Wittmeyer (Deputy Supervisor), Town Attorney Michael F. Perley, Highway Superintendent Eugene E. Ruchalski. Absent: Supervisor Richard L. Kennedy In Supervisor Kennedy absence Deputy Supervisor Wittmeyer will chair the meeting. A motion was made by Council Wittmeyer and seconded by Councilman Flowers to accept t;he correction and adoption of the minutes of the February 17, 1993 Regular Monthly Meeting. four (4) Ayes Carried ^ A motion was made by Councilman Wohlhueter and seconded by S^''^ jCuj''' Councilman Zimmerman that the General Fund and Special District (^y ,,u Bills on Abstract #3 dated March 3, 1993 in the amount of 1-''^ c*- •" ' ^..--~-. . $13,908.31 be paid, four (4) Ayes Carried A motion was made by Councilman Wittmeyer and seconded by Councilman Zimmerman that the Highway Bills on Abstract #3 dated March 3, 1993 in the amount of $31,620.96 be paid. four (4) Ayes Carried A motion was made by Councilman Wittmeyer and seconded by Councilman Flowers to accept the Town Clerk's Monthly Report for February 1993. four (4) Ayes Carried Letter received from Dale M. Volker, N.Y. State Senate and a letter from Francis J. Pordum, N.Y. State Assembly acknowledging receipt of the Towns request for Community Development consideration to expand the Community Room in the Town Hall, received and on file in the Clerk's Office. Deputy Supervisor Wittmeyer commented the Capital Improvements Committee is working with Pordum, Volker, and our Grants Consultant on this project. Letters received Francis J. Pordum, N.Y. State Assembly acknowledging receipt of letters received concerning the Governor's proposal to open the "Locked Box" of the dedicated highway fund and the Governor's proposal to eliminate the Environmental Conservation's Bureau of Mineral Resources, Division of Oil and Gas on file in the Clerk's Office. Received Notice from NYSDEC regarding Kiatone Pipeline Corporations proposal to install sixty-five (65) miles of sixteen (16) inch diameter crude oil transport pipeline in New York State, from its existing storage facility in West Seneca, Erie County to the New York/Pennsylvania border in the Town of South Valley, Cattaraugus County. Public hearings on this application will be held at Gowanda Volunteer Fire Company 7:00 P.M. March 9, 1993 and also at Seneca Hose Fire Company 7:00 P.M. Harch 10, 1993 for anyone who is interested in attending on file in the Clerk's Office. Letter received from Joseph G. L REGULAR BOARD MEETING MARCH 3, 1993 TOWN HALL 7:30 P.M. regarding Hillcroft Drive Bridge 707 of Eighteen Mile Creek. The County will apply to N.Y.S.D.E.C. and Corp. of Engineers for a permit to install rip-rap received and on file in the Clerk's Office. Deputy Supervisor Hittmeyer commented the town will work with the county jointly on this project. Letter received from Charles A. Sickler, P.E. Supervisor of Design, Erie County Department of Public Works, Division of Highways acknowledging receipt of letter regarding Site Plan changes, Boston State Road, Boston Hills Estate, North Road Entrance on file in the Clerk's Office. Deputy Supervisor Wittmeyer asked John Falkides if he would like to comment on this letter and he declined comment, stating that he intended to close the north road. Deputy Supervisor Wittmeyer acknowledged that Tom O'Boyle a representative from County Legislature Marshall's Office was present and invited him to speak from the floor. Tom O'Boyle acknowledge that County Legislature Marshall had received the Town's letters of February 18, 1993 regarding the condition of the Boston State Road and Mr. Marshall turned them over to the proper authorities. A motion was made by Councilman Zimmerman and seconded by Councilman Wohlhueter to approve a "Temporary Certificate of Occupancy" for lot ffl7 in the Boston Hills Estates Mobile Home Community. four (4) Ayes Carried Letter received from Highway Superintendent Ruchalski regarding the turn over of Roads by Erie County. Superintendent Ruchalski asked that if the Town is approached by Erie County people regarding possible turn over to contact him before taking any action. Town Attorney Perley suggested to Superintendent Ruchalski and other Highway Superintendents that before submitting specifications to the County that they present them to each of the Town Boards for their review and comment. Letter received from Mel & Louise Schmidt, 7730 Wohlhueter Road commending the Boston Highway Superintendent and his crew for the outstanding job they do on the winter roads. Letter of appreciation from Eileen Dziob 5622 Northside Drive, thanking and commending the drivers who plow the Creekside Subdivision in North Boston. Letter received from Angelo Bellitiere, 8406 Zimmerman Road opposing the proposed water tank for Water District #1. It is his recommendation that a larger water tank or tower be considered to benefit both Water District #1 and water District #2. Letter on file in the Clerk's Office. Town Attorney Perley commented that these are two different types of projects with two different types of problems and they cannot be affectively addressed with one tank. Unfortunately, the project that we are looking at Water District #2 and beyond it has a cost of about 1.3 million dollars, with the pump station, the lank and the fact that twelve (12") inch main in order to get a system on line that will actually provide the _J
