REGULAR BOARD MEETING<br />

JANUARY 20, 1993<br />

TOWN HALL<br />

7:30 P.M.<br />

A motion was made by Councilman Zimmerman and seconded by<br />

councilman Wittmeyer to authorize Supervisor Kennedy to enter<br />

into a contract with Nussbaumer & Clarke, Inc. for the yearly<br />

1993 charge for the listed services at a fee of two thousand,<br />

eight hundred dollars ($2,800.00) payable quarterly in seven<br />

hundred dollar ($700.00) increments. Quarterly payments due and<br />

owing thirty (30) days of the Engineer's submittal.<br />

TOWN CLERK'S REPORT<br />

Carried<br />

A) Registrar of Vital Statistics Final Report for 1992<br />

received and on file in the Town Clerk's office.<br />

A motion was made by Councilman Zimmerman and seconded by<br />

Supervisor Kennedy to accept the Registrar of Vital Statistics<br />

Final Report for 1992.<br />

five (5) Ayes Carried<br />

Town Clerk Shenk will announce additional hours for 1993 Tax<br />

Collection at the next Town Board Meeting.<br />

TOHN JUSTICE REPORT<br />

Town Justice Annual Report for 1992 received and on file in<br />

the Town Clerk's office.<br />

A motion was made by Councilman Wittmeyer and seconded by<br />

Councilman Flowers to accept the Town Justice Annual Report for<br />

the year 1992.<br />

TOHN ATTORNEY'S REPORT<br />

Carried<br />

Letter to the Town Board from Town Justice Tills asking that the<br />

Town Board consider the creation of a second Town Justice<br />

position within the Town of Boston, was referred to the Town<br />

Attorney for review of the applicable law. Under section 60A of<br />

the Town Law there is a provision by which the Town Board may in<br />

the first instance reduce the number of Justices from the number<br />

allowed under the Town Law which is two (2) to one (1), which,<br />

in fact, it did in 1979. That same provision allows for the<br />

Town Board by Resolution to restore the position of Town Justice<br />

or create a position of Town Justice up to the amount allowed by<br />

law, by similar Resolution. Both Resolutions are subject to a<br />

Permissive Referendum.<br />
