A -1 J REGULAR BOARD MEETING FEBRUARY 3, 1993 TOWN HALL 7:30 P.M. Present were Councilman Mark H. Flowers, Councilman Don A. Hohlhueter, Councilman Milton I. Wittmeyer, Councilman David G. Zimmerman, Supervisor Richard L. Kennedy, Town Attorney Michael F. Perley, Highuay Superintendent Eugene Ruchalski. A motion was raade by Councilman Hittmeyer and seconded by Supervisor Kennedy to accept the correction and adoption of the minutes of the January 20, 1993, Regular Monthly Meeting. five (5) Ayes Carried A motion was made by Councilman Zimmerman and seconded by Councilman Flowers that the General Fund and Special District Bills on Abstract #2, dated February 3, 1993 in the amount of $10,198.19 be paid. five (5) Ayes Carried A motion was made by Supervisor Kennedy and seconded by Councilman Wohlhueter that the Highway Bills on Abstract S2, dated February 3, 1993 in the amount of $47,699.63 be paid. five (5) Ayes Carried A motion was made by Councilman Zimmerman and seconded by Councilman Hittmeyer to accept the Town Clerk's Annual Report for the Year 1992. five (5) Ayes Carried Resolution received from the Town of Amherst, re: Community Prevention Network received and on file in the Town Clerk's office. RESOLUTION - 1993-3 COMMUNITY PREVENTION NETWORK OP WNY Letter received from Mario M. Cubmo, Governor, State of New York, re: Fiscal Policies for 1993, stating that he will propose legislation which would give local governments the option of switching from real property taxes to local income taxes as a fairer way of paying for their schools. And also, a commitment to no, "new unfunded mandates in the coming year," and more. Received and on file in the Town Clerk's Office. A motion was made by Supervisor Kennedy and seconded by Councilman Wittmeyer authorizing Highway Superintendent Ruchalski to spend Town Highway Funds as set forth on Form AC 984 "Agreement for the Expenditure of Highway Moneys" five (5) Ayes Carried Letter received from Erie County Water Authority, re: Hydrant Billings rate increase. Hydrants in District Town lines District #1 and District Townlines District #2 received and on file in the Town Clerk's office. RESOLUTION 1993-4 COMMUNITY BLOCK GRANT PROJECT A motion was made by Councilman Wohlhueter and seconded by Councilman Flowers to appoint Len Souliere as Recreation Supervisor in charge of the Youth Baseball and Softball programs. Salary is $1100.00 per year with two (2) payments ot $550.00 one (1) at the end of June and the other at the end of September. This appointment will be effective immediately and expire on December 31, 1993. five (5) Ayes Carried J y
L REGULAR BOARD HEETING FEBRUARY 3, 1993 TOHN HALL 7:30 P.M. A motion was made by Supervisor Kennedy and seconded by Councilman Hohlhueter to table the awarding of the Ambulance Garage Bids until the next Regular Board Meeting on February 17, 1993, to allow the Town Engineer an opportunity to review all the bids. five (5) Ayes Carried Q On January 23, 1993, an inspection of Sprague Mobile Home Park was made by Supervisor Kennedy, Councilman Wittmeyer, Councilman Hohlhueter, councilman Flowers, Code Enforcement Officer Kramer and the Maintenance Person assigned to the Park. A number of items were found in violation of the Town Mobile Court Law. A copy of the report was mailed to Mr. Sprague advising that the Town Board members are in agreement and unless and until we receive assurance that a program of clean-up and change has begun we will not issue a renewal license for the Court and will proceed to explore legal action necessary to promote improvements. To date we have not received a response from Mr. Sprague. Supervisor Kennedy directed Town Clerk Shenk to send a copy_pf the report and letter by certified mail advising Mr. Sprague that we withhold the granting of a license. And if we do not hear from Mr. Sprague by March 1, 1993, he will ask the Town Attorney to start to prepare notification to the residents of the Park that Mr. Sprague does not have a licensed park and whatever remedial action is taken after that depends on the ordinance and the law. A motion Was made by Supervisor Kennedy and seconded by Councilman Hittmeyer to give Mr. Sprague of Sprague Mobile Home Park until March 3, 1993 to respond to the Town Board so that we can determine whether or not he intends to address a number of problems that exist in the Park and, if not at that time appropriate action will be taken. five (5) Ayes Carried A motion was made by Councilman Wohlhueter ahd seconded by Supervisor Kennedy to accept the fee of $622.50 for 97 homes and grant a Mobile Home Park License to Mr. 8. Mrs. John Falkides, Boston Hills Homes & Estates, effective January 1, 1993 to expire June 30, 1993. five (5) Ayes RESOLUTION 1993-5 Carried REFUSE & GARBAGE LICENSE - C.I.D. A motion was made by Councilman Wohlhueter and seconded by Councilman Flowers to grant permission to the Boston Baseball Association to use the Lion's Shelter and Baseball Diamonds on Saturday, July 31, 1992 for the Annual Baseball Picnic and All Star Games from 8:00 A.M. till dusk. five (5) Aye SUPERVISOR'S REPORT Carried A) Supervisor's Financial Report for January 1993 received and on file in the Town Clerk's office. Supervisor Kennedy reported on a meeting held with Mr. Gugino, Deputy Commissioner, Erie County Division of Public Works. At that time they examined the situation that exists at the Hillcroft bridge.
