\ TUWN-OT- BTTblUN RESOLUTION 19^3 .1 At a Regular Meeting of the Town Board ot the Town or Boston, Erie County, New York held at the Boston Town Hall, 8500 Boston State Road, Boston, New York, on the 17th day of March 1991 at 7:30 P.M. Eastern Standard Time, there were PRESENT: Richard L. Kennedy Mi i ton I . Wit '-i-eyer David G. Zimmerman Don A. Wohlhueter Mark V!. Fioviers Supervisor CounciIman CounciIman CounciIman Counci ijnan CounciIman Wlttmeyer presented the following resolution and moved its adoption: WKSKSAS, drunken drivers not only present a serious threat to the health and safety of a community and its citizens, but also require substantial expenditure of municipal funds to combat this crime; and ViHSREAS. the Town of Boston, like most towns, villages and cities in New York State must now budget :for the arrest, processing and trial ot people arrested for driving while intoxicated and driving while impaired; and WHEREAS, the cost of the arrest, processing and trial of an offender in the Town of Boston is well over S 200.00; and W.4EREAS, currently, municipalities ate reimbursed by New York State under the "Stop DKI" program for only 50% of these costs; and WHEREAS, in the Town of Boston the financial cost to the municipal budget of dealing with drunken drivers was over $12,000.00 in 1992; and WHEREAS, responsible drivers should not be called upon to subsidize the action of the irresponsible; HOW, THEREFORE, BE IT RESOLVED, that in order to deter the crime of drunken driving, the Town of Boston Board supports legislation in the New York State Legislature v;>;ich would ai lowlocal governments to charge people convicted of drunk driving or driving while impaired for the actual cost of their arrest, processing and trial; and be it further RESOLVED, that a copy of this resolution be sent to State Senator Dale M. Volker, State Assemblyman Francis J. n:3 REGULAR BOARD MEETING MARCH 17, 1993 At 7:45 P.M. a Public Hearing was held, First: TO rezone the Panek property on South Feddick Road from Residential-Agricultural (R/A) to Residential (R-1). Second: To consider the motion made by the Town Board of the Town of Boston on the 17th day of February 1993 to rezorie ariy or all of the followirig described property situated on the east side of South Feddick Road in the Town of Boston from Resideritial Agricultural (R/A) to Residential (R-1). Town Clerk Shenk read the Public Notice and the following corresponderice relating to the Public Hearing on the proposed rezoning: Recommeridatiori from the Plannirig Board. Letter of iritent received from Chester Panek. Town Clerk Shenk also, stated that notices had been sent to thirty-two (32) neighboring property owners. Supervisor Kennedy Convened the Public Hearirig. Councilman Flowers: There is a strip fifty (50') feet wide between Panek's and Philip's, is this an easement? Chester Panek: That is an easement with Tennessee Gas.
