1.1 Function <strong>and</strong> Reporting m<strong>and</strong>ate <strong>of</strong> CAG<br />

1.1.1 CAG <strong>report</strong>ing m<strong>and</strong>ate<br />

Article 143 (4) <strong>of</strong> <strong>the</strong> Constitution <strong>of</strong> <strong>the</strong> URT <strong>of</strong> 1977<br />

requires <strong>the</strong> Controller <strong>and</strong> Auditor General to submit <strong>the</strong><br />

CAG’s annual <strong>report</strong>s to <strong>the</strong> President <strong>of</strong> <strong>the</strong> URT by 31 st<br />

March. Upon receipt <strong>of</strong> such <strong>report</strong>s <strong>the</strong> President shall<br />

direct <strong>the</strong> persons concerned to submit those <strong>report</strong>s<br />

before <strong>the</strong> first sitting <strong>of</strong> <strong>the</strong> National Assembly which<br />

shall be held after <strong>the</strong> President has received <strong>the</strong> <strong>report</strong>s<br />

<strong>and</strong> it shall have to be submitted to such a sitting before<br />

<strong>the</strong> expiration <strong>of</strong> seven days from <strong>the</strong> day <strong>the</strong> sitting <strong>of</strong><br />

<strong>the</strong> National Assembly began. If <strong>the</strong> President does not<br />

take steps <strong>of</strong> submitting such <strong>report</strong>s to <strong>the</strong> National<br />

Assembly, <strong>the</strong>n <strong>the</strong> Controller <strong>and</strong> Auditor General shall<br />

submit such <strong>report</strong>s to <strong>the</strong> Speaker <strong>of</strong> <strong>the</strong> National<br />

Assembly (or <strong>the</strong> Deputy Speaker if <strong>the</strong> <strong>of</strong>fice <strong>of</strong> <strong>the</strong><br />

Speaker is vacant <strong>the</strong>n, or if for any reasons <strong>the</strong> Speaker<br />

is unable to perform <strong>the</strong> functions <strong>of</strong> his <strong>of</strong>fice) who shall<br />

submit <strong>the</strong> <strong>report</strong> to <strong>the</strong> National Assembly.<br />

1.1.2 Audit m<strong>and</strong>ate<br />

The Controller <strong>and</strong> Auditor General is m<strong>and</strong>ated to<br />

conduct both financial <strong>and</strong> performance audits <strong>of</strong> public<br />

accounts (both Central <strong>and</strong> Local) including <strong>the</strong> audit <strong>of</strong><br />

<strong>the</strong> financial statements <strong>of</strong> all Public Authorities <strong>and</strong><br />

o<strong>the</strong>r Bodies as defined in Section 37 <strong>of</strong> <strong>the</strong> Public<br />

Finance Act No. 6 <strong>of</strong> 2001 (revised 2004) ammended by<br />

<strong>the</strong> Public Audit Act No. 11 <strong>of</strong> 2008. The Office is also<br />

empowered to conduct special audits <strong>and</strong> audit<br />

investigations when required to do so as per <strong>the</strong> Public<br />

Finance Act No. 6 <strong>of</strong> 2001 (revised 2004) as ammended by<br />

<strong>the</strong> Public Audit Act, No. 11 <strong>of</strong> 2008 Section 36(1) which<br />

empowers <strong>the</strong> Controller <strong>and</strong> Auditor General to make<br />

recommendations for <strong>the</strong> purpose <strong>of</strong>:-<br />
