L 2^^/V REGULAR BOARD MEETING NOVEMBER 17, 1993 TOWN HALL 7:30 P.M. On the recommendation of Town Clerk Shenk, a motion was made by Councilman Wittraeyer and seconded by Councilman Wohlhueter to appoint Karen A. Ellis as Deputy Town Clerk, term to expire 12/31/93 at a rate of $8.15/hr.. five (5) Ayes Carried A raotion was made by Supervisor Kennedy and seconded by Councilman Flowers to appoint Karen A. Ellis as Deputy Registrar of Vital Statistics, term to expire 12/31/93, no salary. five (5) Ayes TOWN ATTORNEY REPORT Carried Delivered to the Supervisor and the Town Clerk the executed contract with the amendments to the refuse district with B.F.I.. Reminded the people in attendance of his presentation to the Boston Chamber of Commerce on 11/18/93 on the formation of a Business District. COUNCILMEN REPORT Councilman Flowers announced that the Chamber of Commerce is currently working on some by-law changes and their dinner tomorrow will have Art Benson from the Route 219 Association as well as the Town Attorney. Councilman Flowers also attended the Insurance Committee meeting and noted their are several changes in the industry. Councilman Flowers announced the Southtowns Haz-Mat Team is working on a proposal to the Erie County Legislature to attain sorae of the new permit fee money that will soon be a revenue of the County. Councilman Flowers wishes everyone a happy Thanksgiving. Councilman Wittmeyer met with representatives of the three fire companies and updated their records with the benefit program. DEPUTY CODE ENFORCEHENT OFFICER REPORT A) Deputy Code Enforceraent Officer's monthly report for October 1993 received and on file in the Clerk's Office. TOWN ENGINEER REPORT A) Town Engineer's Monthly report for October 1993 received and on file in the Clerk's Office. ERIE COUNTY SHERIFF REPORT A) Erie County Sheriff's Report for October 1993 received and on file in the Clerk's office. Upon the request of Town Clerk Shenk, a motion was made by Supervisor Kennedy and seconded Councilman Flowers to allow the Town Clerk to give free copies to the newly elected Town Board members and Justice elect Maxwell to help assist in a smooth transition. five (5) Ayes Carried A motion was made by Councilman Flowers and seconded by Supervisor Kennedy to adjourn the meeting at 8:28 P.M. L ] ] REGULAR BOARD MEETING DECEMBER 1, 1993 TOWN HALL 7:30 P.M. Present were Councilman Mark W. Flowers, Councilman Don A. Wohlhueter, Councilman David G. Zimmerraan, Councilman Milton I. Wittraeyer, Supervisor Richard L. Kennedy, Town Attorney Michael F. Perley, and Highway Superintendent Eugene E. Ruchalski. A raotion was made by Councilman Zimmerman and seconded by Councilraan Wittmeyer to accept the correction and adoption of the rainutes of the November 17, 1993 Regular Board Meeting. five (5) Ayes Carried A motion was made by Councilman Wohlhueter and seconded by Councilmaii Zimmerman that the General Fund and Special District Bills on Abstract #12 dated December 1, 1993 in the araount of $5,918.63 be paid. five (5) Ayes Carried A raotion was made by Councilman Wittmeyer and seconded by Supervisor Kennedy that the Highway Bills on Abstract #12 dated December 1, 1993 in the amount of $4,017.07 be paid. five (5) Ayes Carried Letter frora Gregory Sutton, Environmental Engineer NYSDEC, Re: The proposed Remedial Action Plaif for the T.N.T. Battery Site, 8338 Boston State Rd. Received and on file in the Town Clerk's Office. Letter received frora William Bouteiller, NYS Dept. of Public Services to John Mostel, Re: National Fuel Gas Notice of Meetings. Received and on file in the Town Clerk's Office. Letter received from Theodore Osborne, Chautauqua County, Re: Landfill Space. Supervisor Kennedy referred this letter to the Refuse Solid Waste Committee Chairman, Don Wohlhueter. Kevin Hesse, 8770 Boston State Rd: Asked about the drainage situation at his property at 6657 Redwing Drive. Supervisor Kennedy: The Town Attorney is preparing easements to be presented to both Mr. Hesse and his neighbor and if acceptable the Town will reraove trees which were placed on the Town right-of-way. Letter received from Herbert Klein resigning his membership on the Boston Planning Board, effective November 18, 1993. Supervisor Kennedy directed the Town Clerk to send Hr. Klein a letter thanking him for his outstanding service to the Town of Boston. A raotion was raade by Supervisor Kennedy and seconded by Councilman Wohlhueter to accept the resignation of Herbert H. Klein. five (5) Ayes Carried Letter received from Paul Jusko, 7212 Tricia Lane requesting to be appointed to the Boston Town Planning Board. A motion was made by Supervisor Kennedy and seconded by Councilman Wohlhueter to appoint Paul Jusko to the Boston Planning Board, term to expire 2/1/95. five (5) Ayes Carried Application for an open road cut: Kevin Hesse, 6657 Redwing Drive. A "recommendation was received from the Town Engineer to approve the permit as presented. Town Attorney Perley: The applicant raust have his contractor supply me with the bonding material, the cost of the inspection, the cost of the engineering, and the permit fee. J
