9.2.6 Dispute on Plot no. 250 block ‘T’ Kenyata Road Mwanza<br />
City - NSSF<br />
The National Social Security Fund (NSSF) acquired a plot<br />
no. 250 block ‘T’ on 10 th September 2005 from Kassim<br />
Omari <strong>of</strong> P.O.Box 327 Mwanza as an extension to <strong>the</strong> main<br />
plot no. 254 block “T” for building <strong>the</strong> NSSF Commercial<br />
Complex in Mwanza. Audit noted that before compensating<br />
<strong>the</strong> owner, NSSF commissioned Mwanza City Council to<br />
determine <strong>the</strong> market value <strong>of</strong> <strong>the</strong> plot whereby <strong>the</strong> l<strong>and</strong><br />
valuer estimated <strong>the</strong> value <strong>of</strong> <strong>the</strong> properties on plot No.<br />
250 to be Shs.29,800,000. Mr. Kassim Omari claimed<br />
additional expenses incurred in development <strong>of</strong> <strong>the</strong> same<br />
plot amounting to Shs. 14,000,000 <strong>and</strong> <strong>the</strong> fund agreed <strong>and</strong><br />
finally compensated him Shs. 43,800,000 on 10 th September<br />
2005 without signing any agreement or putting any<br />
documentation evidence in that regard.<br />
After almost three years, Mr. Kassimu Omari raised a claim<br />
on 18 th March 2008 dem<strong>and</strong>ing that he was just<br />
compensated a part <strong>of</strong> l<strong>and</strong> by <strong>the</strong> Fund <strong>and</strong> not <strong>the</strong> whole<br />
plot <strong>and</strong> <strong>the</strong> Fund asked <strong>the</strong> city council to value <strong>the</strong><br />
remainder <strong>of</strong> Kassimu’s plot but <strong>the</strong> city disagreed stating<br />
that it had already done so. Thereafter <strong>the</strong> parties have<br />
