10.3 Weak management <strong>of</strong> employment contracts<br />
According to provisions <strong>of</strong> section 15 <strong>of</strong> Employment <strong>and</strong><br />
Labor Act No. 6 <strong>of</strong> 2004; employers are required to prepare<br />
<strong>and</strong> provide employees written contracts which should<br />
include <strong>the</strong> following information upon recruitment.<br />
• name, age, permanent address <strong>and</strong> sex <strong>of</strong> <strong>the</strong><br />
employee,<br />
• place <strong>of</strong> recruitment,<br />
• job description,<br />
• date <strong>of</strong> commencement,<br />
• form <strong>and</strong> duration <strong>of</strong> contract,<br />
• place <strong>of</strong> work,<br />
• hours <strong>of</strong> work,<br />
• remuneration <strong>and</strong> method <strong>of</strong> calculation, <strong>and</strong><br />
details <strong>of</strong> any benefits or payments in-kind.<br />
However, during <strong>the</strong> year under review some <strong>of</strong> <strong>the</strong> Public<br />
Authorities were found to have no employment contracts<br />
with <strong>the</strong>ir employees. In addition, for o<strong>the</strong>r organizations<br />
<strong>the</strong> employee-employer contracts are incomplete. These<br />
lapses have negative results to such organizations in any<br />
case <strong>of</strong> legal matters.<br />
S/No Auditee Weakness observed<br />
1. TPA During <strong>the</strong> financial year ended 30 th June<br />
2008 TPA recruited 127 staff for <strong>the</strong><br />
contract periods <strong>of</strong> less than six (6) <strong>and</strong><br />
three (3) years.<br />
However, all new contracts were not<br />
supported with written document from<br />
concerned employees (as required by<br />
internal directives) explaining <strong>the</strong>ir<br />
intention to continue with employment.<br />
This contradicts with Part B <strong>of</strong> <strong>the</strong> staff<br />
regulation manual.<br />
2. TBC TBC appointed one senior <strong>of</strong>ficer<br />
(management level) since December 2006<br />
