RESOLUTION 19^3 .1<br />

At a Regular Meeting of the Town Board ot the Town or<br />

Boston, Erie County, New York held at the Boston Town Hall,<br />

8500 Boston State <strong>Road</strong>, Boston, New York, on the 17th day of<br />

March 1991 at 7:30 P.M. Eastern Standard Time, there were<br />

CounciIman Wlttmeyer presented the following resolution and<br />

moved its adoption:<br />

WKSKSAS, drunken drivers not only present a serious threat<br />

to the health and safety of a community and its citizens, but<br />

also require substantial expenditure of municipal funds to<br />

combat this crime; and<br />

ViHSREAS. the Town of Boston, like most towns, villages and<br />

cities in New York State must now budget :for the arrest,<br />

processing and trial ot people arrested for driving while<br />

intoxicated and driving while impaired; and<br />

WHEREAS, the cost of the arrest, processing and trial of an<br />

offender in the Town of Boston is well over S 200.00; and<br />

W.4EREAS, currently, municipalities ate reimbursed by New<br />

York State under the "Stop DKI" program for only 50% of these<br />

costs; and<br />

WHEREAS, in the Town of Boston the financial cost to the<br />

municipal budget of dealing with drunken drivers was over<br />

$12,000.00 in 1992; and<br />

WHEREAS, responsible drivers should not be called upon to<br />

subsidize the action of the irresponsible;<br />

HOW, THEREFORE, BE IT RESOLVED, that in order to deter the<br />

crime of drunken driving, the Town of Boston Board supports<br />

legislation in the New York State Legislature v;>;ich would ai lowlocal<br />

governments to charge people convicted of drunk driving or<br />

driving while impaired for the actual cost of their arrest,<br />

processing and trial; and be it further<br />

RESOLVED, that a copy of this resolution be sent to State<br />

Senator Dale M. Volker, State Assemblyman Francis J. Pordum,<br />

Dennis Mill president of Association of Erie County Governments,<br />

and the Association of Towns of the State of New York<br />

Seconded by Councilman Wohlhueter and duly put to a vote<br />

which resulted as follows:<br />
