mengeratkan lagi silaturahim di antara kita,<br />

terutama sekali dengan rakan-rakan kita yang<br />

bukan beragama Islam. Sebagai sebuah negara<br />

yang terdiri daripada rakyat yang berbilang kaum,<br />

diharap melalui sambutan hari raya ini, kita akan<br />

dapat mengekalkan kemakmuran dan keharmonian<br />

di dalam negara.<br />

Kepada yang akan pulang ke kampung halaman<br />

untuk menyambut hari raya berhati-hatilah di jalan<br />

raya. Saya doakan agar perjalanan <strong>and</strong>a semua<br />

selamat sampai ke destinasi. Di samping itu, saya<br />

juga ingin menasihatkan agar <strong>and</strong>a semua menjaga<br />

kesihatan diri, kerana kesihatan merupakan<br />

In July 2010, Malaysia’s global trade increased<br />

15.6% (y-o-y) to RM103.8 billion. Exports<br />

increased 13.5% (y-o-y) to RM55.4 billion while<br />

imports increased 18.1% to RM48.4 billion. A trade<br />

surplus <strong>of</strong> RM7 billion was recorded in July 2010,<br />

making it the 153 rd consecutive month <strong>of</strong> surplus<br />

since November 1997.<br />

For the period January to July 2010, Malaysia’s<br />

exports increased by 24% to reach RM371.3<br />

billion compared to the corresponding period last<br />

year.<br />

BARRIERS TO FREE TRADE: APEC BUSINESS LEADERS VOICE CONCERN<br />

_________________________________________________________________________<br />

At the 3 rd APEC Business Advisory Council<br />

(ABAC) Meeting held in Bangkok from 24-27<br />

August, 2010, business leaders from 21 APEC<br />

economies expressed their concern over new<br />

trade protection measures that have emerged<br />

in the wake <strong>of</strong> the global financial crisis. While<br />

most APEC economies have not resorted to<br />

such measures <strong>and</strong> have in fact liberalised trade<br />

<strong>and</strong> investment, business leaders noted that<br />

some have continued to take trade restrictive<br />

measures. These include raising tariffs,<br />

imposing regulations, discriminating against<br />

imports <strong>and</strong> exports, providing government aid<br />

<strong>and</strong> <strong>of</strong>fering export subsidies. ABAC has urged<br />

economies to re-affirm APEC’s commitment to<br />

keep markets open <strong>and</strong> to withdraw all trade<br />

restrictive measures regardless <strong>of</strong> being WTO-<br />

compliant.<br />

ABAC also discussed initiatives to accelerate<br />

regional economic integration. ABAC views the<br />

Free <strong>Trade</strong> Area <strong>of</strong> Asia Pacific (FTAAP) as an<br />

aspiration, but is achievable. FTAAP can act<br />

as a vehicle to deliver free <strong>and</strong> open trade <strong>and</strong><br />

investment within the Asia-Pacific region. ABAC<br />

Malaysia opined that building blocks such as<br />

the Trans-Pacific Partnership (TPP) <strong>and</strong> the<br />

East Asia Free <strong>Trade</strong> Agreement (ASEAN +3)<br />

are the best pathways towards realising the<br />

FTAAP.<br />

At the meeting, ABAC Malaysia also reiterated<br />

the need for APEC to accelerate the growth <strong>of</strong><br />

SMEs <strong>and</strong> micro enterprises through policies<br />

which promote capacity building <strong>and</strong> financial<br />

inclusion in achieving quality economic<br />

integration. ABAC also called on economies to<br />

accord importance to introducing comprehensive<br />

fibre/broadb<strong>and</strong> networks in the region through<br />

public-private sector partnership.<br />

PROGRESS OF MALAYSIA-TURKEY FREE TRADE AGREEMENT (MTFTA)<br />

NEGOTIATIONS<br />

_________________________________________________________________________<br />

Malaysian <strong>and</strong> Turkish <strong>of</strong>ficials held their<br />

second meeting <strong>of</strong> Malaysia-Turkey Free <strong>Trade</strong><br />

Agreement (MTFTA) from 23 to 25 August 2010<br />

in Kuala Lumpur, Malaysia.<br />

At the meeting both Parties discussed tariffs<br />

<strong>and</strong> market access, customs procedures <strong>and</strong><br />

cooperation, Rules <strong>of</strong> Origin, Sanitary <strong>and</strong><br />

Phytosanitary Measures, Technical Barriers<br />

to <strong>Trade</strong>, Legal Matters <strong>and</strong> Economic<br />

Cooperation. Both parties reiterated their<br />

desire to complete negotiations by the first half<br />

<strong>of</strong> 2011.<br />

The meeting achieved good progress in the<br />

discussions on Sanitary <strong>and</strong> Phytosanitary<br />

Measures, Technical Barriers to <strong>Trade</strong>, Legal<br />

Matters <strong>and</strong> Economic Cooperation. Remaining<br />

issues will be discussed in the next round <strong>of</strong><br />

negotiations. Meanwhile, both parties agreed<br />

to work inter-sessionally to expedite work-inprogress<br />

<strong>of</strong> the respective Working Groups<br />

before the third round <strong>of</strong> negotiations which was<br />

scheduled from 30 November to 2 December<br />

2010.<br />

The MTFTA is expected to boost trade <strong>and</strong><br />

investment between the two countries. Turkey<br />

is an attractive market for Malaysian products<br />

as it has a large population base <strong>of</strong> 77 million<br />

people <strong>and</strong> GDP per capita <strong>of</strong> US$12,000.<br />

Turkey can serve as a gateway to Europe, the<br />

Middle East, Central Asia <strong>and</strong> North Africa.<br />

Similarly, Turkey can use Malaysia as a base<br />

to market Turkish products to the huge ASEAN<br />

market <strong>of</strong> 580 million people.<br />

STRATEGIC TRADE ACT 2010 - FACILITATING TRADE IN A SECURED<br />

TRADING ENVIRONMENT<br />

___________________________________________________________________________<br />

In keeping with Malaysia’s obligations to<br />

adopt the United Nations Security Council<br />

Resolutions 1540, the Strategic <strong>Trade</strong> Act<br />

(STA) was passed in the Parliament in June<br />

2010. This provides for control over the<br />

export, transshipment, transit <strong>and</strong> brokering<br />

<strong>of</strong> strategic items, including arms <strong>and</strong> related<br />

materials, <strong>and</strong> other activities that can facilitate<br />

the design, development <strong>and</strong> production <strong>of</strong><br />

weapons <strong>of</strong> mass destruction (WMD) <strong>and</strong> their<br />

delivery systems.<br />

To implement the STA, <strong>MITI</strong> had established<br />

the Strategic <strong>Trade</strong> Secretariat, led by a<br />

Controller. The implementation <strong>of</strong> this law will<br />

involve many other Ministries <strong>and</strong> Agencies<br />

dealing with licensing, enforcement <strong>and</strong><br />

prosecution. The related laws under the STA<br />

include:<br />

• Atomic Energy Licensing Act 1984 (Act<br />

304);<br />

• Chemical Weapons Convention Act 2005<br />

(Act 641);<br />

• Prevention <strong>and</strong> Control <strong>of</strong> Infectious<br />

Diseases Act 1988 (Act 342);<br />

• Animals Act 1953 (Act 647);<br />

• Pesticides Act 1974 (Act 149);<br />

• Plant Quarantine Act 1976 (Act 167);<br />

• Protection <strong>of</strong> New Plant Varieties Act 2004<br />

(Act 634); <strong>and</strong><br />

• Customs Act 1967 (Act 235).<br />

The STA will be implemented through<br />

guidelines <strong>and</strong> procedures that will detail out<br />

the mechanism <strong>of</strong> exports <strong>of</strong> strategic items in<br />

Malaysia. The regulations are being finalised<br />

for implementation latest by October 2010.<br />

The STA is consistent with Malaysia’s national<br />

security <strong>and</strong> international obligations. <strong>MITI</strong><br />

will ensure that the implementation <strong>of</strong> this<br />

Act does not hinder export activities in the<br />

country. While enforcement is required, the<br />

spirit is to facilitate legitimate trade. Through<br />

the implementation <strong>of</strong> this Act, we aim to<br />

achieve a more secured trading environment,<br />

in particular to enhance the confidence <strong>of</strong> the<br />

world on Malaysia as a responsible trading<br />

partner.<br />

Malaysia will benefit in terms <strong>of</strong>:<br />

• enhancing its image <strong>and</strong> build confidence<br />

among foreign investors wanting to invest<br />

in Malaysia;<br />

• facilitating <strong>and</strong> managing the exports <strong>of</strong><br />

high technology goods <strong>and</strong> components<br />

from Malaysia to other countries;<br />

• protecting Malaysia <strong>and</strong> Malaysian<br />

exporters from being exploited by<br />

proliferators <strong>and</strong> those that pr<strong>of</strong>ited from<br />

such activities, without compromising the<br />

legitimate trade in the strategic items;<br />

• promoting Malaysia as a secure country to<br />

trade with; <strong>and</strong><br />

• enabling Malaysia’s effort in maintaining<br />

international peace <strong>and</strong> security by<br />

combating the proliferation <strong>of</strong> weapons <strong>of</strong><br />

mass destruction.<br />

<strong>Trade</strong> <strong>and</strong> industry associations <strong>and</strong> business<br />

councils should be aware <strong>of</strong> the requirements<br />

<strong>of</strong> <strong>and</strong> ensure compliance with the Act. To this<br />

end, the Strategic <strong>Trade</strong> Secretariat is already<br />

undertaking outreach programmes, which will<br />

be intensified before the implementation <strong>of</strong> the<br />

Act.<br />

INITIATIVES TO DEVELOP ‘GREEN INDUSTRY’<br />

_______________________________________________<br />

Among the goals <strong>of</strong> the National Green<br />

Technology Policy are to increase production <strong>of</strong><br />

local Green Technology products <strong>and</strong> to exp<strong>and</strong><br />

SMEs businesses on Green Technology to the<br />

global market.<br />

Malaysia has taken several initiatives in<br />

promoting Green Technology including:<br />

• establishing the Green Technology<br />

Financing Scheme (GTFS) amounting to<br />

RM1.5 billion to promote the development<br />

<strong>of</strong> green technology;<br />

• developing Green Building Index (GBI), to<br />

enable green certification <strong>of</strong> buildings in<br />

Malaysia;<br />

• approval <strong>of</strong> the Renewable Energy <strong>and</strong><br />

Action Plan;<br />

• launching <strong>of</strong> Green Directory, a database for<br />

companies that have taken green initiatives<br />

in business operations; <strong>and</strong><br />

• organising the <strong>International</strong> Greentech, Eco-<br />

Products Exhibition & Conference Malaysia<br />

2010 (IGEM 2010) in October 2010, to<br />

provide an essential platform to feature<br />

innovative eco-products <strong>and</strong> services.<br />

To further develop green industries in Malaysia,<br />

<strong>MITI</strong> has undertaken several initiatives, among<br />

others:<br />

• Spearheading <strong>of</strong> the Working Committee<br />

on Green Technology <strong>and</strong> Climate Change<br />

(<strong>Industry</strong>) that has formulated Terms <strong>of</strong><br />

Reference (TOR) which include:<br />

• to enhance the awareness <strong>of</strong> industries<br />

in promoting low carbon <strong>and</strong> resourceefficient<br />

in all industrial sectors;<br />

• to promote investments <strong>and</strong> financing<br />

in low-carbon <strong>and</strong> resource-efficient<br />

industries including services sector<br />

through specific incentives;<br />

• to foster a greater market access <strong>of</strong><br />

eco-friendly products <strong>and</strong> services from<br />

Malaysia through exports promotions;<br />

• to encourage the adoption <strong>of</strong> strategies<br />

<strong>and</strong> plans to promote green technology;<br />

• to intensify international cooperation in<br />

the development <strong>and</strong> transfer <strong>of</strong> green<br />

technology; <strong>and</strong><br />

• to monitor <strong>and</strong> evaluate the strategies<br />

<strong>and</strong> plans on green technology.<br />

• organised Green Technology seminar<br />

on 9 June 2010 with the objectives to<br />

enhance awareness <strong>of</strong> industries in green<br />

technology; <strong>and</strong><br />

• conducted several consultations with<br />

industries to discuss proposals on new<br />

incentives for green technology.<br />

The Working Committee will continue to<br />

encourage investments <strong>and</strong> monitor the<br />

effectiveness <strong>of</strong> existing incentives, in line with<br />

Malaysia’s thrust to become a regional centre<br />

for green technology.<br />

DISPUTE ON ITA PRODUCTS: WTO RULING<br />

________________________________________________<br />

The WTO Dispute Settlement Body (DSB)<br />

panel issued its report on the Information<br />

Technology Agreement (ITA) dispute between<br />

the USA, Japan <strong>and</strong> Chinese Taipei <strong>and</strong> the<br />

European Union (EU) on 16 August 2010.<br />

In the dispute, the complainants claimed that<br />

the tariff imposed by the EU on certain IT<br />

On MFM products, the EU has committed to<br />

grant duty-free treatment for MFM products,<br />

but has imposed a duty <strong>of</strong> 6% on:<br />

• certain Automatic Data Processing (ADP)<br />

MFMs for “input or output” units; <strong>and</strong><br />

• certain non-ADP MFMs for facsimile<br />

machines.<br />

The panel concluded that all the products<br />

concerned fall within the scope <strong>of</strong> the ITA <strong>and</strong><br />

the EU had breached its obligation to <strong>of</strong>fer dutyfree<br />

treatment.<br />

The Dispute Settlement Body requested the<br />

EU to act in conformity with its obligations.<br />

This WTO ruling would benefit Malaysian<br />

manufacturers <strong>of</strong> these products exporting to<br />

the EU market.<br />

Summary :<br />

The Government <strong>of</strong> Karnataka, through the Government <strong>of</strong> India has applied for financing from<br />

the Asian Development Bank (ADB) towards the cost <strong>of</strong> Karnataka State Highway Improvement<br />

Project II, Stage II. Part <strong>of</strong> the proceeds from these loans will be applied to payments for<br />

Consulting Services for which this Invitation For Expression <strong>of</strong> Interest is issued.<br />

The Executing Agency, the Public Works Department, represented by the Project Director,<br />

Project Implementation Unit, Karnataka State Highway Improvement Project (PIU-KSHIP)<br />

intends to improve about 633 km <strong>of</strong> state highways. The road improvement works will include :<br />

• upgrading <strong>of</strong> existing roads to full two lanes;<br />

• green field construction <strong>of</strong> bypasses;<br />

• strengthening culverts <strong>and</strong> bridges;<br />

• constructing new bridges;<br />

• cross-drainage structures; <strong>and</strong><br />

• constructing structures for resettlement <strong>and</strong> rehabilitation.<br />

For assistance in the implementation <strong>of</strong> the project, PIU-KSHIP will engage a qualified<br />

international consulting firm supported by national consultants to provide the services that will<br />

include construction quality control, monitoring <strong>and</strong> supervision <strong>of</strong> environmental <strong>and</strong> safety<br />

aspects <strong>of</strong> the project. The consulting services contract is expected to commence in March<br />

2011 <strong>and</strong> will continue for approximately 48 months, including Defects Notification Period.<br />

Approximate cost <strong>of</strong> consulting services is about US$10 million.<br />

The PIU-KSHIP now invites eligible consultants to indicate their interest in providing these<br />

services. Interested consultants must provide information indicating that they are qualified<br />

to perform the services (brochures, description <strong>of</strong> similar assignments, experience in similar<br />

conditions, availability <strong>of</strong> appropriate skills among staff, etc). Consultants may associate with<br />

other firms to enhance their qualifications.<br />

The deadline for the submission <strong>of</strong> Expression <strong>of</strong> Interest (EOI) is at 1630 hours (local time)<br />

on 15 September 2010 to the address below. Late submissions will not be accepted. All firms<br />

will be advised <strong>of</strong> the result <strong>of</strong> their expression <strong>of</strong> interest. Only consulting firms that have been<br />
