The implications of this Policy in terms of the proposal will be considered in
detail below, in terms of the number of rights-of-way existing. It is noted,
however, that the Policy has been consistently applied by council for in excess
of 30 years and was applied when the existing property was created in
accordance with the Policy by subdivision in 1997. Further, the Local
Government (Building and Miscellaneous Provisions) Act, 1993 provide that
in respect to the subdivision of land in any building area, lots must have a
minimum frontage of 3.6m.
2.3. The proposal is a Discretionary development as it relates to the creation of
new lots within the Rural zone.
2.4. The relevant parts of the Planning Scheme are:
� Section 2 – Planning Policy Framework;
� Section 3 – General Provisions;
� Section 6.8 – Rural Zone;
� Section 6.10 – Landscape and Skyline Conservation Zone; and
� Section 7.1 – Vegetation Management Overlay.
2.5. Council’s assessment of this proposal should also consider the issues raised in
any representations received, the outcomes of the State Policies and the
Objectives of Schedule 1 of the Land Use Planning and Approvals Act, 1993
(LUPAA).
3. PROPOSAL IN DETAIL
3.1. The Site
The site is located at 64 Kings Road, Cambridge and comprised in CT
130283/1 which has a total area of 63.86ha. The location of the property is
illustrated by the location plan at Attachment 1 and illustrated by the site
photos at Attachment 3.
