Although visible above the 1.8m high Hebel boundary wall, it will not
cause a loss of views from any adjoining properties.
5.4. Maintenance of Fence
Concern is raised that the sound enclosure is erected against the existing
boundary fence which restricts the ability to access the fence for repairs and
maintenance.
� Comment
Maintenance of any boundary fencing behind the sound enclosure is a
civil matter between the respective property owners.
5.5. Council Approvals
Concern is raised that the Hebel fence was erected without Council approval
and that in light of Council’s subsequent inspections it was assumed approval
had been granted. If it were known that the structure was not approved, the
noise complaints would have been raised earlier.
� Comment
When the development was brought to Council’s attention, the owner
was advised that the enclosure for the swimming pool heat pump
required a Planning Permit. Retrospective approval is now sought to
enable completion of the enclosure and also to remedy the noise
impacts on adjoining residential properties.
6. STATE POLICIES AND ACT OBJECTIVES
6.1. The proposal is consistent with the outcomes of the State Policies, including
those of the State Coastal Policy.
6.2. The proposal is consistent with the objectives of Schedule 1 of LUPAA.
7. COUNCIL STRATEGIC PLAN/POLICY IMPLICATIONS
There are no inconsistencies with Council’s adopted Strategic Plan 2010-2015 or any
other relevant Council Policy.
