Supervisor Kennedy: Andrew Forestal would you answer that<br />

question please?<br />

Andrew Forestal, Cold Spring Construction: There la six hund'-fed<br />

teet (600') or existing Pfarner Head ort the contract that wouiu<br />

be utilized by tnese trucxs. He cola Spring Construction wiii<br />

fix that road to tne liking of the Tovm Board and the Town<br />

Highway Superintendent.<br />

Mark Hisher: I too, am concerned about the water. I have, just<br />

over a gallon an hour recovery rate. I agree any Kind of<br />

blasting that should happen. Nobody can guarantee that tne weil<br />

is not going to go bad. Although 1 may not be directly artected<br />

by this, 1 am not tnat far irom it. I am very concerned.<br />

Another thing that concerns me, I Know the mining permit is good<br />

for this project only. You can still take out a thousatid<br />

11.000) ton of gravel without getting a mining permit. Now.<br />

should this pond maybe not hold water or should plans change and<br />

somebody does not want to build there now. Does that allow them<br />

to go in there and continue to take out the tnousana (1,'JOO) ton<br />

of fill every year?<br />

Supervisor Kennedy: I would have to ask the Code Enforcement<br />

Officer. I don't thinK you can take out over six hundred (600)<br />

cubic yards.<br />

Town Attorriey Perley: It depends on what is being taken out. \^<br />

Whether it is gravel, stone, topsoil, etc. There are different<br />

requirements from D.E.C. The D.E.C. doesn't have restriction<br />

over mining or wnat is defined as mining. Trie Town has a law<br />

that requires a permit to excavate snort of wnat t.he D.E.c.<br />

threshold is for a mine. You have to come to the town to get a<br />

permit tnen.<br />

Hark Hisher: I don't vjant to deny anybody from putting a pond<br />

lu. I thinx tney are great. Yes. it does bring in different<br />

habitat and everytning. A lot has been said about this pond.<br />

Tnat is not the issue here. Tne issue is taking of tnree<br />

hundred thousand (300.000) cubic yards or earth. You have to<br />

leave a hole there when you do that. 1 saw a map like this<br />

about a year and a naif ago with the Rice <strong>Road</strong> project and<br />

everything looks nice now but. Drive up there nov; while tne<br />

stumps are still there and see what we once had, which is<br />

forever gone. I can't help but believe that this could possibly<br />

turn into tha same thing. Thank you.<br />

Robert Buyer, 6426 Pfarner <strong>Road</strong>: Hy family has owned property<br />

at 6426 Pfarner <strong>Road</strong> for thirty (30) years. He nave two (2)<br />

homes on that property and they are all dependent upon a single<br />

well that we hold by easement. Hhen I first heard o£ this plan \m<br />

1 called my friend Dick Forestal of the Cold Springs<br />

Construction Company and toid him ot my concern. Dick Forestal<br />

and his family and tne Cold Spring Construction Company are<br />

tirst operators. Tney are good engineers, they are good<br />

business people, these people nave integrity. Dick and Andy<br />

came out last week and we walked over the property. He spotted<br />

tne well. He spotted the ravine. I told them of my concern.<br />

Dick and Andy said to me "I aon't think that your well is going<br />

to be troubled, l don't thin/, so." He mentioned the ravine arid<br />

the deptn just as the engineer has said. And tney aon't tnir;.':<br />

that It would nappen. That the weii would be rotnerecl. H^^i<br />
