RESOLUTION 1993 45<br />

At a regular meeting of the Town Board of the Town of<br />

Boston, Erie County, New York, held at the Tovjn Hall, 8500<br />

Boston State <strong>Road</strong>, in said town on the 17th day of November,<br />

1993 at 7:30 P.M. Eastern Daylight Saving Time, there were<br />

Councilman Wittmeyer presented the following resolution and<br />

moved its adoption:<br />

WHEREAS, Ray and Karen Weishaar have requested to receive<br />

water as an out-of-district customer of Water District #1 of the<br />

Town of Boston, New York on property locally known as 7509<br />

Boston State <strong>Road</strong>, Boston, New York,<br />

NOW THEREFORE BE IT RESOLVED, that the Town Board hereby<br />

approve the request of Ray and Karen Weishaar to receive water<br />

from Water District #1 as an out-of-district customer upon the<br />

following terms and conditions:<br />

(1) Permission is granted for one additional residential<br />

tap in at 7509 Boston State <strong>Road</strong>.<br />

(2) Ray and Karen Weishaar shall pay customary district<br />

charges for district residents receiving service.<br />

(3) Ray and Karen Weishaar shall be responsible for<br />

obtaining all easements necessary to transmit the<br />

water from the current main to the respective<br />

residence.<br />

(4) All expenses with regard to extending or upgrading the<br />

existing water service shall be not be a charge<br />

against Boston Water District #1.<br />

(5) That Ray and Karen Weishaar acknowledges that they may<br />

be liable for additional district charges in the event<br />

of the formation of any additional Water Improvement<br />

and/or Water District.<br />

(6) This resolution shall be subject to approval of the<br />

Erie County Water Authority.<br />

Seconded by Supervisor Kennedy and put to a vote which<br />

resulted as follows:<br />
