were no significant changes to <strong>the</strong> two technical proposals<br />

between <strong>the</strong> initial tender <strong>and</strong> <strong>the</strong> re-tender. In <strong>the</strong> retender<br />

document two consultants from <strong>the</strong> awarded<br />

company misrepresented that <strong>the</strong>y have worked with <strong>the</strong><br />

firm for more than 12 months, which to a large extent<br />

improved <strong>the</strong>ir score. Also it was noted that <strong>the</strong> Principal<br />

Consultant <strong>of</strong> awarded company is a member <strong>of</strong> <strong>the</strong> TCRA<br />

Review Panel <strong>and</strong> this was not disclosed in <strong>the</strong> proposal<br />

stage apart from a comment from one tender board<br />

member. This was not reviewed to establish whe<strong>the</strong>r or not<br />

a conflict <strong>of</strong> interest exists <strong>and</strong> declaration to that effect<br />

had not been done. We consider <strong>the</strong> tender process to lack<br />

openness, transparency <strong>and</strong> equality among players in<br />

procurement which conclusively caused gross violation <strong>of</strong><br />

Public Procurement Act, 2004 <strong>and</strong> its regulations which<br />

require responsible authority to conduct an independent<br />

investigate on <strong>the</strong> tender <strong>and</strong> take appropriate action.<br />

7.2.2 National Social Security Fund (NSSF)<br />

Questionable procurement <strong>of</strong> security services from<br />

Alliance Day <strong>and</strong> Night Ltd.<br />

During <strong>the</strong> year under audit, <strong>the</strong> Fund procured security<br />

services for guarding its <strong>of</strong>fices <strong>and</strong> estates country wide.<br />

The result <strong>of</strong> evaluation committee submitted to <strong>the</strong><br />

tender board meeting held on 13 th August, 2007 proposed<br />

<strong>the</strong> winners for <strong>the</strong> lots that Alliance security bided as<br />

detailed in <strong>the</strong> table below:-<br />
