2. Less need to transfer cases out of the jurisdiction<br />

where one justice may know the party and<br />

have to disqualify himself or herself.<br />

3. Judges can coordinate vacations so that the<br />

Town is less likely to be without a Town Justice<br />

available.<br />

4. If a judge should become ill, the other judge<br />

would be able to cover, eliminating the necessity<br />

of bringing in outside judges.<br />

WHEREAS, the Town Board has determined that there is no<br />

necessity for an increase in cost to the Town since the Court can<br />

be administered by the same number of personnel at present; and<br />

further that the Town Justice's salary will be divided in<br />

accordance with the division of the work load; and<br />

WHEREAS, the Town Board of the Town of Boston has determined<br />

that it is in the best interests of the Town of Boston to increase<br />

the number of Justices from One (1) to Two (2); and<br />

WHEREAS, the Town Board is desirous of effecting such a change<br />

prior to the next ensuing biennial Town election.<br />

NOW, THEREFORE, upon due consideration, it is<br />

RESOLVED, by the Town Board of the Town of Boston as follows:<br />

1. The number of Town Justices in the Town of<br />

Boston be and the same is increased from One<br />

(1) to Two (2) under the term of the newly<br />

created position(8) of Town Justice to commence<br />

on January 1, 1994.<br />

2. That the newly-created position of Town Justice<br />

shall be filled at the next biennial Town Election<br />

to be held in November, 1993, with the term of the<br />

newly-created Judge elected at such election, to be<br />

TWO (2) YEARS.<br />

3. That thereafter, each Town Justice shall be elected<br />

for a FOUR (4) YEAR term at the appropriate biennial Town<br />

election with the newly-created position of Town Justice<br />

being elected for a FOUR (4) Year term at the biennial<br />

election to be held in November, 1995.<br />
