CLARENCE CITY COUNCIL – PLANNING AUTHORITY MATTERS- 4 JUNE 2012 94 5.3. Future Subdivision Opportunities Comments were made in terms of this subdivision being allowed and what opportunities may open for other landowners in the Kings Road area. � Comment As discussed in detail, the proposal is not possible in terms of the frontage requirements of the Scheme. The subdivision of any lots must satisfy the requirements of the Scheme and any proposal would be considered as such. 5.4. Width of Kings Road and Surface Concern was expressed regarding the condition of Kings Road and the impact of additional traffic on the road and safety of users. � Comment The condition of Kings Road is considered to be acceptable in terms of the likely additional traffic to be generated by a further 2 dwellings, should the proposal be supported by Council. 6. STATE POLICIES AND ACT OBJECTIVES 6.1. The proposal is consistent with the outcomes of the State Policies, including those of the State Coastal Policy. 6.2. The proposal is consistent with the Objectives of Schedule 1 of LUPAA. 7. COUNCIL STRATEGIC PLAN/POLICY IMPLICATIONS As discussed above, the proposal is inconsistent with Council Policy C3.13 – Shared Rights-of-Way. This Policy relates to the maximum number of rights-of-way permissible and highlights 4 as the maximum number allowed. As the proposal proposes access to a total of 5 properties, it would therefore be in conflict with this Policy.

The proposal relies upon a narrow strip for access to the proposed lots and the same access strip is already encumbered by rights-of-way to 2 neighbouring properties. For this reason and as a result of insufficient frontage width, the proposal is for a Prohibited development under the Scheme and should therefore be refused. Attachments: 1. Location Plan (1) 2.
