L (•ii REGULAR BOARD HEETING HARCH 17, 1993 TOHN HALL 7:30 P.M. Supervisor Kennedy thanked Mr. Gliwa for the work he put into his study of this situation. Michael Reilly, 7697 Kevin Dr.: Once the letter of withdrawal comes in from Carol Seamon is there any chance that this could be resurrected in some form at a later date? Town Attorney Perley: zoning request. He can't prevent anybody from filing a Supervisor Kennedy: He can't say absolutely not. However, under the circumstances with the reports that we have had there is no way that this could be resurrected. I feel that the study we have received is going to be a very valuable study to the people that already have existing wells on that particular hill. Hith this study we know more now about that particular area than we have ever known before and this will be a benefit to the town. Supervisor Kennedy hearing no further comments from the floor asked that the Public Hearing be closed. A motion was made by Supervisor Kennedy and seconded by Councilmari Wittmeyer to close the Public Hearing at 8:19 P.M. five (5) Ayes Carried A motion was made by Supervisor Kennedy and seconded by Councilmari Zimmermari not to take any action on the Seamon Rezoning Application and that we await the official documentation froni the Seamon's withdrawing. If a withdrawal request is not received by that time we will act on the application at the next regular meeting on April 7, 1993. five (5) Ayes Carried Received from Barbara Ballachino, Chairperson of the Triquasquicentennial Celebration a report on the Celebration activities along with a copy of the Treasurer's Financial Report dated 3-27-91 through 1-20-93, on file in the Town Clerk's Office. Supervisor Kennedy asked Councilman FloWers to act as liaison between the Tri-Q Committee and the Town Board to determine the future of the Tri-Q Committee. Letter received from the Patchin Volunteer Fire Company requesting permission to use the Lion's Shelter on July 25, 1993, for 20 Week Club Party. A motion was made by Councilman Wohlhueter and seconded by Councilman Wittmeyer to grant permission to the Patchin Volunteer Fire Company to use the Lion's Club Shelter on July 25, 1993 for their 20 Week Club Party contingent upon Insurance Coverage. Permission to serve beer also. five (5) Ayes Carried Letter received from Tony Staub request permission to use the Lion's Shelter for Softball Picnic on Saturday, July 17, 1993. A motion was made by Supervisor Kennedy and seconded by Councilmari Wittmeyer to grarit permission to the Town of Boston Softball League to use the Lion's Shelter on July 17, 1993 for a picnic from 9:00 A.M.until 3:00 P.M. five (5) Ayes Carried ^M^yyy-'y' the U^#. ~1 II I '' J
REGULAR BOARD MEETING MARCH 17, 1993 TOWN HALL 7:30 P.M. Soil Permit requests received from R.J.Smolinski to removed soil from the following properties: Martin & Mildred Logel Joseph Simmeth 7784 Boston State <strong>Road</strong> 8010 Bostoh State <strong>Road</strong> Supervisor Kennedy asked that these permit applications be deferred until the next Regular Meeting on April 7, 1993 to give the Deputy Supervisor and Code Enforcement Officer and opportunity to review these sites. A motion was made by Supervisor Kennedy and seconded by Councilman Flowers to table the Gregory Gerwitz building application tabled from the March-3, 1993 meeting, till the April 7, 1993 meeting pending receipt of documehtation previously requested. five (5) Ayes Carried A motiori was made by Supervisor Kennedy and seconded by Councilman Wittmeyer to issue a Mobile Home Park License to the Sprague Mobile Home Park which will expire June 30, 1993. Mr. Sprague must be informed that upon the issuance of this license the fire lanes must be kept opened effectively or a penalty will be applied. five (5) Ayes SUPERVISOR'S REPORT Carried A) Supervisor's Honthly Financial Report for February 1993 received and on file in the Town Clerk's Office. Supervisor Kennedy read a letter directed to the Town Board Hembers as follows: Perhaps some of you already know that I have retired from Ford Motor Company. Under the provisions of the Ford contract workers who are retired or limited to maximum earnings of $15,000.00 per year during retirement without incurring a penalty. Since the yearly salary of the Town Supervisor is $20,500.00 under the approved 1993 Budget the Ford Retirement Board has indicated that I cannot accept the total salary allocated for this position. I, therefore, propose that I resign my elected position as the Town of Boston Supervisor effective Monday, April 5, 1993 at midnight and I would request that the Board reappoint me for the balance of my term which would expire on December 31, 1993 at the regular scheduled Town Board Heeting to be held on April 7, 1993 at 7:30 P.H. At the end of the normal pay perioti which concludes on April 6, 1993, the Supervisor will have received $5,519.22 out of the Budget approved salary of $20,500.00. I propose that a new reduced salary be established at $9,480.78 for the balance of 1993 instead of the $14,980.78 Which will remain in the ajpproved Supervisor Salary in the Town Budget. The remaining $5,500.00 would then be available to transfer to another Town account. It is my suggestion that this balance of $5,500.00 be reappropriated to be used by the Boston Free Library to reduce the cost of resurfacing the driveway and the parking area to make it handicapped assessable. This action on the part of the Town Board will allow me also the opportunity to retire under the New York State Pension System.
