PPRA on <strong>the</strong> composition <strong>of</strong> <strong>the</strong> tender boards was not done<br />

as required by law, <strong>general</strong> procurement notice were not<br />

published <strong>and</strong> o<strong>the</strong>r procurement related gaps as detailed<br />

below:<br />

7.1 General Observation<br />

7.1.1 Lack <strong>of</strong> procurement management unit<br />

Section 34 <strong>of</strong> <strong>the</strong> Public Procurement Act, 2004 requires<br />

<strong>the</strong> procuring entity to establish Procurement Management<br />

Unit staffed to an appropriate level. Study on <strong>the</strong><br />

compliance with <strong>the</strong> above provision has revealed<br />

significant weaknesses whereby Chief Executive Officers <strong>of</strong><br />

Public Authorities have not been able to establish <strong>the</strong> units<br />

as per requirement <strong>of</strong> <strong>the</strong> law. Detailed analysis <strong>of</strong> <strong>the</strong><br />

findings for selected entities can be provided in <strong>the</strong> table<br />

below:<br />

7.1.2 Lack <strong>of</strong> <strong>Annual</strong> procurement plans<br />

Section 45 <strong>of</strong> <strong>the</strong> procurement Act, 2004 a procuring entity<br />

is required to plan its procurement in a rational manner<br />

<strong>and</strong> in particular to avoid emergency procurement,<br />

aggregate its procurement requirements whatever possible<br />

both within <strong>the</strong> procuring entity to obtain value for money.<br />

Also procuring entities are required to reduce procurement<br />

costs <strong>and</strong> avoid splitting <strong>of</strong> procurement to defeat <strong>the</strong> use<br />
