

g. Active or Inactive Duty for Tra<strong>in</strong><strong>in</strong>g<br />

A person whose only service is active duty for tra<strong>in</strong><strong>in</strong>g or <strong>in</strong>active duty tra<strong>in</strong><strong>in</strong>g <strong>in</strong> the <strong>National</strong><br />

Guard or Reserve Component, unless the <strong>in</strong>dividual meets the eligibility criteria listed <strong>in</strong> Section<br />

III. .b. <strong>of</strong> this <strong>in</strong>formation sheet.<br />

Members <strong>of</strong> groups whose service has been determ<strong>in</strong>ed by the Secretary <strong>of</strong> the<br />
