Council’s assessment of this proposal should also consider the issues raised in any representations received, the outcomes of the State Policies and the Objectives of Schedule 1 of the Land Use Planning and Approvals Act, 1993 (LUPAA). 3. PROPOSAL IN DETAIL 3.1. The Site The site is 617m 2 in area and is located on the northern side of Tanundal Street, from which all access is obtained. The site currently contains a single dwelling with a covered swimming pool at the rear. The pool operates as a commercial swim centre providing private and group tuition to adults, babies, children and juniors. The pool is heated by a heat pump located in the northwestern rear corner of the property. 3.2. The Proposal The existing heat pump is 1.198m in height above natural ground level. The proposal is for the construction of an enclosure made of sound reducing materials including a Hebel wall, 2.56m in length along the northern rear boundary, 6.3m in length along the western side boundary and a maximum height of 2.3m to the truss peak. In accordance with the recommendations of an acoustic specialist, additional housing constructed of noise reducing materials would be built directly around the heat pump. The maximum height of the structure would be a chimney 2.7m above natural ground level. 4. PLANNING ASSESSMENT 4.1. Planning Policy Framework [Section 2] The relevant elements of the Planning Policy Framework are contained in Section 2.2.3 (a) (i) – Residential Land Use. In particular, a Key Objective includes protecting the safety and amenity of residential areas adjacent to sensitive or conflicting land uses and environments.

General Decision Requirements [Section 3.3.1] The relevant General Decision Requirements of this part are as follows. “(a) General requirements: (iii) The Planning Policy Framework; (iv) The Purposes of the Zone; (v) The Specific Decision requirements of the Zone, Overlay or Specific Provision; (vii) Any representation made in accordance with Section 43F(5) or Section 57(5) of the Act. (b) Amenity Requirements: (ii) Any pollution arising from the site in terms of noise, fumes, smell, smoke or ventilation”. Reference to these principles is also contained in the discussion below. 4.3. Residential Zone The subject site is zoned Residential under the Scheme. The purpose of the Residential zone includes allowing for a limited range of community and other non-residential uses to serve local community needs. Active Recreation is a Discretionary use in this zone. � Use and Development Standards Clause 6.1.3 provides Use and Development Standards against which all Development Applications within the zone must be assessed. Compliance with these standards is summarised at Table 1 below.
