The subject application is for subdivision only and does not propose any
development at this point in time. Although the site has not been surveyed by
a coastal expert to confirm the extent of any frontal dune system across the
site, the proposal recognises the hazards associated with coastal development
and proposes a covenant to Prohibit development on the western side of the
site as marked A-B-C-D on the subdivision plan. The area marked A-B-C-D
comprises the frontal dune and a further buffer area. Any proposal to develop
a dwelling within the remaining area of the Coastal Management Overlay that
is not covered by the no-build zone would be required to demonstrate that it is
not located within any frontal dune system.
“(b) The coastal environment should be protected, especially
including water quality, shoreline change, erosion or areas
of visual sensitivity”.
Any future development proposals on either lot will be required to
demonstrate compliance with the Overlay requirements of the Scheme and
show appropriate treatment of the coastal environment.
“(c) Public access to the coast is to be facilitated through
applications where possible”.
It is not necessary to facilitate public access through this site, however, a
public open space contribution should be required in accordance with Council
Policy.
“(d) The coastal area should be stabilised and made safe where
necessary”.
As discussed above, no works are currently proposed and therefore these
measures are not necessary at this point in time.
“(e) The use or development should be coastal dependent and
appropriate to a coastal location”.
