REGULAR BOARD MEETING<br />

DECEMBER 1, 1993<br />

TOWN HALL<br />

7:30 P.M.<br />

Present were Councilman Mark W. Flowers, Councilman Don A.<br />

Wohlhueter, Councilman David G. Zimmerraan, Councilman Milton I.<br />

Wittraeyer, Supervisor Richard L. Kennedy, Town Attorney Michael F.<br />

Perley, and Highway Superintendent Eugene E. Ruchalski.<br />

A raotion was made by Councilman Zimmerman and seconded by<br />

Councilraan Wittmeyer to accept the correction and adoption of the<br />

rainutes of the November 17, 1993 Regular Board Meeting.<br />

five (5) Ayes Carried<br />

A motion was made by Councilman Wohlhueter and seconded by<br />

Councilmaii Zimmerman that the General Fund and Special District<br />

Bills on Abstract #12 dated December 1, 1993 in the araount of<br />

$5,918.63 be paid.<br />

five (5) Ayes Carried<br />

A raotion was made by Councilman Wittmeyer and seconded by<br />

Supervisor Kennedy that the Highway Bills on Abstract #12 dated<br />

December 1, 1993 in the amount of $4,017.07 be paid.<br />

Letter frora Gregory Sutton, Environmental Engineer NYSDEC, Re: The<br />

proposed Remedial Action Plaif for the T.N.T. Battery Site, 8338<br />

Boston State Rd. Received and on file in the Town Clerk's Office.<br />

Letter received frora William Bouteiller, NYS Dept. of Public<br />

Services to John Mostel, Re: National Fuel Gas Notice of<br />

Meetings. Received and on file in the Town Clerk's Office.<br />

Letter received from Theodore Osborne, Chautauqua County, Re:<br />

Landfill Space. Supervisor Kennedy referred this letter to the<br />

Refuse Solid Waste Committee Chairman, Don Wohlhueter.<br />

Kevin Hesse, 8770 Boston State Rd: Asked about the drainage<br />

situation at his property at 6657 Redwing Drive.<br />

Supervisor Kennedy: The Town Attorney is preparing easements to be<br />

presented to both Mr. Hesse and his neighbor and if acceptable the<br />

Town will reraove trees which were placed on the Town right-of-way.<br />

Letter received from Herbert Klein resigning his membership on the<br />

Boston Planning Board, effective November 18, 1993. Supervisor<br />

Kennedy directed the Town Clerk to send Hr. Klein a letter thanking<br />

him for his outstanding service to the Town of Boston.<br />

A raotion was raade by Supervisor Kennedy and seconded by Councilman<br />

Wohlhueter to accept the resignation of Herbert H. Klein.<br />

Letter received from Paul Jusko, 7212 Tricia Lane requesting to be<br />

appointed to the Boston Town Planning Board.<br />

A motion was made by Supervisor Kennedy and seconded by Councilman<br />

Wohlhueter to appoint Paul Jusko to the Boston Planning Board, term<br />

to expire 2/1/95.<br />

five (5) Ayes Carried<br />

Application for an open road cut: Kevin Hesse, 6657 Redwing Drive.<br />

A "recommendation was received from the Town Engineer to approve the<br />

permit as presented.<br />

Town Attorney Perley: The applicant raust have his contractor<br />

supply me with the bonding material, the cost of the inspection,<br />

the cost of the engineering, and the permit fee.<br />
