F i 3- IOWN OK BOS I ON RESOLUTION 1993 45 At a regular meeting of the Town Board of the Town of Boston, Erie County, New York, held at the Tovjn Hall, 8500 Boston State Road, in said town on the 17th day of November, 1993 at 7:30 P.M. Eastern Daylight Saving Time, there were PRESENT: Richard L. Kennedy Milton I. Wittmeyer David G. Zimmerman Don A. Wohlhueter Mark W. Flowers Supervisor Councilman Councilman Councilman Councilman Councilman Wittmeyer presented the following resolution and moved its adoption: WHEREAS, Ray and Karen Weishaar have requested to receive water as an out-of-district customer of Water District #1 of the Town of Boston, New York on property locally known as 7509 Boston State Road, Boston, New York, NOW THEREFORE BE IT RESOLVED, that the Town Board hereby approve the request of Ray and Karen Weishaar to receive water from Water District #1 as an out-of-district customer upon the following terms and conditions: (1) Permission is granted for one additional residential tap in at 7509 Boston State Road. (2) Ray and Karen Weishaar shall pay customary district charges for district residents receiving service. (3) Ray and Karen Weishaar shall be responsible for obtaining all easements necessary to transmit the water from the current main to the respective residence. (4) All expenses with regard to extending or upgrading the existing water service shall be not be a charge against Boston Water District #1. (5) That Ray and Karen Weishaar acknowledges that they may be liable for additional district charges in the event of the formation of any additional Water Improvement and/or Water District. (6) This resolution shall be subject to approval of the Erie County Water Authority. A ] CJ ] REGULAR BOARD MEETING NOVEMBER 17, 1993 TOWN HALL 7:30 P.M. A motion was made by Supervisor Kennedy and seconded by Councilman Zijnmerman to approve the temporary Certificate of Occupancy for lot #10 in the Boston Hills Estates and return the payment for lot #5. five (S) Ayes Carried Katherlne Falkides, Boston Hills Estates, requested that Town Clerk Shenk hold the check until Lot #5 is approved. A request was made by residents of the Crestwood Circle.area to have a 50 ft. right-of-way opened that has been recently closed. Supervisor Kennedy commented this seems to be a legal matter as to the proper_ownership of this piece of land. This will be referred to the Towh Attorney. Town Attorney perley will arrange a raeeting with the people on Crestwood Circle. RESOLUTION 1993 - 45 WEISHAAR OUT-OF-DISTRICT WATER SERVICE At the recommendation of Recreation Director Gerald O'Brien a motion was made by Councilman Wohlhueter and seconded by Councilman Wittmeyer to appoint the following to the Friday Night Recreation Program, term to expire 12/31/93. Attendants 5.50/hr HRS/WK 6hrs 6hrs Carried A motion was made by Councilman Wittmeyer and seconded by Councilman Zimraerman to appoint the following as Boston Fire Police, term to expire 12/31/93: Dennis Emerling, Richard Emerling, Dennis Kramer, Eugene Ruchalski. five (5) Ayes SUPERVISOR REPORT Carried Supervisor Kennedy received a comraunication from the NYSDEC, Re: Notice of Public Hearing for the (PRAP) Proposed Remedial Action Plan for the TNT Battery hazardous waste site at 8338 Boston State Road. This hearing will be held at the Town Hall on 12/7/93, 7:00 P.M. thru 9:00 P.M.. All those interested please attend. A motion was raade by Supervisor Kennedy and seconded by Councilman Flowers to appoint Gary Gomlak, 8719 Park Drive to the Conservation Advisory Council, term to expire on 3/1/96. five (5) Ayes TOWN CLERK REPORT Carried A motion was made by Councilman Wittmeyer and seconded by Councilman Flowers to schedule a Public Hearing for the annual renewal of the Emergency Squad contract at 8:00 P.M. and Boston Historical Society contract for 8:05 P.M. on December 15, 1993. five (5) Ayes Carried J /
