L ifi ] 1 ] REGULAR BOARD HEETING NOVEMBER 17, 1993 Present were Councilman Mark W, Flowers, Councilman Don A. Wohlhueter, Councilman David G. Zimmerman, Councilman Milton I. Wittmeyer, Supervisor Richard L. Kennedy, Town Attorney Michael F. Perley and Highway Superintendent Eugene E. Ruchalski. A raotion v;as made by Supervisor Kennedy and seconded by Councilman Wittmeyer to accept the correction and adoption of the minutes of the November 3, 1993 Regular Board Meeting. five (5) Ayes Carried A motion was made by Councilman Zimmerman and seconded by Coundilraan Flowers that the General Fund and Special District Bills on Abstract /llA dated Noveraber 17, 1993 in the amount of $58,229.07 be paid. five (5) Ayes Carried A raotion was made by Councilman Wittmeyer and seconded by Councilraan Ziramerman to approve the correction of Abstract #11 dated November 3, 1993 as follows: Vouchers #855, 856, 857, 858, 859 (Election Inspectors) From: A1460.1 Elections, Per Serv. To: A1460.4 Election, Cont. five (5) Ayes Carried A motion was made by Councilman Wittraeyer and seconded by Councilman Flowers that the Highway Bills on Abstract #11A dated November 17, 1993 in the amount of $10,040.51 be paid. five (5) Ayes Carried Letter received from Philip M. DeGaetano, P.E. from the Bureau of Water Quality Management, NYSDEC, with regard to the Federal Stormwater Management Regulations adopted October 1, 1992, received and on file in the Clerk's office. Letter received from John Agostino, NYS Disaster Preparedness Commission, advising that a check will be forthcoming in the araount of $1,124.00 for emergency snow plowing assistance provided during the blizzard which occurred on March 13, 1993. Letter received from R. J. Russell, NYSDOT, acknowledging receipt of the Town of Boston's request to lower the maximum speed limit on Boston State <strong>Road</strong>. A traffic safety study will be conducted. Letter from Melvin Kase, Erie County Highway Department, requesting the Town of Boston sign and return the 1993-94 winter season invoices for payment of snow and ice control expenses. A motion was raade Councilman Wohlhueter and seconded by Councilman Wittmeyer to authorize the Supervisor to sign the 1993-94 winter season snow and ice control expenses contract. five (5) Ayes Carried Letter received from Alan J. Laurita, Envirogas Inc. notifying the Town of their intent to Drill well: W. Harder #1, received and on file in the Clerk's office. A raotion was made by Supervisor Kennedy and seconded by Councilman Ziramerman to approve the following 1994 Final Budget Correction to the Refuse and Garbage District. Approv/Oth Uses 505,440.00 five (5) Ayes Est Revenue .00 Unexp Bal 5,184.00 Amt Raised by Tax 500,256.00 Carried J _J
L ?C? REGULAR BOARD MEETING NOVEMBER 17, 1993 TOWN HALL 7:30 P.M. A letter was received from the Planning Board v/ith regard to the Czajka request to build a garage in the Boston Hills Estates. It was the consensus of the Planning Board that this request be denied. The request frora the Town Board of the Planning Board to comment on the current Mobile Home Court Law that a garage be considered living space was replied to as follows: this was placed to prevent overcrowding, a provision was given to a small storage building, and a garage would take away from the open look of a mobile home court. The developer of Boston Hills Estates was asked to give up one lot to add additional area to the remaining lots. Katherlne Falkides, Boston Hills Estates: It was never discussed with the developer to give up one lot to add additional area to each lot so a garage could be considered in the future. Browney Czajka, 5631 Northside Drive: should be changed. This was a "bad law" and Katharine Falkides: The Town Board has the jurisdiction to raake an exception at any Board meeting. Councilraan Wittmeyer: We don't want to raake a decision now, we will let the new Board make it. Councilman Flowers: There is no tirae to make a decision. This would involve changing the law because if we do it for one, we must do it for all. Councilman Zimmerman: I agree with Councilman Wittraeyer. Councilman Wohlhueter: We must abide by the law as it is now. Supervisor Kennedy: I agree. Town Attorney Perley: The maximum lot coverage is 20% whether it is living space or not. A motion was made by Councilman Wohlhueter and seconded by Councilman wittmeyer to deny the request of Browney and Marion Czajka to build a garage in the Boston Hills Estates. Councilman Flowers nay Councilman Wohlhueter aye Councilman Zimmerraan aye Councilman Wittmeyer aye Supervisor Kennedy aye four (4) Ayes one (1) Nay Carried A letter was received from the Planning Board with regard to the hiring of a Town Planner. It is their recommendation to hire Mr. Richard F. Brox. Supervisor Kennedy commented that he would like to interview Mr. Richard Brox before Town Board approval. A motion was made by Councilman Wohlhueter and seconded by Councilman Zimmerraan to invite Mr. Richard Brox to the Agenda Review Meeting on November 29, 1993. five (5) Ayes Carried A raotion was made by Supervisor Kennedy and seconded by Councilman Zimmerman for the permit for temporary construction trailers, previously issued to Cold Spring Construction, be extended to expire on December 31, 1994, pursuant to Town Code Sec.123-118.B. five (5) Ayes Carried w^ J J '1
