(a) Tender Evaluation Documents<br />
We could not obtain <strong>the</strong> original evaluation <strong>report</strong> as<br />
it was stated that <strong>the</strong> same was in possession <strong>of</strong><br />
Prevention <strong>and</strong> Combating Corruption Bureau<br />
(PCCB). Though photo copy <strong>of</strong> <strong>the</strong> <strong>report</strong> was<br />
available, it was not dated hence we could not<br />
ascertain whe<strong>the</strong>r <strong>the</strong> evaluation was done as<br />
required by section 33 <strong>of</strong> <strong>the</strong> Public Procurement Act<br />
<strong>of</strong> 2004.<br />
(b) Tender Evaluation Committee<br />
Evaluation <strong>of</strong> <strong>the</strong> tender was done by six members in<br />
<strong>the</strong> evaluation committee contrary to Regulation 90<br />
(1) <strong>of</strong> <strong>the</strong> Procurement Act <strong>of</strong> 2004 which requires<br />
<strong>the</strong> procuring entity to establish <strong>the</strong> evaluation<br />
committee comprising <strong>of</strong> not less than three <strong>and</strong> not<br />
more team than five members.<br />
Fur<strong>the</strong>r, <strong>the</strong> evaluation committee was appointed by<br />
Director <strong>of</strong> Human Resources <strong>and</strong> Administration<br />
ra<strong>the</strong>r than being recommended by Procurement<br />
Management Unit <strong>and</strong> approved by <strong>the</strong> Chief<br />
Executive Officer as per section 33(e) <strong>of</strong> <strong>the</strong> Public<br />
Procurement Act <strong>of</strong> 2004.<br />
(c) Opening Ceremony Register <strong>and</strong> Bidder Documents<br />
Opening ceremony register signed by both Fund’s<br />
representative <strong>and</strong> bidders` representatives which is<br />
a binding document for read out prices was not<br />
availed to us despite several requests made by<br />
auditors. Fur<strong>the</strong>r, Original bid documents could not<br />
be read since <strong>the</strong>y were destroyed apparently by<br />
water.<br />
Therefore, some <strong>of</strong> <strong>the</strong> important information<br />
contained <strong>the</strong>rein, such as bidders’ names <strong>and</strong> <strong>the</strong><br />
corresponding prices could not be established. The<br />
fund contravenes regulation 19 (5) G.N. 97 which<br />
